GUILTY AZ - Daniel Rodriguez, 29, fatally shot by Phoenix PD officer, 5 Oct 2010 #3

So it is up to us to keep this thread alive not only for the assault sentencing but for another trial. Unless we start a new thread when it gets closer to a maybe new trial.

I am excited! It will be fun spending the cold winter days with you all watching Juan do his thing.

Oh I see they got around to posting that there were jury questions, the content of which we still don't know.

I heard it twice on the same day. Both times it was on one of the every half-hour (?) news breaks on KFYI and both times it was Nicole Franks doing the intro, so probably just a re-run the second time. I heard it once in the morning and again on my way home from a dinner that got done at 9 pm. I haven't been able to find it either. I even checked the KFYI website when I originally posted, but not since. I do remember that she said the interview was WITH KFYI which is kind of unusual ime.

There was nothing more to it than what I posted since it was just the news "updates" which last like two minutes total. But the clip was a man talking and the clip was introduced as an alternate juror speaking. He didn't say anything (that I heard) about the details of the case or his reasoning.

Swear on a stack of Bibles I'm not making it up and I only had one very lightly poured glass of wine at dinner :)[/QUOTE]

:floorlaugh::floorlaugh:

No Karmady of course I would not think you were making it up...just tried to find it somewhere so I could listen to the (thankfully!) alternate juror and then yell and break a glass or something. LOL! I get now about the news update and that it was very short and just snippets of what he said. They might have even bombarded him on the street or something like they tried to do with the Arias jurors. If it was a sit-down, hopefully they'll put up the whole interview soon.

Well thank you for your faith in me :) Seriously, though, I just looked all around on google and on the KFYI web site again and I STILL don't see it. Very strange. I may have to call the station. If I hadn't heard the exact same thing twice I would be doubting myself right now!

Woohoo!! But does this mean it's for certain that it's going to re-trial? Also what does the "oral arguments" mean...what exactly r they gonna argue?

I think it's the defendant's motion for a new trial. The motion entry cites Rule 24.1

http://www.arizonacrimelaws.com/24_1.htm

This is the pertinent part of the rule

Rule 24.1. Motion for new trial

a. Power of the Court. When the defendant has been found guilty or sentenced to death by a jury or by the court, the court on motion of the defendant, or on its own initiative with the consent of the defendant, may order a new trial or, in a capital case, an aggravation or penalty hearing.

haha, that's what I figured. I don't have a strong opinion about the case because I didn't follow it. Just trying to keep y'all safe from getting your hopes up too much. lol I do hear about it every so often on the local news and know that everyone here wants all of the details all of the time. So when I have some info, I try to share it.

I really appreciate your clarifying it Karmady. I started to wonder why JM wouldn't just file the charges again instead of asking for a new trial, but then I was also thinking RC's attnys would file an appeal for the conviction and not ask for a trial, so really glad to know where the motion came from. I'd like to think we'll get to see the oral arguments live but even getting a vid of it later may be hoping for too much (considering how the trial went).

There is a thread on WS about this murder. There is a great article from Deseret News at the start of the thread that explains everything better than I can do here. What intrigues me is that he is a doctor as well as an attorney and the mistress (naturally he has one) is named Gypsy...can't make this stuff up.:floorlaugh:

Ah, I see, he's one of those too smart for his own good....he thought he could outsmart the system!

Of couse, on the other thread I'm on, if I said this someone would accuse me of using incorrect logic....so I'm putting a disclaimer: no, I do not think all doctors who are attorneys as well are murderers.

10/7/2013 OBJ - Objection/Opposition. - Party (001) 10/7/2013

NOTE: OBJECTION TO MOTION FOR NEW TRIAL (RULE 24.1)

No addition to the calendar (yet), I would guess oral arguments or something along those lines will be coming, or just a ruling?

Ladies, I have to say I miss all of you so much! On the other thread I'm on (Amanda Knox), it's like a hung jury over there. I have to constantly be on my toes over there....it is pretty mind-taxing. Makes my brain hurt....LOL! I cannot imagine what Juan and also the defense attorneys go through every day during trial! Juan must be so exhausted, between CMJA and Chrisman back to back, how does he do it??

This case made me think too, of course, but it helped that we were all on the same page and helped us to conserve energy and focus on getting justice for Danny!

I guess it's good for my brain....LOL!!

aa I read that thread and dont bother commenting, reminds me of the jbr threads and treyvons, probably not as much snark but I still refuse to comment lol.

She is guilty as sin. Another arias, although she is not as cruel I suppose.

That trial I was talking about is about a girl who stabbed her mum like 50 times. Her lack of remorse reminds me of the she devil as well.

Isabella Guzman is who I think you mean, Josie, Here's the thread someone started here, no clue where they are legally in it:

CO-18 year old stabs mother 79 times - Websleuths Crime Sleuthing Community

I haven't paid much attention to Knox' case although I caught the tail end of whatever program she was on the other evening and her facial expressions just seemed off, or not true to what she was saying. But who knows how someone will behave if they're accused and they know it looks like they could have done it but they know they didn't - I have no idea how I'd act throughout the course. But there are rock solid opinions on both sides and I really have none either way so I just keep out of it. lol

Think there's any chance of RC being granted another trial on the assault? Does anyone know if the sentencing going to streamed - maybe someone could Tweet-a-Diva and see if they know anything.

Hey Geevee! I don't think any way he will get another trial on assault. That is just a motion all defense's probably put it just in case some miracle happens and the judge decides to grant it. Like Jodi's lawyers and all their motions to dismiss the whole trial over some little thing, or motions to get removed from the case when they knew that wouldn't happen. There was no issue in this trial, everything was presented fairly and the jury convicted, so IMO there is nothing the judge can do.
