Question. Is Police able to actually retrieve the content of the text messages between the accused ? Obviously they can if the messages are still on their phones, but how about deleted text messages? Can that be retrieved ? And will any text messages be presented in court as evidence ? I would assume so right?

This is from another case, but cell phone companies do not have access to their customer's text messages. The actual phone(s) would be needed.

Fortier said Rogers does not have access to the content of the text messages. That would have to come from the phone, she said.

"won't testify" = refuses to testify
"won't testify" = won't be testifying cause somebody else who was there with him has his nice detailed notes.

Take your pick and keep playing devil's advocate. It's all in how you interpret the wording, and how the words are rearranged in the tweets.

Won't be testifying because....1,000,001 potential reasons. Poor health may play a role in why Officer Banks "won't" be testifying. And I like your first reason paris...his notes are totally sufficient. Obviously the judge had no issues with his partner referring to and presenting them in court. MOO.

Examples: Mr. Smith won't be testifying because he is scheduled for surgery and recovery time is four to five months. Mr. Brown won't be testifying because unfortunately he has passed away.

So the Yukon was messy, the trailer was messy with various things being heaved into it, DM's house was a mess....it's really hard to clean up everything when there is no order to things. No wonder he got caught. He's messy in life in general and that eventually comes back to haunt you when there are sooooo many loose ends dangling in the breeze. Just an observation. MOO

The house was searched by the police. They don't usually clean up after themselves from what I understand. Trailers usually are used to carry furniture, boxes, cars etc, so I'm not too surprised it had similar items in it. I think it will be interesting when more things are revealed to shed some light on such things. JMO

Yes. In the Tori Stafford case, one ex-girlfriend and one current girlfriend of the male suspect were posting on the threads. One "best friend" of the accused as well. They were mainly posting in defense of the male suspect.

UGH. So glad I wasn't on that thread - I would have been banned for 14 consecutive lifetimes.

My daughters text messages were needed for a court case. They took the actual phone and retrieved messages and we got the phone back in three weeks. We are with Rogers.

Seriously, if we think for one minute that a forensic examination like this one didn't involve many detailed notes and many experts, all extremely qualified to testify in court, I think we're really missing the qualifications and experience of many of the forensic LE on this case. Dungey's attempt at chastising LE for potentially allowing contamination of the truck as it sat in the trailer in an authorized compound, IMO, is merely an attempt at trying to make sure his client doesn't get nailed as the guy who shot the gun. But, in all honesty, because DM had full control of the truck from Monday night until Thursday night- stripping the interior out of it, grinding down it's markings and decals, I don't know how necessary it was for him to get his blood pressure elevated and scream at a witness-show boating? Trying to make a mountain out of a molehill? Fact is that DM had lots of time and opportunity to contaminate the evidence in the truck. MOO

im not more tech savy but i watched a first 48 last night and the daughter and father inlaw had killed the son in law. the daughter and father had deleted their texts but cops were able to find out what was said. Not sure about whether they had the phones or not but i suspect so

I'm just guessing here but I think if the officer in Florida is really that sick, too I'll to testify, he wouldn't be in Florida, he would be back in Ontario where his medical expenses would be covered

So as long as they have physical possession of DM's and MS's cell phones, they should be able to retrieve the text messages. This would be huge.

For some reason, I believe it was previously stated that the incinerator was delivered July 11th or around that time. What was entered into evidence today was the receipt for the purchase of it, AFAIK, it doesn't show us when it was actually delivered. MOO

No the messages weren't deleted. We were told there was a way to get them if they had been but it was more complicated so I'm not sure how that works.

Similar situation here. Messages sent to my daughter (that she deleted) were needed for potential criminal charges. The IT forensics team had the phone 2 days and recovered them all (images too). We're with Bell. It was *sort* of explained how they do it, but unless you're a tech-geek (which I'm not) it's kind of hard to understand how it works.

Just now catching up but I suspect defense KNOWS videotaping evidence gathering isn't standard protocol but threw that out there to cause the jury to doubt the evidence gathering was as professional as it could have been. Because, he knows he's got nothing else to go with.

Yes, throwing anything against the wall with the hope it will stick. As stated by Det. McLellan a few times, it is not common practice for forensic technicians to videotape their work.

I would have liked to be in the courtroom, to witness this detective on the stand while being cross examined by Dungey with his yelling. From reading the tweets she seemed un-fazed. I can almost picture her giving him "attitude" back, but of course in a professional calm demeanour. Hope Dungey doesn't suffer from high blood pressure. :notgood: MOO.

He is retired. He is not required to testify in every case that is sitting in the court dockets for the next however many years that he took notes for. I'm sure this happens often in court cases. DM and MS are just not that special. Their lawyers should get over it.

One would think, once these 2 were both in custody, the first place their phones were sent to would have been the department that does this kind of thing. We've already heard all the ping info (about the phones they had on them at the time of the crime & days after) but nothing at all about the actual phone info (about the phones they almost certainly had on them at the time of their arrests), and that's rather curious to me.
