I'm still sitting here reading all the facts from today, can someone who believes this wasn't "premeditated" explain your thoughts on that.
maybe I'm oblivious to how sick and twisted society is but who the H*LL brings a gun to test drive a truck?

A LOADED gun...if DM and MS only intended to intimidate, they could have successfully done that with an unloaded gun.

Why was the gun loaded? Why did they need bullets?

Forgive me but I don't know why that would be important to know. It doesn't contribute to what is going on with the trial. Just my opinion.

Court just watched from 9:47 p.m. until 10:03 p.m. Two vehicles are seen coming to and then eventually leaving the area. I didn't hear any bangs, though.

Plaxton says he included the entire clip because some small lights can be seen in the video. "It's possible a cigarette maybe. It all indicated to me there was some activity happening around the trucks." Lights are seen at 9:55 p.m. and 9:58 p.m.

It sounds like they got the footage from the wood preservers place across the road

I thought it might be from across the road but I didn't see any legible street numbers. That was why I asked. I'm not familiar with that area.

Millard had killed two people by this point. He wasn't going to bring an unloaded gun.

I don't think so. As others have noted your hand and arm extended into the cab through an open window could put the weapon in a similar position as it might be if you were shooting from the driver's seat. Regardless, no expert witness has declared anything definitive beyond the facts that there is a strong case for a firearm being discharged in the vehicle and that somebody bled in the passenger seat. I don't think anybody has linked the blood patterns to anything more than those two facts.

The video testimony today has me going back to the cell phone activity, and as I'm trying to line everything up, I found this strange inconsistency:

On trial day 3, Det. Sgt. Greg Jackson testified that at 10:01pm TB's phone accessed the browser data and at 10:02pm the phone was shut off. This is around the same time the vehicles departed the Bobcat dealership in Brantford. Then, at 10:56pm TB's phone pings at Colborne St in Brantford. How could TB's phone ping after it was turned off? Is this possible? Three different reporters (Adam Carter, Susan Clairmont, Nicole Martin) tweeted this so it doesn't seem like an error in the reporting. Maybe in error in the testimony?

The vehicles were captured on video in Cambridge by 10:26pm, so it's not like they went back to Brantford and turned TB's phone back on at 10:56pm.

I'm not sure if either DM or MS planned to kill TB, but I do think the evidence suggests strongly that one or both went on that test drive prepared to kill TB if things didn't go as they expected, IMO.

The thing that makes me lean toward the idea that the murder was planned is in context to what we presume to know about LB and WM having been murdered prior to TB by one or both of the accused, IMO. Unfortunately, as I understand it, the jury will not have information about LB or WM's deaths to prejudice their assessment of the situation regarding TB's murder, but these prior murders surely prejudice mine, IMO.

I guess so, but Jackson said the phone was turned off at 10:02pm. Maybe by "turned off" he meant stopped using the browser as opposed to actually powering off the phone.

Yes if the phone is turned off it still will ping. So even if you turn your phone off but someone calls/texts you, they will expose your location.

In another scenario, what would have happened if TB decided to be naive and just let them take the truck on a test drive? Would they have returned it and gone looking for another one because they wanted to kill someone?

IMO DM kills for necessity. If someone is a problem or in the way, he seems to have no problem eliminating them. I don't think he set up this elaborate scheme to steal a truck and told people about it beforehand just to kill someone for the thrill of it. He could do that anytime, anywhere if he needed a "fix".

But the anticipation/thrill of actually being in the vehicle with the intent to steal it after leaving TB's home and the overwhelming feeling of what to do about the fact that there is an owner in the truck that perhaps is not going to be all that accommodating about the plan to steal his truck, may have just triggered his instinct to eliminate the person who was in the way rather than to just let him go and potentially ID him.

Colborne St. isn't near Oak Park Rd. It must be 9:56? You can drive from Colborne St. to Oak Park Rd. in that time. Why oh why would they drive through downtown Brantford? If they had taken the 403 there is an exit to Oak Park Rd.

edit: No. Can't do it that quick, and the time still doesn't work. Must be an error on the time.

Some have speculated that Smich might have taken the wheel of the truck at some point the night of the 6th. I wonder if that becomes less likely given the fact that only DM's print was found on the rear view mirror? It's a pretty automatic adjustment for most drivers I think. It requires a few assumptions to be made, but it might support the idea that Smich was never behind the wheel.
