Karmady, you are an attorney, correct? I wrote a post yesterday (on CMJA thread) that I think this judge just gets annoyed with Juan for his "flamboyant" ways. I also wrote that yes, Juan appears to be rude sometimes, for example, when the opposing counsel gives him an exhibit or paper or something, he doesn't even acknowledge them or say thank you or anything....like one time Mehrens was giving him a stack of papers, and Juan LITERALLY completely ignored him, and then Mehrenes said "well, do you want it?" and Juan (without ever looking up) said "yeah, just put it there." LOL. Sometimes I think he takes it too personally with the opposing counsel, I don't know if this is for the jury, or if he really feels that way.

But I still love him!

I think most lawyers take the cases personally, but can usually act respectful to the opposing counsel. It does bother me sometimes that he is so rude to opposing counsel, no matter how he feels about them. That's why has been described as a "pariah among defense attorneys" for playing "hardball." I get that. But, hey, that's just Juan. You just have to deal. As long as he acts ethically, then there's nothing anyone can do.

i will never understand that mentality....if i was on a jury for a case like this and the evidence and testimony points to the cop being guilty like it does imo here i would find it easier to vote guilty since cops are meant to be there to protect people not gun them down on a whim

Josie, I think a lot of people (esp. probably the peole the defense wanted on this jury) would give cops more leeway due to their job. I thought Chrisman was able to put a good line in there "I don't have the option of running away." I wish he wouldn't have been able to say that, it might stick with some jurors, just like Juan's line "and is it your job to kill people?" People know that cops put themselves in danger and have to face it, as an inherent part of the job. And yes, a lot of people know that most other poeple would just be able to run away from a bad situation. Whereas the cops don't have that choice. Ugh, the verdict-waiting is gonna be very hard on this one, 'cause I honestly have no idea what this jury could be thinking.

If they look at the facts of evidence, it's CLEAR that Chrisman is guilty. But what if they say, look it was a bad situation, maybe he really did perceive a threat, even if there was NO threat. This is what i"m afraid of.

I would not be surprised if that's what happens. Cops are usually given a lot more leeway than any other common citizen, because they're cops, they're more respected. I can see him getting a lesser charge or being altogether acquitted. I mean, Daniel was high and acting a bit belligerent. Maybe he was scared and did feel threatened. Though that totally contradicts Virgillo's version of events. So...we'll see what happens.

I haven't been on the thread but I have read that he is having issues, staying out, not coming home and his FB friends seem exasperated.

I wonder about this kid. His cover photo is a picture of him from trial. He seems like a young sociopath.

Why not let it in? It shows the type of police officer he was, Out of control! They let Daniels previous drug use in and he is the VICTIM. :stormingmad:

Girls, bear with me. I re-watched some of Chrisman's testimony last night and came up with a few things. I believe Jewels has kindly posted the links for his testimony above.

Okay, most of the interesting part was part 3. I noticed that when he was describing his "first contact" and stuff that happened in the very beginning, there are inconsistencies in his story. He says he did one hold to try to get him outside - HOLD 1. Then he says "I put my arm underneath his, and he lunged back." - HOLD 2. Then he says, "At the point when I pulled my gun out, we were at the doorjam. The suspect lunged backwards, I took out my pepper spray." The pulling of the gun out here is where he claims he told Daniel to call off the dogs and he did the "sweeping motion" with the muzzle of the gun, with the gun pointed towards the ceiling. Then he says, "THe second time I grabbed him, he pulled towards the doorjam. I pulled my gun aout and pointed it at the dog that was advancing, he lunged backwards, I holstered and advanced on him. He pulled away, and I took out my pepper spray." - HOLD 3 (pepper spray).

All of the above means that he took out his gun DURING Hold 2, at the doorjam of the door. Yet he claims that he took his gun out and told Daniel to call off the dogs, and then did a "sweepoing motion" with the gun, raising gun to the ceiling and telling Danny to call them off. Nuh uh. If he had a hold on Danny, why would he be doing sweeping motion with the gun? No, I believe HOLD 2 is where he pulled the gun out and held it at Danny's temple = Vergillo's version. Even Chrisman's own version of his own story supports this version. He says that during HOLD 2 , he grabbed Danny underneath arms, pulled him towards the door....and THIS is where he pulls the gun out. It has to be DURING HOlD2, it can't be any other way if we even use Chrsiman's own version of what happened.
Hopefully some of the jurors will catch this.


Everything he is saying is supporting Vergillo's version. I completley believe the holding gun to his temple version.

There were also a few other things, I'll post those in a few.
