I don't get this. If the questions before lunch were inappropriate, the witness should have been held over until after lunch. If I were on the jury, I wouldn't like that. Didn't Dr. Cunningham testify for the defense?

In my state, the jury deliberates on what is gleaned at trial via the prosecution and defense presenting their cases and asking their questions. If the jury has questions during deliberations they direct them to the judge and if appropriate the judge will respond, but no juror gets to direct questions to any witness at any point during a trial. It is the responsibility of the state and defense to present their cases for jury consideration; if either side leaves questions in the jurors' minds it may affect the verdict. To me, jurors asking questions of witnesses is a very strange concept.

LOL Josie Since I live in the wild west compared to Vermont my motto is 'live free or die tryin'.

Krkrjx, jurors asking questions was a bit strange for me too but I really like the concept, since they're the ones having to make the decision in the case I think it's quite appropriate for them to ask for info that they feel they need to have as complete a picture as possible. I hope all states will go to this and empower the jurors with as much information as they feel they need to render a good verdict.

Vermont is Freedom and Unity. Vermont is a softer, gentler version of NH.....this coming from a native Massachusetts.
