What DM's defense failed to acknowledge during the cross-examination of Banks, is that the front area of the truck was cleaned out. Seats and carpet removed, etc. Even if a shell casing did land in the front area, it could have easily been moved to the back during the clean-out. This "climbing over a wall" business is rather far-fetched.

Any gun shop. Even some Canadian Tire stores stock them. But you would need a valid license.

snip

I wonder if he had some with the gun when purchased illegally, I think it's been established that neither DM or MS had an FAC.

So we are allowed to buy any bullets we want, just not the gun? Or do those bullets fit in a hunting type gun that we can purchase? And don't you have to show some kind of license to purchase them? I know nothing about gun sales in Canada obviously. LOL

I remember seeing photos of DM and his friends at a large hunting and sporting goods place. Photos not available to be seen now. JMO

My understanding is, so long as you have a valid FAC you can purchase any ammo or gun. They don't check to make sure you own a specific weapon when you buy said ammo.

Banks agrees that rear seat was not lifted by an officer to reveal the casing. Seats were always up.

Now going over collection of gun shot residue with a dabber designed by Centre of Forensic Sciences. #Bosma

Susan Clairmont ‏@susanclairmont 3m3 minutes ago
He used 12 dabbers to collect GSR from #Bosma truck.

We will be hearing from a GSR expert later in the trial, says Sachak.

***I wonder if he's talking about his own GSR expert here? An indication that they will be launching a defense case?

If you have a valid PAL for restricted firearms, you can legally buy handguns and handgun ammo. Non-restricted gives you access to rifles, with exception to some assault rifles like an AR-15, which requires a restricted license.

Banks says any suggestion that any officer lifted the seat and that's why the casing became visible is incorrect.

Sachak now asking about the gunshot residue kit and the way GSR is collected.

PAL Licence. (Position and Acquisition Licence)

I have one, I can buy any ammo I want. Restricted and Non-Restricted Firearms.

He's saying it couldn't have rolled to the back from the front. He's trying to establish that it was always in the back.

I believe MS's lawyer asked previously if it could have rolled from the front to the back when the truck was moved by LE.

They are trying to blame each other.

Besides the already mentioned fact that a casing ejects to the right. That the casing could of came from the front and not nessarily from the back upon firing.

Also, that truck was winched into the trailer by DM (LE reported that truck looked like it was dragged onto the trailer) possibly some jumping in the process. Then it was hauled to 3 different locations (DM's mom's, Tow company, Forensic building)
In one of the BAJA photos, the Jeep actually moved around in the trailer. Tells me that the trailer isn't an air ride (smooth) and they didn't secure it in the trailer (moved from back to front). I would assume they didn't properly secure TB's either.
When I haul my rig, I have a pulley system with chains that keeps my rig secure on the trailer with absolutely no movement. Everything else in the sleep half is scattered, if it's not secured or in the locked drawers and cupboards. IMO, The shell could have moved from anywhere in that truck given the BAJA pic and everything not secured, was scattered including the Jeep.
All of course my opinion though.

Humm, Just seen pic of the back seat ledge and where casing was found. That would have to be a really bumpy ride to jump that.

Well, not any ammo. For example, 5.56 NATO is not accessible to you.

What else could anyone expect from defense lawyers who come out with profound comments like "What's good for the goose is good for the gander".
Sooooo Canadian, eh?

Sorry, I meant within the parameters of my licence. :fence: But the ammo in question for the case, anyone with a licence can get.

Banks says each GSR dabber is used in set locations or quadrants. Sachak says there's no way, given the process, to know where precisely GSR came from. The particles are too small too see.. "I don't exactly where what portion of, say, the driver side ceiling the GSR came from," Banks says.
by Adam Carter 12:22 PM

"It's to look for the potential of a firearm being fired in a vehicle, but not to find exactly where it was fired from," Banks says.
by Adam Carter 12:22 PM

"it's a representative sample of a specific area," Banks says.
by Adam Carter 12:26 PM

"You didn't necessarily dab every square millimetre or centimetre ... of that front right side?" Sachak says. Banks says he tried to get whatever he could, but it wouldn't be possible to get every single GSR particle.

Speaking of that, where would someone in Canada legally obtain Winchester .380 bullets for this gun? I'm surprised LE didn't find a box of them somewhere in the mess at Maplegate Dr.

MOO
Could probably get them at the gun store in Hamilton if he knew someone with a gun license.

Banks says he dabs a sampling of areas, not every inch of the truck.

Sachak still going. Asking now about the gunshot residue process and the dabbers used. #Bosma

molly hayesVerified account ‏@mollyhayes 4m4 minutes ago
Because dabbers are used across quadrants, it'd be impossible to pinpoint exactly where any detected GSR had been found. Banks: yes. #Bosma

molly hayesVerified account ‏@mollyhayes 4m4 minutes ago
Banks agrees the test is to determine the existence of GSR in the truck--not mathematical location of where any particle was found. #Bosma

Susan Clairmont ‏@susanclairmont 49s49 seconds ago
Sachak making point there may or may not be GSR in areas that weren't checked. We don't know. Banks agrees.

Sachak now asking again about the location of the shell casing.
by Adam Carter 12:29 PM

Sachak is now done. Smich's lawyer Thomas Dungey now cross examining.
by Adam Carter 12:29 PM

"When we found it, as the original photograph had shown, it was in the upright position," Banks says.
by Adam Carter 12:30 PM

"If the shell casing was on the seat and it was lifted up into the closed position by somebody else, it is possible it could have fallen," Banks says.
by Adam Carter 12:31 PM

An exhibit is now being retrieved.
by Adam Carter 12:36 PM

Scratch that, they're moving on without it.
