It shouldn't be her trust fund any more. It should belong to her daughter once she is born, and it should be held in trust until the birth. With sm's brother as executor.

She has not been convicted of any crime against her mother yet so technically it probably IS still her trust fund. This is a tough one. I'm very interested to see how it will play out.

In the court filing, Heather Mack's attorney said Wiese, the executor of his slain sister's estate, has denied the defendant's requests to release funds, stating it could allow "for bribery, which is against anti-corruption laws."

Mack originally had sought $300,000 for her mother's estate, the filing states. She later revised it to half the amount, but her uncle did not respond. William Wiese, an out-of-state attorney, declined comment Thursday.

The parties are expected in Cook County court Friday.


Originally wanted 300 grand. Now is claiming to only want what the Indonesian lawyer wants. Seriously??? What lawyer in Indonesia is going to get 150 grand US for a murder case? This is for a bribe. No wonder she changed lawyers, she had to find a corrupt one over there to match the corrupt one she has in the US pecking at Sheila's money like vultures.

ETA: Interesting to find out that Sheila's brother is an attorney. Glad to hear it as he will be able to deal with this absolute affront to his sister's memory with a legal mind. I can imagine what he's thinking though.

So William Wiese controls a trust fund worth $1.56 million. We start to get a better picture of the money Heather will never see.

"She said the funds are necessary to preserve her life because if she is convicted, she will likely be executed." This is actually far from true. According to the United Nations Office on Drugs and Crime, there were 1,456 murders in Indonesia in 2012. As discussed upthread, there are approximately ten people annually who are sentenced to death in that country, with roughly 50 to 70 percent of those murderers. So Heather is unlikely, purely on statistical grounds, to be sentenced to the firing squad.

I am confident this application will fail. I think it was in the second Sheila thread where there was a long discussion about the legal issues surrounding benefiting from an inheritance in the case of murder. Chicago judges will know the law and will not release a penny of Sheila's money for Heather's defense.

Yet another epic fail on the part of Elkin and fellow clowns.

Knowing Cook County as I do, I very much doubt it will be in the database already. But I'll have a rummage round and see if I can find anything.

It's the ultimate sleuth move and I feel slightly obsessive but if I can find it in the morning on the docket log ( I walk through the pedway of the court house every morning on my way to work to avoid the cold) I will definitely go.

Yeah, I finally found where to look and only the filings as of yesterday are there. So we'll likely see the filing online tomorrow but won't be able to see much other than maybe the name of the lawyer who filed it which I think we all know will be Michael Elkin.

Where is South Aussie? I swear I remember her mentioning a bribe to get out of a murder charge in another case was around 150 grand. That is exactly what HM wants the money for. And why she's been so smug about it all. She has been told that she is entitled to her money and that she can buy her way out of this I'm sure. She probably never imagined her Uncle would refuse to send her the funds. And when he accused them of needing it for a bribe, they cut the amount in half? So the other half was to go to Elkin? And he figures if he can get the money for the bribe to get her off, she'll get out and get all her money to pay him eventually. Hmmm....I wonder if he'll be willing to front the cash himself? :thinking:

Wouldn't ya know it, she wants some of her Mother's money. Not surprised, but it makes me sick that HM thinks she's entitled to anything from her mother's estate.

Glad SWM's brother is not going for it. Blocking HM from getting any of that money is the only way now to honor Sheila, IMO. SWM's brother is an attorney,
so he knows what's going on. It must really hurt the entire family now to learn Heather was going to pay someone $50K to kill Sheila. She's had plans for SWM's money all along.

One and a half million is about what I figured SWM was worth if you consider the condo (close to a million) and her savings/investments/property etc. So I was right that we were never talking about an "extremely" wealthy woman here. There are a LOT of people with that amount in their "estate".

I wonder if the condo is up for sale and for how much?

ETA: It has not been sold and the Zillow estimate for it's value is $742,681.

Most people used to living well need at least a million put aside for retirement.
So, I agree, SWM wasn't extremely wealthy, but she could have lived a very nice life for the next 30+ years. Heather would've blown through that money within a year or two.

I'm curious about the condo, too.

I think it's almost time to file that wrongful death civil suit against HM. So glad William is an attorney and knows just how to block this.
