For me, the presence of duct tape struck me as odd. Who goes on an exotic vacation and happens to have trusty ole duct tape with them? Where did the duct tape come from? Was it purchased before the killing? Brought from America? I'm curious about it. From what i understand, neither suspect left the hotel and could have purchased it after the killing . So why was it there and available?
BBM

Some ppl here calculated, after TS arrived, HM & TS did not have time to go to a store for duct tape, etc., but ---

Is it poss thatbefore TS's arrival, HM went to store once, during her several days in Bali?

Or poss that HM or TS simply asked a resort maintenance/building services/housekeeping employee for duct tape?
Maybe a couple feet of it or a roll? Easy favor for a small tip?

Or poss HM or TS packed a roll? Adding to evd of premeditation.

FWIW: This appears to be TS' jacket:

the you tube made me shudder....thinking, "omg -- what if she was still alive?"

I'm wondering that now too ... I looked up the Indonesian meaning of premeditation, and all I can find right now is the following.

They stuffed poor Sheila in the suitcase :( instead of going for help or helping her. They did not 'interfere' in her dying, and go on to help her, or even leave her to be found and helped. Sheila did not die immediately, she suffocated on her own blood .. they had the opportunity to help, and chose not to. Premeditation.

The difference between murder (Article 340) and manslaughter (Article 338) is premeditation. According to Indonesian jurisprudence and the interpretation of murder in different countries, premeditation does not necessarily imply a long-term planning of the conduct. It suffices for the perpetrator to have thought about acting and to have decided whether to take the life of the victim or to withdraw from that intention. The time for that decision to be made can be very short (minutes or seconds); rather, what is decisive is that nothing exceptional interferes with the decision.

http://www.internationalcrimesdatabase.org/Case/865/Fernandez-(Julio)/

‘Whosoever with intention and premeditation takes the life of another, being guilty of premeditated murder, shall be sentenced to death or life imprisonment or for a fixed period, with a maximum of twenty years’
Article 340 of the Criminal Code (Kitab Undang-Undang Hukum Pidana, KUHP)

Tourists buy Balinese statues - wood carvings etc, or steal them from their hosts/resorts if they're that way inclined. One of the MSM articles identified the parcel wrapped in yellow as being a cultural item.

In relation to the accommodation, having lived in the region I can share that anyone with the slightest weakness in their chests can suffer pretty badly with the high humidity, plus all that concrete keeps the environment cold. It will be hot for that first year the perps are there, but after that they'll acclimatise and the wet season will get at them - bacteria and mould spread like crazy. Any cuts fester and bronchial conditions are rife.

As I commented earlier on, HM's biggest enemy will be boredom. It would appear that TS will do okay if he ends up on death row with the Bali 9. The threat of death seems to bind them together. It will be HM whom will struggle IMO due to her difficult personality. She'll be likely more open to boredom that will wear down her mental state. Apathy is their enemy, not fear of the guards.

Thoughtful post. I think you're right. (Also, I'm wondering if you can give us a professional prediction as to how you feel this case will turn out, in layman's terms?)

The thought of Sheila still being alive when she was twisted and stuffed into that suitcase is an especially heinous possibilty I'd never even considered :(

So mad about this case my HM turned into HW lol at myself. Geez[emoji5]

ciao

LOL. I knew what you meant. I saw HW and simply thought " Heather Whack" which would also be appropriate since she dos seem pretty whacked to have thought she could get away with a scheme like this,

Can only speak from an academic sense G. As am not verified and do not wish to break TOC, please take the following as opinion only.

I would expect TS to plea a lesser charge (if you get my drift) although I would expect him to get the book thrown at him, due to his lack of restraint after the fact (didn't act responsibly/paternally). Indonesia, generally speaking, is a patriarchal society and that will go against him due to his (lack of) actions. If he goes into the general prison he will still have surreptitious access to HM, which IMO is not a good idea. He will do better to be with a group that can mentor him.

The biggest risk if they both go to the general prison will be that HM will then abuse TS.

I doubt HM will get a death sentence due to her being pregnant and her young age, even though I expect her to be found to be the main perpetrator.

Thoughtful post. I think you're right. (Also, I'm wondering if you can give us a professional prediction as to how you feel this case will turn out, in layman's terms?)

Am I allowed to post details of SWM transferring property worth half a million into a trust two month's before her murder? This is public information for which I can provide an internet link. But as this info has been available since before the murder and no one has mentioned it heretofore, I worry that there may be a reason for this, and that for me to do so could violate a board rule I may not have fully understood. Remember, I only joined on Sunday and am still getting the hang of things here!

Yes, I've seen that too. She purchased her new condo for $535,000 in April of 2013 under her name only but in June of this year it was transferred into a trust in her name. Not sure what the reason for that was. Can't see why you couldn't post the links. We've been all over the Linden Ave property.

MOO

Please do -I don't see a problem. No one has mentioned it because no one has found it, IMO.

That is it, Kamille, precisely. A few interesting points:

1. She purchased the unit in April of 2013 in her own name and then transferred the property to the Sheila von Wiese trust, with her named as trustee, in June of 2014, two months before the murder. I suspect this will add an additional burden for her daughter, during the interregnum between police suspicion and (possible) conviction in gaining access to Sheila's estate. (IANAL, so perhaps the burden is, in fact, unchanged.)

2. Sheila appears, for whatever reason (one possibly that she wanted, out of a mother's love, to create a little distance from the public records in Oak Park of Heather's violence), to have reverted to her unmarried name.

Knowing this, you can find a few other things about her. For example, she appears to have long been a friendly, gregarious person. Note a social club she formed, described in 1991, before she married:

You can also find corroboration of the Chicago Tribune's research that SWM was not an editor for Studs Terkel, but instead a transcriber. See a page from the Terkel book "Race: How Blacks and Whites Think and Feel about the American Obsession" here:

I can understand if her step-siblings don't care to help her.
What about Sheila's brother or sisters?
They've known her as a child and maybe one of them will have sympathy for her.
Any living grandparents? A great aunt perhaps?
If no one liked this girl, she might eat rice forever.
Truthfully, I think I'm all for it including long, damp rainy days in a boring prison.

I hesitated because I first broached the issue over two days ago in a post on page 12 of this thread (post #291--I don't know how to quote that directly). No one replied then, so I felt lost at sea.

I read a lot of discussion boards, posting on some, lurking on others. There's a different ethos on each one. I've seen newbies come elephanting in and creating disruption by violating rules or generally showing disrespect. My own course is to attempt great caution until I have my feet firmly on the the ground.

("Elephanting" comes to mind because I like to think that Sheila, were she so inclined, had a chance to ride an elephant in Bali, and that she had some wondrful experiences in Indonesia before she met with tragedy.)

Back to the main point. Since Quester posted those revealing videos a few days ago (which displayed Sheila's Gold Coast address on the luggage tag) and I then looked up the LSD property, it's been on my mind. I was discussing it with someone earlier tonight (we both live in Chicago) and I decided to raise the issue again here because members of this group can take facts and add value via discussion and further sleuthing.

I forgot to add in my previous post, that another "Sheila von Wiese" find (i.e., her name shorn of "Mack") reveals that Mark Bacharach has truly been in her circle before this terrible crime (I'm never sure whether to trust the media and its "here's what someone who knew X has to say"). He's a jeweler, and so just may have been the source of some of the items Sheila had protected in the safe at the St. Regis. Bacharach is the one quoted in the press in the early days as saying Heather could be a "vicious little monster." He was linked to Sheila on this site:

April 2013 - Sheila bought LakeShoreDrive property, in name of SVW
June 2014 - Sheila transferred ^property^ from her individual name, to SVW trustee for SVW trust

IIRC, Sheila's brother was quoted in MSM, my paraphrasing - family is grieving, pls respect our privacy.

IIRC, an atty in private practice said - my paraphrasing - On learning of Sheila's death
my law firm filed Sheila's will in probate court, as we are bound to do by law
.
IDK if executor of her will was ID'ed in MSM, but I half remember her bro was her executor. Anyone actually recall?
He also, or another atty, said - again, my paraphrasing - I/my firm did some estate planning work for her.

^ suggests to me, if accurate, that this past spring/summer, Sheila re-thought her estate plan and decided -
- to estab living trust for privacy, ease of administration, etc (from what I see in assets, no benefit re Fed. estate tax)
and/or
- to change beneficiaries of her estate, or change percentages to various beneficiaries.

Did Sheila realize w dau HM reaching age 18, that on Sheila's death, under her will, HM w/inherit her estate(or whatever $)
w no strings attached and promptly spend imprudently?
Did Sheila think estab'ing a trust, and transferring some or all her assets to it,
naming someone (her bro?) as successor trustee would help prevent HM's burning thru principal like a drunken sailor?

I think, but am not sure that atty quoted in MSM re state planning and filing will w probate ct were one in the same.
JM2 cts, no links, going by memory re above info.

I had to look up benefits of setting up a trust, as I wasn't sure of all the benefits. Here is an easy explanation, if anyone else is unfamiliar, like me.

http://www.dummies.com/how-to/content/benefits-of-setting-up-a-trust.html

Certainly sounds as if Shelia could have put all kinds of conditions on the distribution of her trust .... Heather gets none till she's 25/35/45 years old .. her art interests get it all ... her siblings get it all ... any conditions she wanted, really.

exactly!! she can set up parameters including ''use of real estate until a certain age but not sell it '' etc too - I betcha there's a lot of financial controls in that estate -- brilliant plan on part of Sheila

I guess I am one Hard Hearted Hanna but I don't think I could send $ to my niece if she offed my sister or had been a raging abuser in the past. I think this is a case of tough love being more than appropriate. Or....perhaps maybe I would send a token amount of say $20 per month.

MOO, get your nails done and don't send your sister's killer any money, not even $20. Guess I hope Sheila's family finds their inner Hard Hearted Hanna and goes the tough love route.

Okay, send her a package with a big bag of RICE every month.

BBM :what:

I hadn't realised, but $20 is close to a week's wages in Bali (currently listed as US$30 per week minimum wage for a fulltime job), and HM will be paying no rent, no electricity, no gas, no water expenses .. and will be going nowhere. She'll be able to buy a LOT with $20.

It is no wonder that prisoners can buy so much from inside jail, when so small an amount of our money is worth so much to them.

Minimum Wage per Month
Bali = 1,542,600.00 Rupiah

1542600 Indonesian Rupiah equals 130.973065 US Dollar
