They're now asking a judge to be let out of jail before their trial begins after prosecutors said last month that they were no longer seeking the death penalty.

The child's father, Germayne Cunningham, and stepmother, Lisa Cunningham, were originally released without bond and wore ankle monitors when the case was first filed.

Now that the death penalty is off the table, the defense of both parties filed a motion to modify their release conditions.

"We're not asking you to rubber stamp what was going on before. We simply ask that you return Mr. Cunningham to the terms that he enjoyed in 2018, when the case was non-capital, which it is again," Taylor Fox, Germayne's lawyer, said during a court appearance.

"I still get to make my own independent determination," said Judge Patricia Starr.

An Australian woman awaiting trial over the death of her stepdaughter is unable to leave jail because her bail has been set at an "unattainable" $US500,000, according to her lawyer.

"We had a hearing last week with the assigned judge and she considered what she felt was an appropriate release condition, and in this case it's a half a million bond, secured bond, but none the less it's unattainable," Mr Kessler told the ABC from Arizona.

"It's really an unfortunate ruling because before the notice of intent to seek death was filed by the state six-and-a-half years ago, Lisa and her husband had been let out at their initial appearance with zero bond, just ankle monitoring.

"I can't speak for why our judge made that kind of ruling — I think it's terribly unfair."

A secured bond allows a defendant to post property or other assets as collateral in case they do not show up in court.

Mr Kessler said he intends to file an appeal against the bail conditions on Friday but "the Court of Appeals doesn't have to accept it".
