Baez Lashes out at Investigators-UPDATE Allegations of Evidence Tampering

IMO Baez needs to spend as MUCH time as he can to prepare a defense, not worry about what everyone else (LE) is doing.

How can one work on preparing a defense if you don't have one?

He should have stuck with the dp lawyer, Tenamon. He would have made sure KC got a fair trial, yet punished to the full extent of the law.

Which is why JB got rid of him.

I kept thinking of what I was going to post as I read through all the posts so far. then I remembered the stern, yet gentle warnings of the Mods about not making bad comments about the Casey Anthony Defense Team. *SIGH*

So I will content myself with saying this: If he is this upset, why didn't he say all this in court to Judge Strickland after Judge Stickland denied his motions. Perhaps he was afraid of being cited for contempt of court or something along those lines?

Now that brings up an interesting question: Could JB be nailed with contempt of court charges for what he is saying - is he not being contemptious (is that a word, or did I just make it up?) of the judge's ruling?

I believe the case with wind up won or lost in jury selection and the significant aspect of the testimony could be characterized as 'the battle of the bug men' when determining how long the body has been there.

but Alpha....they have so much more than that! This case is a three hundred and sixty degree slam dunk in my opinion! From her phone calls, forensics, texts, pings, and 144 to date witnesses for the state.

I actually think team casey makes this a 720 degree slam dunk! (so keep on keeping on team casey! Keep whinning, crying, and getting spanked by the judge. It helps the cause!)

Agree, and it is not just standard for a murder one case, it is the standard for crime scenes. The burden of proof is on the state, these are trained professionals paid for by the taxpayers, it is their crime scene until they release the property back to the owner. In most cases they don't know what charges will be related to a crime scene as usually the scene is found before a suspect is charged. Casey being charged does not give her some exemption.

It BAFFLES me that he does not seem to get that by insisting they have a right to be there he is confirming that this is Caylee's body, the location of which would only be known by the murderer. That damages his client.

No kidding, it would be so much better for him to not fight so hard, makes his Caylee was kidnapped and we dont know who or where she is theory go up in smoke. He should not be showing his concern about this area at all right now...:bang:

No, J Baez is not in contempt for talking/releasing this to the press (though I wish there had been a gag order that he was in contempt of violating,) as the judge did not ever order him to cease talking about the case to the public nor of the specific motion seeking access. Contempt requires that there BE a previous order for him to do/not do something. Here, the Order from Judge S was that he would not have access, NOT that he couldn't (continue to) complain to the press about it.

Dear Jose',

Somehow she has convinced you that these tactics will sway people into believing that you are owed the right of observation, let alone assistance to an ongoing investigation into a crime scene. Whether this crime scene is eventually indicated in the case you have set before the court to try, until it is identified as such, you and your glory-seeking publicity hound "experts" will simply have to sit on the sidelines in your collective bad wardrobes.

Please be patient. The State is making certain that there is nothing missed in this investigation.

I think that thanks to TV, and now the net, that standards for public behaviour have crashed. You get to see Jerry Springer like public behaviour becoming the admirable norm. Some people will see Baez's harping as a win for the underdog. Go figure.

I agree that there should be a gag order. I wonder why it isn't happening. Clearly Baez is needlessly heating things up, clearly is unethical, and lies and distorts everything. He's just been told by a judge, for the second time, that he has to wait, yet immediately, he hits the media with his whining.

Something is terribly wrong with the system, IMO, if he is endlessly allowed to play with both the law and the media. I just don't get why there is no gag when the chaos could be controlled.

And on a personal note- he gives lawyers a really bad name, and I find him deeply offensive. It's like he's flipping the bird to the law rather than dignifying it.

LE are playing this cautiously, that they do not have DNA definitive proof to know/say for sure. Although the Defense can say based on the visual ID it is Caylee but -- only the killer would know (and her reaction back to her attorney). Bizarre . . . to rush to the Defense when they were advocating so strongly that Caylee is alive!!!!

It appears that Jose does not comprehend what Judge Strickland said to him in response to his requests to interfere with a murder investigation.
Perhaps the judge should have responded to Jose's requests in a more understandable fashion.....Like maybe "No way Jose".
