The next witness is Armin Siebert.

Feb 18 2016 2:34 PM
He's a resident on Roseville Road. He has 10 acres cut out of the Millard farm property. He said he met Millard once when his family first bought the property.

Feb 18 2016 2:34 PM
Siebert still lives there, on 10 acres of land.

Follow up question: would that then change the records that LE could see when they run a VIN?
FWIK, the VIN number stays with the vehicle, and modifications are recorded unless the ministry deems the modifications to be so significant that they require a whole new registration number. i.e.) a station wagon that gets it's 8 cylinder engine replaced with another 8 cylinder engine or a 6 cylinder turbo may be deemed a modification, whereas the station wagon that's been converted to look like a pick up truck complete with engine change etc would require a new registration. That's just my take on it and perhaps one of our car guru's can clarify. MOO

They have 5 horses, and the 10 acres is pasture land for the horses.
Adam Carter

Feb 18 2016 2:36 PM
He says the horses are used for "barrel racing," like you'd see at the Calgary Stampede.

Feb 18 2016 2:36 PM
The pasture land is there for the horses to feed and roam.

Feb 18 2016 2:38 PM
Seibert is now outlining his property on a map next to the Millard farm.

Feb 18 2016 2:41 PM
The court is now seeing a map of Seibert's property. He's down on the bottom left portion of where the Millard farm is.

Seibert says he was bringing the horses in on Tuesday or Wednesday night on the week of the 11th of May. "I had seen some flashlights bouncing off the silo at the back of the barn," he said he told police.

Feb 18 2016 2:45 PM
This was around 11 or 11:30 at night, he says.

Feb 18 2016 2:45 PM
"Had you seen that sort of activity there before?" Fraser asks. "No," Seibert says.

Feb 18 2016 2:46 PM
He said he was concerned about people breaking in, so he drove around his buildings. He didn't see anyone around in the area, so he went back home.

Feb 18 2016 2:47 PM
Crown is done. No questions from the defence. He's excused.

Feb 18 2016 2:50 PM
Next witness is Steve Henhoeffer. He's a dairy farmer in the Ayr area by the Millard farm.

Feb 18 2016 2:50 PM
He says he doesn't know Dellen Millard.

Feb 18 2016 2:50 PM
He says he works long hours, early mornings and sometimes late nights.

Feb 18 2016 2:52 PM
Henhoeffer says early one morning while milking the cows he saw smoke in the area. "It was an early spring morning - I noticed smoke coming from the area of the Millard farm. It was very odd that thick, black and grey smoke would be coming up."

***and that answers that question of why didn't anyone notice the smoke. They did.

Knowing what he knows now he has to assume he may have been lucky he didn't see anyone. As he may have met the same fate as Tim

Feb 18 2016 2:55 PM
He says he saw the smoke on a May 7 or May 8 around 6 a.m. "The air was very still that morning, so it went straight up. It was blackish, grey smoke I saw. It dissipated very quickly."

***I guess the phone records will clarify the date.

He'd hunt turkey in the spring, and then later on deer, and sometimes rabbit.

Feb 18 2016 3:01 PM
In May, it was turkey season.

***Well there you go, the pesky animals on the property were already being taken care of. ;)

Feb 18 2016 3:03 PM

McGrath drawing on a map the area where he'd sit and hunt. It's not too far from where the treeline where the Eliminator was found.

He is describing a pathway through the trees. #Bosma

Feb 18 2016 3:11 PM
He says they used to put up tree cameras on the property to see what the deer levels were like.

Feb 18 2016 3:12 PM
McGrath says he knows the area very well. He was there on May 11, 2013 to go turkey hunting with his dad.

Feb 18 2016 3:13 PM
"We looked up to the field where the pathway is, we saw a white SUV and a dirtbike going up to the hill." He thought it was the farmer, who he had never met. When they got there, they saw the incinerator and the investigators.
