I haven't read the entire thread yet, but did the news ever report anything of substance about the other man that was killed. Why was he there? Was he living with them, or a visitor, or what?

I don't know how long he had lived with the Romeros. His hometown is 170 miles from where he was killed. He worked with the father at the power plant there and rented a room there during the week and then returned home to his own family on the weekends. He was married for 20 years and has two daughters in college, 18 and 19.

From the articles I have read I think the Romeros had recently built their home so he may have started living with them not too long ago.

Both he and Vincent had made plans that night to go help a friend work on a chest of drawers.

there is a new document filed, defense is requesting funds for an expert child psychiatrist that specializes in confessions. (fairly obvious that they would want to get the confession thrown out)

As far as what caused the murders, he just had a visit with Mama. Maybe he wanted to live with her, now he is going to get his way probably. Mr. Romans was a witness.

She seems nice but what I found strange was she never says that her son did not do this. She more or less says he is scared being in jail and she will support him.

It was at the very first of the case, Jules. She had been for a visit the weekend before this happened on Wednesday.

I don't think there is doubt that he did this. The confession video doesn't mean anything. There's much evidence linking him to the crime(s).

Someone asked how loud a .22 is when fired. LOUD. That's why it's advisable to wear hearing protection when you fire one. No matter who fired the gun, it ought to have been heard from outside of the house and down the road. That's why I can't believe that the roommate was outside of the house when the father was shot. Who would enter a house, after hearing a gunshot?

Right, she was very nondescript.

Innocent until proven guilty wouldn't be said by me if I were his mother. If I thought he was innocent I would say that clearly no matter what the term is for the law.

The bio mother has not indicated there were signs of abuse, nor has anyone else, but a defense lawyer would need to try anything to get a reduced sentence. A trial like this could go on for many weeks/months and could cost $$$. With only charging him with killing the boarder, it would be easier to a) reprimand the boy to a juvenile facility, b) decrease public outcry. AZ law allows the boy to be tried as an adult for a juvenile crime. This is a win/win situation for both the prosecution and defense.

In AZ, you cannot charge a child of 8 years, as an adult. I believe the statute requires the child to be at least 12 years old, but I'd have to double check. Also, they have already stated they will NOT be charging him as an adult (again, I don't believe they can legally anyway) so any sentence will be in a juvenile facility.

No one heard a 12 gauge shotgun blast go off in the Winkler home and it is 10 times louder than a youth 22 rifle which isn't loud.

The neighbors did hear gunshots. The officer testified that the shots that were fired in the enclosed home would be muffled but the shots fired to the outside where sound travels could be heard and they were.

This was a very quiet neighborhood.

I find this a very disturbing case, I have an 8 yr old and I wonder what happened that would cause a child to kill his parent as well as the roomate, I hope some legal organzations become involved in this case as I watched the so called confession I was apalled by LE and how they conducted themself. This little boy needed counsil present before any questioning or at least his bio mother as well as being read his Miranda (which I doubt he would understand). I truly believe that we may see an adult involved in this case.

She is not under a gag order or she wouldn't be able to be on GMA . A statement of innocence would just be her motherly opinion and would have nothing to do with the actual evidence in the case. That is what she can't comment on.....what she knows....or what she has learned concerning the case itself. etc.

Yes, but they clearly said several times that the mother was not allowed to specifically talk about the case, so I don't think she is allowed to come right out and state that he is innocent. I very much took from her comments that she thinks he is innocent, a "regular little boy." She does not discuss the boys relationship with the stepmother, which I think is curious. In listening to the confession tape again, I can definitely see where the police are putting words into the boys mouth--I really think this confession will be thrown out. I am very curious if they found GSR on the boys clothing...
