He says they used to put up tree cameras on the property to see what the deer levels were like.

McGrath says he knows the area very well. He was there on May 11, 2013 to go turkey hunting with his dad.

McGrath was on the property on May 4th and 5th, he says, and didn't see the incinerator in that laneway then.

Gotta love the farmers and the hunters! They always notice stuff going on. I wondered about Turkey hunters. That property looked prime for Turkeys and it was prime Turkey season.

May 6th between 21:20 - May 7 @ 09:18, MS phone had no cell tower communication.
May 7th @ 00:12 DM txt rec'd from Whidden location Hanger. DM phone cell ping between Hanger and Farm at 00:29.

According to what I have, May 7th, DM was sending SS and AJ text at 05:55 location mapped as hanger.

Could have been the 8th. I can't find the phone record for that day. Anyone else?

Gotta love the farmers and the hunters! They always notice stuff going on.

There was way more going on than DM was aware of, that's for sure. That's what happens when you rent out your property. ;)

I'm thinking, could LE have gotten that lucky? But he said "used to". So I'm not anticipating but it would be an unbelievable thing if there is actually surveillance he didn't know about on his own farm. :what:

He mentioned using trail cams for deer. I wonder if he use them for turkey a well.
Can you imagine if they had trail cam video of this, that would be fantastic, to see all th players who were there.

May 8th MS "phones" in the Oakville area

If they did, would it be admissible? A camera on DM's property that he wasn't aware of? Anyone have any knowledge if these pictures would be usable?

can imagine the kid and his dad were crapping their pants too, imagine, him and his dad with guns, going about their business, police finding an incinerator, has to be a tense moment!!

Seibert says he was bringing the horses in on Tuesday or Wednesday night on the week of the 11th of May. "I had seen some flashlights bouncing off the silo at the back of the barn," he said he told police.

He said he was concerned about people breaking in, so he drove around his buildings. He didn't see anyone around in the area, so he went back home.

My daughter attended a sleepover equestrian camp that is very close to this property. I felt sick dropping her off 4 weeks after TB'S remains were found so close by.

Thanks. Do you have a link to the evidence map for that date? For some reason I think ABro missed posting that one on her site. Or I'm just not seeing it?

So as of right now there's the dirt biker, the horse farmer, the dairy farmer, the cash cropper and the hunter- and chances are DM didn't have a clue that they were all paying attention to their surroundings MOO

I am hypothesizing, but suspect that "implied consent" would factor in here. These hunters had access to the property for their hunting activities from the previous owner (Snider) and it was still operational after DM's ownership (2 years previous), whether explicitly or not. Hence, implicit consent. Snider, then by inference DM, consented to their hunting turkey and deer, and by extension to whatever reasonable activities this involved, for example setting up a temporary campsite, cameras, whatever. Some things, like right of way over a property, continue from year to year and have to be explicitly terminated. If they go on long enough, they can't be explicitly terminated (in some jurisdictions, anyway).

I have similar tree cameras. They take still photos with a flash, so if they were operational at the time, it would have been highly noticeable to anyone present, in my opinion.

He was also on the farm on April 25. Four deer came out of the woods then.

He says he was also on the farm on several occasions between then and May. Again, McGrath says, nobody said to get off the property. He also says again the gate wasn't locked.

More riveting cross examination- I guess maybe if DM knew so many people accessed the property he may have done things differently- perhaps the lack of restrictive access to his farm was simply a result of his ignorance. MOO

I own a motion sensor bird cam and put it up at my parents farm to capture Great Horned Owls. We have captured all kinds of interesting activity including trespassers and hunters. I live in Toronto and had it in my yard to see birds and caught a neighbour stealing my herbs : )
