There were photos of the truck being pulled out of the trailer, McLellan says, but no photos were taken of another officer going through the door of the trailer to get to the truck and put a key in the ignition.
by Adam Carter 2:49 PM

Court now seeing an exhibit list of things identified from the truck/trailer.

Dungey said he was refusing to testify, just following along with what is tweeted like everyone else HTH

Right. Like everything a defense lawyer throws up in the air should be taken as gossip. If an officer have some sort of disease and would say I "can't testify because I have a disease which would render my testimony invalide" (like dementia, Alzheimer's or brain damage from an accident), it could be construed/ turned into refusal by the defense lawyer.

The log exhibit was done by Det. Dave Banks and not McLellan.
by Adam Carter 2:52 PM

Dungey now done cross examination.
by Adam Carter 2:52 PM

Pillay has an objection about the logs being made an exhibit. Jury bing sent out to discuss.
by Adam Carter 2:53 PM

I can't talk about anything being said with the jury out of the room.

BBM I'm sensing a nice dose of context and reality for the members of the jury. MOO

IMO, DM simply ran out of time- no time to clean everything, no time to paint the truck- he had a lot of things to look after. The gun, the incinerator, the contents of the incinerator, the seats. He was working as fast as he could- it just wasn't fast enough. MOO

Totally agreed. The ID of the ambition tattoo was critical in making DM a person of interest almost right away. If not for that and AJ calling into Crimestoppers, who knows how much cleaning up DM could have accomplished before LE found out about him?

Jury now being recalled.
by Adam Carter 3:02 PM

McLellan now being reexamined by Crown Tony Leitch.
by Adam Carter 3:04 PM

Leitch asking if she took any notes at all - she says yes, at the beginning of each day.

McLellan took notes, she tells Leitch, just not as detailed as Banks' notes.

***So she used the more detailed ones to testify and was crucified for it. SMH

McLellan is telling the court about doing a fibre taping pat down (using tape to check the investigating officer's suit/clothing) to check for fibres that may have come in or out of the truck.
by Adam Carter 3:06 PM

McLellan says she saw officer banks seize the shell casing.
by Adam Carter 3:06 PM

McLellan is now excused.
by Adam Carter 3:07 PM

***Huge sigh of relief from her I'm sure.

by Adam Carter 3:08 PM

He's an officer with Niagara Regional Police.
by Adam Carter 3:08 PM

He'll be testifying as a member of the forensics services unit, about things found in Millard's SUV.
by Adam Carter 3:09 PM

He came to Hamilton to assist with the investigation in its early days.

As for MS fingerprints, it's possible that evidence of same is yet to come. But it's also possible that he had gloves on, as he might have thought of doing if planning to hold and fire a gun.
<rsbm>

It's also possible it was thoroughly wiped down in the hangar.

It's also possible it was thoroughly wiped down in the hangar.

Especially since the outside should have been covered in blood too. Now THAT would have tipped off the "employees". ;)

Court now seeing pictures of MIllard's Yukon.
by Adam Carter 3:14 PM

It's on rollers in the photo, which was used to roll it into the Hamilton police garage at Central station.
by Adam Carter 3:15 PM

There were several police seals on the SUV.

TB owned the truck. He presumably drove it daily and probably touched it from bumper to bumper and yet not one viable print !

Says who?

We are now seeing photos of Dellen #Millard's GMC Yukon. Dark blue. #Bosma

I would assume the passenger side was given a good wipe down doors etc because that is the side TB was pulled out of the vehicle from and blood would be on the doors. Also that would explain why Smich's weren't detected either. They also mentioned the car was washed and wax by TB before the drive which would have cleaned his prior prints

Dungey asks if it would take a lot of time & effort to take inside of truck apart. She says "I don't know. I've never taken a truck apart."

Susan Clairmont ‏@susanclairmont 2m2 minutes ago
Another officer's notes says shell casing found under rear seat. #Bosma

aside from speculation, has anyone seen images of an air compressor, mechanic tools, etc, located within the hanger where they found the truck? IMO, having tools available would make light work of taking the truck apart.

Dungey asks about truck being on angle when pulled (or driven) into trailer--so a shell casing could roll from front to back? #Bosma

molly hayesVerified account ‏@mollyhayes 1m1 minute ago
McLellan: Anything could move while being transported yes. #Bosma

BBM - Your point Dungey? Bottom line...the shell casing was found in the truck period. He's trying to raise doubt in the jurors minds that forensics did sloppy work. His tactic isn't going to work for him though as there is way too much evidence showing TB was shot in his truck while sitting in the passenger seat. His bullying or harsh attitude toward witnesses could end up backfiring on him where the jurors are concerned, if Dungey's questioning is really irrelevant. MOO.

Now seeing the inside of Millard's SUV. There is a beige bag on the passenger seat.
by Adam Carter 3:19 PM

There's a stack of plastic cards and some change in between the front seats.
by Adam Carter 3:20 PM

The IDs are Millard's driver's licence, his health card, several credit cards, and two replacement RBC bank cards.
