One of the questions that was being addressed in the LVD trial thread that pertains to this case is whether MBP was driving the getaway car for AC when he shot at BB. I had wondered about it myself for a couple reasons.
1. It was pointed out that BB kept saying “they” when he referred to the occupants of the Jeep.
2. BB said he thought there had to be a driver because it happened too fast - presumably referring to how soon after the shot, the Jeep drove away.
But it didn’t really seem likely to me that she would be in the car with her toddler or that AC would have had time to pick her up after BB dropped off the toddler and be back at BB’s and observed by neighbor around 8:40am. So i did a little more digging into the Gilbert PD reports and am now convinced that MBP was not the driver nor even in the vehicle that day.
I think that BB initially said “they” when referring to the occupant in the Jeep more in the sense of not knowing whether it was a male or female so he didn’t say he or she. I’ve used “they” myself when trying to relay info about someone when I KNOW it’s only one person but don’t know whether it was a man or a woman.
I think he thought it happened faster than it did when he said it had to be more than one person because it happened too fast. The shooting itself did happen fast and so did BB driving away. But I’m not sure that he realized that he drove a few blocks before he pulled over by the park and observed the Jeep behind him that turned right a block and a half or two blocks before he stopped at the park. I think in the time that he drove that extra block & a half and got parked that AC had time to move to the driver’s seat and drive away himself and be observed turning right by BB.
Additionally, the phone records show that AC was in a church parking lot about 2 miles from BB’s house and at 7:19am and drove directly to BB’s house from that parking lot. So he didn’t have time to go get MBP after BB dropped the toddler off at her house after taking the older ones to school and daycare. AC got to BB’s shortly after BB left and did not leave until after the shooting.
Also, one of the neighbors who saw the Jeep parked and idling said that he was very close to the vehicle and could see that the driver’s seat was pushed forward all the way into the steering wheel. He couldn’t see in the rest of the vehicle so he didn’t observe any occupants but could only say for sure that no one was in the driver’s seat.
So I am convinced that MBP was NOT the driver or even there when AC shot at BB.
However, I still think she was involved as there doesn’t seem to be any way that AC would know where Brandon lived unless MBP gave the address to him or LVD. Nor do I see any way that AC would have known BB had left his house unless she told him. And it appears he knew exactly when BB left. By the way, in case you didn’t know this…BB’s son had a phone with GPS and MBP had access to the data so she knew when he left the house.
