What DM's defense failed to acknowledge during the cross-examination of Banks, is that the front area of the truck was cleaned out. Seats and carpet removed, etc. Even if a shell casing did land in the front area, it could have easily been moved to the back during the clean-out. This "climbing over a wall" business is rather far-fetched.

My understanding is, so long as you have a valid FAC you can purchase any ammo or gun. They don't check to make sure you own a specific weapon when you buy said ammo.

If you have a valid PAL for restricted firearms, you can legally buy handguns and handgun ammo. Non-restricted gives you access to rifles, with exception to some assault rifles like an AR-15, which requires a restricted license.

He's saying it couldn't have rolled to the back from the front. He's trying to establish that it was always in the back.

I believe MS's lawyer asked previously if it could have rolled from the front to the back when the truck was moved by LE.

They are trying to blame each other.

Besides the already mentioned fact that a casing ejects to the right. That the casing could of came from the front and not nessarily from the back upon firing.

Also, that truck was winched into the trailer by DM (LE reported that truck looked like it was dragged onto the trailer) possibly some jumping in the process. Then it was hauled to 3 different locations (DM's mom's, Tow company, Forensic building)
In one of the BAJA photos, the Jeep actually moved around in the trailer. Tells me that the trailer isn't an air ride (smooth) and they didn't secure it in the trailer (moved from back to front). I would assume they didn't properly secure TB's either.
When I haul my rig, I have a pulley system with chains that keeps my rig secure on the trailer with absolutely no movement. Everything else in the sleep half is scattered, if it's not secured or in the locked drawers and cupboards. IMO, The shell could have moved from anywhere in that truck given the BAJA pic and everything not secured, was scattered including the Jeep.
All of course my opinion though.

Humm, Just seen pic of the back seat ledge and where casing was found. That would have to be a really bumpy ride to jump that.
