BIG HOLES in the defense theory

While sitting in jail, planning her defense, why didn't she tell it to cops? This makes no danged sense. Not only would it be the logical thing to do, but also, she legally owed it to investigators to clear up all the lies about the nanny. Also, I have a question about her father. If he was so willing to coverup an accident, to keep people from prying into their family, then what happened 31 days later, to change their minds? Didn't they realize this would bring even more prying eyes into their family? And if she even dares to try to blame her continued silence on her mother not knowing their secrets, well, I feel nothing but pity for the defense. When backed into that kind of corner, a person fesses up. She doesn't go to jail, and get threatened with the death penalty...all for what? just so she can then finally, on national tv, spill the secrets anyway? No. These are the 2 biggest holes, IMO.

I think the biggest mistake Jose made was attacking the smell of death in the trunk by saying it was garbage and the state let the garbage dry out so it would not smell anymore. That is a test so easily recreated.

There are just way to many people who know the smell of death in the professional lives and know the difference between the rankest garbage and the smell of decomposition. Think of all the people who have searched dumps for bodies.

I had the misfortunesince this case began to learn once and for all what a decomposing human smells like. My uncle had died and it was 6 days before they were able to have his funeral and standing very near his casket I smelled what death of a human smells like. Once makes you an expert on the subject. I would recognize that smell anywhere anytime. That was a huge hole they created especially with experts who smell that smell as part of their living like Doctor Vass from the body farm. It smells nothing like any garbage I have ever smelled.

Now, does this sound like someone who is incapable of showing emotion after a loss? Are we supposed to believe that KC would grieve and emote more for the (accidental) loss of an unborn child than she would for the (accidental) loss of a child that she had bonded with for two years. The only way this makes sense is if she was responsible for the loss of Caylee.

IDK what is going on, this is a circus. What I DO know is; JB has to be the WORST Defense Lawyer I have ever seen in my life.

I almost feel bad for Casey at this point. She has absolutely no fighting chance with this guy as her lawyer.

JB says that Casey is unable to express emotions, she certainly seems to be capable of feelings and emotions when it comes to herself, we have been seeing that on a daily basis in court. I think the motive was in court today testifying, little did she know that Tony would have loved her even with Caylee.

The DT certainly has some ordering and organizational difficulties to overcome. Among other glaring omissions in the OS, JB skipped from June 17th with their claim of faulty forensics regarding the ladder and ignoring Cindy's statements about the ladder to characterizing George's reasoning and his anticipation of a hypothetical investigation involving the disappearance of Caylee in which (according to George) Casey is lying her butt off and who is going to believe a liar? Thus, George takes certain steps to distance himself from the situation and makes Casey take all of the blame, but then JB does not enumerate any of the supposed steps.

They would have done better with the hypothetical situation that Caylee's accident happened under Casey's watch alone, she panicked and eventually put her in the trunk.

The trunk evidence will be too difficult to overcome. The State has already begun to establish that there was no foul odor in the car before the time that Caylee was last seen.

Clever George.... How did he know that Casey would keep on making up silly, easily debunkable stories and not cave in and tell the truth about his part until after three years in jail...? :waitasec:

You know, I might have believed that Caylee drowned and Casey panicked if it had come out a long time ago and not only when she's in court with DP on the table... How did her attorney ever let it go so far if it was just an accident...?

Can she sue him for incompetent representation?

Totally agree about the "burying her emotions" part. It only seems to apply to the death of her daughter - not her boyfriends (she cries over) or the alleged molestation (she fake cries over in court) or her "love" for Caylee so widely reported by her friends while under pressure from JB --- only the death.

Also - in her Universal Studios interrogation by LE, they even suggested Caylee might have drowned (something like, "nothing you say would surprise us, we've had mothers whose child drowned in the pool.... it's okay to tell us") and she said nothing. Was pleasant. Had no reaction. Yet a fight with her mother made her angry or cry? So ridiculous!

Also Roy K is some kind of body snatching evil genius? Who kept a body for weeks to collect a reward.. insanity. With GA's inadvertent collusion? More insanity.

See! And I keep forgetting about the genius that is RK. I certainly know that I never would have thought about taking it upon myself to put a murdered...I mean accidentally drowned person's body in my hands on the off chance that I will be able to get some sort of reward for improperly disposing of it instead of calling 911 in the first few minutes, or even months. And to think I just keep playing the lottery.

Great post and I hope to God that the prosecution can and will be able point this out to the jury. The defense can't have it ALL ways. She certainly hasn't had a problem showing emotion throughout the trial this week. Matter of fact, she can't seem to control making very visible responses to statements made on the stand by witnesses. Guess she's been "unconditioned" now huh JB?
ETA: And she definately didn't seem to have this "conditioned" control over her emotions during jailhouse phone conversations/video visits with her parents either.

Excellent post! :clap: If I may add to that, ICA showed plenty of emotion in the jailhouse videos with her family.

There's so many holes here that it resembles my DD 'blanky' that she has dragged around everywhere for 5 yrs.

I'm seeing the same huge hole here as one_hooah_wife : that they're claiming that the reason ICA acted as if nothing had happened during the 31 days was because the alleged abuse taught her to ALWAYS pretend like everything was okay... Even after the 'accidental' death of her only child.
Wow! Must be really deeply ingrained, right?

So how is she now capable of showing 'normal' emotion in an open court room with the world watching?
Why hasn't she been happy, chatty, always smiling...and all the other words witnesses have described her as being back in June/July 08, if this coping mechanism is so strong that it allowed her to party, shop and play house when she knew her daughter was dead?

And what's the point of the DT getting all these witnesses to state what a good mum ICA appeared to be when part of her defence is that she never shows her true self. ….so of course she would have appeared to be a good mum. The defense is a one contradiction after another.

How did she heal from so much trauma and learn to stop using those alleged life-long coping mechanisms in less than three yrs? They must have some damn fine psychologists in jail these days!

I predict the DT will say it's because ICA has now had some distance from her abusers and it's helped her to heal and feel normal emotions. :violin:

I think there should be another poll option: Yes, they did change my mind, they solidified my conviction that she is guilty and deserves the death penalty! Why is she still in jail? It was "a common accident". Why didn't her attorney advise her to tell the truth? So she could go home. Would you sit in jail while all these vile things are said about you? I know I wouldn't IFFFFFF my baby accidentally died.

Everyone else is out to get ICA, but her attorney "who is fighting for her life" is letting her sit in jail while he gets his 15 min of fame.

That is the biggest glaring hole for me.

Yes, that came up on NG tonight. I've often wondered that, too, and I think the jurors will also. The answer is obvious.

One of the "biggest holes" I see by the DT used in the opening today is when JB made the allegation that GA had his "p****" in ICA's mouth when she was 8 years old" ... This statement made by JB still has me "reeling" !

There is NO proof -- NO medical or psychiatric expert to back this up -- NOTHING ! ONLY ICA -- so she will have to "take the stand" -- and WHO would believe her ? After all the "fairy tales" she has told over and over ... NO WAY the Jury will buy it !

My Opinion Only ... the A's may NOT be the "Cleavers", but I do NOT believe this allegation at all ... NO WAY JOSE !

IF .. IF -- this were true, Cindy would have known and done something about it a LONG LONG TIME AGO !

Yes, and a commentator on HLN tonight said what the defense succeeded in doing was generating sympathy for George and Cindy. I agree, I feel so bad for them.
