Maybe now Serg Virgillo's life can get back to normal. Or at least a close facsimile.

Not if Judicial Watch has its way.

~snip

Mark Spencer with Judicial Watch said Virgillo neglected his duties. Spencer said, "Here you had a Phoenix police officer that under oath believed that three serious crimes were taking place in his presence. Instead of engaging and diffusing the situation, he chooses to turn his head and disengage. I don't think that's consistent with the oath of office I don't think that's consistent with what we pay guys for."

not sure if the link is msm (I think it is). But the report is attributed in the article to CBS5 and I heard it on local talk radio several times last Friday, as well.

Picked up by the Google News page:

snipped:

Sentencing for the assault conviction and the manslaughter charge is set for Dec. 20. He faces anywhere from five to 15 years in prison for the assault, but both sentences will run concurrently.

Chrisman remains in custody and spoke only briefly during the short hearing Wednesday. He answered, "Yes," when asked if he agreed with prosecutors that he recklessly caused Danny Rodriguez's death.

So is that all he has to say, answer "yes" or "no"? I thought whenever someone plead guilty, they had to explain to the judge what happened, according to them?

Hi, geevee. I'm a little surprised Juan made the deal, because from what I saw during the trial, JM really wanted Chrisman to go down hard. However, and this is speculation on my part, I suspect Juan was asked to make a deal by someone above him. My thinking is, putting a cop away for second degree murder is always a hard sell. To go through another trial - with pretty good odds of ending up where you originally started, wasn't the best course of action.

Offer Chrisman a deal, make him do time for count 1 and avoid another hung jury, because really, then what? Threaten to try him a third time? Offer him a deal at that point? In my opinion, the reason the deal was made is close to the scenario I described, because as I mentioned, Juan really wanted this guy, and if the decision was solely up to him, there would have been a second trial.

As far as sentencing goes....hooboy! I have a bad track record, lol, but please, don't tell anyone else. The folks from the link you provided yesterday seem to think a 10 year sentence is in order. I'll leave that up to the experts.

bbm

I'm thinking ahead to the Judge's decision....ok, so at sentencing, does Chrisman himself say something before the judge makes his decision? Or do his lawyers? Or have those statements already been made, and the judge will just hand his decision down that day?

Because so far, Chrisman basically made it very obvious that he is "just" pleading guilty so he doesn't have to go through the trial, and more importantly, to reduce time in prison if he was ultimately found guilty in the 2-nd trial.

But his guilty plea means he is pleading guilty to manslaughter.

So shouldn't Judge Granville have to take the "remorse factor" into account? B/c Chrisman has not shown any remorse, even now after pleading guilty, no matter what the reason behind that plea was.

I hope, I hope this has some factor in his sentencing.

Thanks again, Geevee for the updates! I'm forever grateful! As you know, I'm usually over there on that other thread :)

Kind of sad that we won't be together for the re-trial, but hey, we still have CMJA left!!

I think this is all very good for the State and for Juan. He got as close as he possibly could to geting what he wanted in the end, even after a hung jury on the most "important" count.

And they don't have to go through the whole trial all over again, with I must say, a strong chance that it would be hung again since like we all know, it's very hard with him having been a cop at the time. All it would take is just 1 on that jury to hold out.

So I am very, very pleased with how this all turned out.

I hope Daniel's mother is starting to get some sense of closure, and I hope she is ok with this result.

See you all on Dec. 20th!

You're very welcome aa, sorry I didn't give you a head's up 'over there' (I did post something at TA/JA since it was JM and JA related - her retrial date depended on what happened with this one so I figured it would be allowed there).

I do agree, I think the plea bargain was the best way to go for everyone involved, esp. RC. I think he'll be allowed to say or read a statement asking for the court's mercy, maybe a shortened version of an allocution? Not too sure on that, I do hope we get the video of it all - not sure either if Danny's Mom or family will get to read a statement but I wouldn't be surprised. I too hope they have felt some amount of peace now that this part is almost behind them, bad enough to lose your son, worse when it's a cop you have to fight in court to have any sense of justice.

See you Friday at 1:30 (per docket) - remember, no more AZ funny-time so regular Mountain time (whatever that is for your timezone).

So, RC copped to a lesser charge in order to serve a concurrent sentence? It will be very interesting to see what kind of sentence Granville hands down. I bet he is a less is more kind of guy. 5 years, out in 3 is my guess.

I too, hope the judge considers Chrisman's "remorse factor", but who knows. And as far as I'm concerned, it shouldn't matter why Chrisman made the deal. He could tell the world that a grasshopper advised him it was the right thing to do. The deal was made, the sentencing guidelines are there, let's hope for the best.

It's not bad either, geevee. Not if you're familiar with Judicial Watch :floorlaugh:

It didn't go well for them this past Spring when they sued a group of Phoenix Police detectives. The fact that they're blaming Officer Virgillo for Chrisman's actions comes as no surprise, imo.

LOL Thanks for the link A.D.A, so I suppose Judicial Watch doesn't believe in what's good for the goose, eh? Do other suspects <ever> get their DNA back and have it wiped off the database? Is a search warrant required for any buccal swabs? I have no knowledge of these things but it seems like treatment should be identical for everyone, civilians as well as LE.

I hadn't heard of that case before, is his death still considered 'a mystery' and unsolved? I may have to look that up.

I hope their suit against SV doesn't go far or has a similar outcome, I think he's been honorable and has been put through enough. After seeing RC's attitude and behavior from arrival at DR's, SV had real reason to worry that his safety may be in danger as well. It's very unfortunate that he couldn't stop RC but very brave to take the actions he did afterwards, imo.
