Mother of missing Tempe baby has to keep lawyer

Johnson's lip quivered at the mention of her son, but she otherwise sat quietly in shackles and answered Ryan's questions with one-word responses.

Ryan granted Smith's motion to excuse Johnson from attending future hearings in her case except during trial or when otherwise ordered to do so. He also denied a motion by Smith to ban video and still cameras from the courtroom.

Smith had said the media coverage would taint potential jurors and deny her client the right to a fair trial, while media attorneys argued it was their clients' constitutional right to record the proceedings for the public and that any tainted jurors can be vetted before the trial.

Police don't know whether Gabriel is alive.

In her motion, Johnson wrote that Smith was "inadequately representing" her, adding that Smith had discussed the case of an unrelated client with her and that she thought Smith had been discussing her case with others.

Judge Timothy Ryan denied Johnson's request to fire Smith at a hearing Wednesday, telling her why Smith didn't file a motion to change her release conditions, and that she has been acting properly as her attorney.

"Right now the reality is they have a case involving baby Gabriel, and the police want to know where baby Gabriel is located," Ryan said. "So when your attorneys come to you with requests for information from the police ... the reason they're doing that isn't to pressure you, it's their ethical responsibility to talk to you about those things."

Elizabeth Johnson asked the judge to fire her attorney Vanessa Smith.

Johnson says Smith does not file the motions she requests and pressures her to do things she doesn't want to.

That request was denied.

A Phoenix judge on Wednesday refused to fire the lawyer defending the mother of an Arizona baby who has been missing for nearly three months.

Elizabeth Johnson, 23, had asked the judge to dismiss attorney Vanessa Smith, saying in a motion handwritten on notebook paper that Smith ``does not file motions I request and pressures me to do what she wants.''

Johnson's son, Gabriel, was 8 months old when he was last seen in late December in San Antonio, and police don't know whether he's alive. Johnson, who remains in jail, has pleaded not guilty to kidnapping, child abuse and custodial interference in the case.

The newest private investigator to join the search for baby Gabriel says he has made significant progress. Ken Gamble, of Gamble Investigations Inc., interviewed several witnesses in San Antonio who said Elizabeth Johnson had a male companion starting the first night she was in San Antonio.

Gamble was in the audience during a hearing Wednesday morning in Phoenix, when a judge denied a request from the mother of missing baby Gabriel Johnson for a new lawyer.

Gamble wanted to meet with Johnson, but she has yet to agree. But even without that meeting, Gamble told CBS5 that there is no evidence that Johnson killed Gabriel. He said everything points to her giving him up in an underground and illegal adoption. Gamble remains confident Gabriel is still in the United States.

Elizabeth Johnson, the mother of Baby Gabriel, who has been missing since December, lost two legal skirmishes in Maricopa County Superior Court on Wednesday, including one over who will represent her.

Johnson had asked for a new defense attorney, based on arguments that her current court-appointed lawyers are not attentive enough to her needs. Judge Timothy Ryan denied her request, as well as a second from her attorney to keep news and television cameras out of the courtroom during Johnson's appearances.

Regarding motions Vanessa Smith would not file, the judge informed Johnson that before he could reconsider her terms of release - she is being held on $1 million bond - there must be new facts to present. Johnson's lawyer could not, at Johnson's whim, just ask again for something that had already been denied, Ryan said.

Johnson said she also felt that her lawyer was conveying information about her case to other clients in jail.

Cameras are regular fixtures in criminal courtrooms, with state and federal laws permitting them fundamentally established.

The father of missing baby Gabriel Johnson was a guest on a local radio station's morning show Friday to discuss his efforts to raise funds to aid in the search for his son.

Logan McQueary was interviewed on KWSS' Morning Infidelity show while at an event to raise money to help find his son, who was last seen Dec. 26, 2009, with the boy's mother, Elizabeth Johnson, in San Antonio, Texas.

As part of the fundraiser, which was held at a T-Mobile store in Scottsdale, McQueary was auctioning off a signed football and raffling "Team Gabriel" T-shirts signed by Alice Cooper.

"Most of the money's been going towards helping find Gabriel," McQueary said at the event. "The unfortunate thing is that everything does cost money, and looking into people and doing background checks &#8230; costs a lot of money."

McQueary also said that he's hopeful his son will be found. "We have a lot of confidence in everything that we're doing, and we're getting a lot closer to finding him," he said.

He also said he plans to move to San Antonio on March 28 to continue the search for his son. McQueary said he's already found a job and a place to live.

Now, an inside look at Elizabeth Johnson's stay in San Antonio is emerging.

A new private investigator working on the case says he discovered Johnson had a male companion while here.

But just who that man was and how he interacted with her is not clear, the investigator said.

Toby Keith's Bar and Grill in Mesa is another business lending their support to the father of missing baby Gabriel.

Toby Keith's Bar is teaming up with Jessica's Law Now to help raise money for Logan McQueary.

On April 10, the bar will host a live auction and benefit concert featuring country artist Nick Nicholson.

All the funds raised will go to paying for the search efforts.

"All of this money we're raising is going all towards my son to help find him, helping the PI. He's donating all of his time he flew from Australia to here to help us out. His team has been looking all over the place for him and going on different leads that they have," says McQueary.

The paternity allegations recently surfaced on a blog. Nevertheless, Gabriel's father, Logan McQueary, and his attorneys said they have all they need to prove McQueary is the boy's father. McQueary even offered a baby photo of himself, saying the similarities between his appearance at that age and Gabriel's are even more proof he's the father.

McQueary, who is moving to Texas, and his attorneys said they regretted they had to take time out of the search for Gabriel.

This isn't the first time Gabriel's paternity has been called into doubt. When Johnson and Tammi Smith, who wanted to adopt Gabriel, went to the courthouse to file custody paperwork, Johnson listed Craig Cherry as a potential father of her baby.

Cherry, who is Smith's first cousin, told police that he had never met or spoken with Johnson. Police said they have evidence that Smith filled out the paperwork, knowing Cherry could not be the father, put his name down anyway.

Logan McQueary was awarded sole legal custody of missing baby Gabriel Johnson during a custody hearing late Friday morning.

Johnson never made eye contact with McQueary. This was the first time the baby's parents had seen each other in person since the boy's disappearance. McQueary appeared visibly upset at being in the same room with Johnson. Throughout the hearing, McQueary welled up with tears. He appeared particularly upset when Johnson refused to give any information on the baby.

In the next few weeks, Superior Court Michael McVey will consider holding Johnson in contempt of court for failing to answer his questions during the civil hearing today. Her attorney believes she will not be held in contempt because of the circumstance of her concurrent criminal case and her constitutional right not to incriminate herself.

Elizabeth Johnson and Logan McQueary, Gabriel's parents, came face-to-face for the first time since the baby disappeared. In court Friday, not once did they appear to make eye contact.

When the judge questioned Johnson, she pleaded the 5th Amendment eight times, saying through tears, "I invoke my right to remain silent." Johnson is already facing kidnapping and child abuse charges, and refused to say anything more on the whereabouts of her baby. She previously told McQueary she killed Gabriel.

McQueary admitted to burglary, probation violations, and drug use, including cocaine, LSD, marijuana, mushrooms and methamphetamine. But he says he's clean now. Given the choices, the judge ruled: "Awarding Logan Scott McQueary sole legal custody of the party's minor child Gabriel Scott Johnson."
