Millard never said why he wanted to steal lawnmowers. Never said he needed to sell them for money.

Colin Butler ‏@ColinButlerCBC 7s7 seconds ago
Hagerman agrees that Millard never said he was stealing to sell the lawnmowers or make money. #Bosma

Shannon Martin ‏@ShannonMartinTV 23s23 seconds ago Toronto, Ontario
Millard's lawyer establishing, over and over again, that Hagerman was a willing and able participant in Millard's 'missions' of crime #Bosma

Susan Clairmont ‏@susanclairmont 21s21 seconds ago
Sachak suggesting they did missions for fun. Similar to my @TheSpec column today. http://bit.ly/1S4FU5w #Bosma

Lisa Hepfner ‏@HefCHCHNews 32s32 seconds ago
Hagerman sniffles and stifles sobs as he admits that he joked about thefts with friends like #Millard. #TimBosma

molly hayes ‏@mollyhayes 30s30 seconds ago
When Hagerman asks what time he'll get home at latest, Millard responds only "5." #Bosma

  • #162
Sachak now going through the portions of the texts where the two are talking about what time the prospective theft of the lawnmowers would go down.
by Adam Carter 12:02 PM

This theft didn't end up happening. Millard says "they moved the mowers, springtime"
by Adam Carter 12:03 PM

Sachak says it's "obvious" why they would plan to do this late at night with lookouts. "The obvious answer is, so we don't get caught."
by Adam Carter 12:05 PM

molly hayes ‏@mollyhayes 9s10 seconds ago
Later (after it never happens) Hagerman texts him "did you end up pulling the heist?"
Sachak suggests he used that bc it's more dramatic.

Lisa Hepfner ‏@HefCHCHNews 5s5 seconds ago
Lawnmower heist never happened. #Millard explained via text, "They moved the mowers, springtime." #TimBosma

molly hayes ‏@mollyhayes 3s3 seconds ago
Hagerman says it's just the word he used. DM replies that "they moved the mowers, springtime." #Bosma

Susan Clairmont ‏@susanclairmont 10s11 seconds ago
Sachak says Millard wants walkie talkies, lookouts etc. so they won't get caught. #Bosma

Colin Butler ‏@ColinButlerCBC 21s22 seconds ago
Hagerman is snivelling again, admitting he joked with his friends about "heists" and "theft missions" #Bosma

molly hayes ‏@mollyhayes 27s28 seconds ago
Sachak suggests reasons for nighttime, lookouts, walkie talkies, is because they were "cautious." To not get caught. He agrees. #Bosma

  • #164
Colin Butler ‏@ColinButlerCBC 36s36 seconds ago
Hagerman agrees with Sachak that Millard wanted lookouts with Walkie talkies so they wouldn't get caught. #Bosma

Shannon Martin ‏@ShannonMartinTV 16s17 seconds ago Toronto, Ontario
Hagerman telling the court about a Halloween in 2009-2010. 'We were all drinking. Dellen was driving.' They lifted a bunch of plants. #Bosma

  • #165
Oh, we're returning to the 'he was too rich to steal stuff' narrative.

It was all just boyish shenanigans!

Yeah, ok.

Exactly! To me it is going to backfire. All this time he has been trying to establish that DM had money and didn't need to steal a truck. Now he is pushing this line of questioning which I feel is solidifying the point that they did these things for thrills and excitement NOT for reasons related to money. If DM had all this money, why steal a bobcat, lawnmowers, trees etc. etc. etc. So we have a pattern of theft despite the Defense spending all this time trying to establish that he didn't need to steal. Seems like a pretty significant contradiction. MOO

Susan Clairmont ‏@susanclairmont 35s36 seconds ago
Asked if he ever stole from a garden depot? Hagerman says no. Then remembers Halloween 2009 "we ended up at a Sheridan nursery..."

molly hayes ‏@mollyhayes 26s27 seconds ago

Susan Clairmont ‏@susanclairmont 6s6 seconds ago
"...and a bunch of flowers wound up in the car." Sachak: " Well, they didn't just walk into the car."

molly hayes ‏@mollyhayes 4s5 seconds ago
Sachak "you yourself have done a theft in the absence of Dellen Millard."
"When I was younger probably," he says. #Bosma

  • #167
Sachak asks Hagerman if he remembers stealing planters, flowers and soil from a Garden Depot. Hagerman says he remembers a night from Halloween 2009 or 2010. "Dellen was driving, we were all drinking that night. We went to a Sheridan nursery and ended up with a bunch of plants in the car." Hagerman says. "The plants didn't fly into the car," Sachak says, to a laugh in the room.
by Adam Carter 12:07 PM

Hagerman says that he has stolen "when he was younger" without Millard involved.

Susan Clairmont ‏@susanclairmont 36s37 seconds ago

Colin Butler ‏@ColinButlerCBC 25s25 seconds ago

Shannon Martin ‏@ShannonMartinTV 5s6 seconds ago Toronto, Ontario
Millard's lawyer asking Hagerman, Millard's lifelong friend, about a series of texts about a mission in Oct. 2012. #Bosma

Shannon Martin ‏@ShannonMartinTV 13s14 seconds ago Toronto, Ontario
Millard's lawyer: There's no control, correct? Hagerman: Correct. Millard's lawyer: There's no domination? Hagerman: Correct

Colin Butler ‏@ColinButlerCBC 10s11 seconds ago
They were to steal lawnmowers and Hagerman agrees that he was willing and able to help without coercion, control or domination. #Bosma

Shannon Martin ‏@ShannonMartinTV 23s23 seconds ago Toronto, Ontario
Millard's lawyer: No control, no domination, you want to partake in a group activity with your friend? Hagerman: Yes #Bosma

molly hayes ‏@mollyhayes 18s18 seconds ago
The plan was to steal lawn mowers. #Bosma

.....group activity with your friend?.....Correction ...group activity led by your friend, initiated, planned and executed by your friend who scouted the sites in advance who provided the transportation and who concealed the spoils of each mission in his hangar....and through out the entire process used you've like a willing pawn.....and you stood out on the road in the pitch black of night and did not think for a moment --what in the hell am I doing this for......how did I get here.....etc.

Is this going to affect MH's job? He apparently works as a bartender/bar back. Being a bartender involves handling a lot of money each night.

  • #174
Exactly! To me it is going to backfire. All this time he has been trying to establish that DM had money and didn't need to steal a truck. If I were a juror the only way I'd find any of this germane is if there was evidence of the wherewithal to pull off a previous theft of a vehicle of comparable size and security features. Otherwise it's just obviously a completely different target with an MO adjusted accordingly and out of necessity.

molly hayes ‏@mollyhayes 36s36 seconds ago
It was a surprise, Sachak says. Sudden. Unexpected. Absolutely no plan for this before May 10. A huge surprise. #Bosma

Shannon Martin ‏@ShannonMartinTV 36s36 seconds ago Toronto, Ontario
The calls were sudden, unexpected. Sachak "There was absolutely no plan before May 10, 2013 for him to unload a toolbox to you?" #Bosma

Adrian Humphreys ‏@AD_Humphreys 34s34 seconds ago
Here's video of witness at #TimBosma murder trial who's revealing Millard's vehicle heists to the jury: https://youtu.be/MZNRlZo7HZo #Bosma #law

Shannon Martin ‏@ShannonMartinTV 39s39 seconds ago Toronto, Ontario
Sachak: All of this was a huge surprise? Hagerman: Yes #Bosma

Colin Butler ‏@ColinButlerCBC 23s23 seconds ago
Millard's sudden appearance troubles and concerned Hagerman "a lot." #Bosma

molly hayes ‏@mollyhayes 28s29 seconds ago
It troubled you, Sachak says
"A lot," Hagerman agrees
"But you were still willing and able to meet him bc he was your friend," S says. Yes.

  • #176
I'm not worried about reasonable doubt on a planned theft. Unless something new in the way of evidence is coming down the pipe I think it would be a mistake to insult the jury's intelligence by asking them to believe otherwise. History of theft, burner phone, mumbled fake name, stashed personal vehicle for both test drives, the anticipated testimony from AM regarding foreknowledge and DM's own behaviour after the fact. Please.

For both test drives?

molly hayes ‏@mollyhayes 40s40 seconds ago

IMO, I don't believe this 'poor little rich boy' angle has anything to do with the theft. They are trying to show probability based on previous characteristics, as to who most likely pulled the trigger.

DM, thrill seeker, and detailed planner to not get caught.
MS, angry and unpredictable. His Rap song isn't helping. His 'f'uped', isn't helping.

Not that i believe it.

Hagerman says the toolbox was locked, about 4 or 5 pounds, and it didn't seem like anything was moving around in it.
by Adam Carter 12:13 PM

"The way everything was contained ... it seems like it was wrapped with clothing," Hagerman says.
by Adam Carter 12:13 PM

"You concluded, in your mind, that there was drugs in it," Sachak says. "Yes," Hagerman says.
by Adam Carter 12:14 PM

"So this toolbox was his drug toolbox," Sachak says. Hagerman says yes.

The toolbox was light, four or five pounds, he says. Nothing was moving around. The item seemed wrapped in clothing. #Bosma

Shannon Martin ‏@ShannonMartinTV 40s40 seconds ago Toronto, Ontario
Sachak: In your mind, it was drugs? Hagerman: Yes. #Bosma

molly hayes ‏@mollyhayes 39s39 seconds ago
He'd seen DM hold that toolbox before. It's always been at Maplegate, Hagerman says. #Bosma

Colin Butler ‏@ColinButlerCBC 11s11 seconds ago
Hagerman thought it was drugs, since the toolbox was brought out at parties filled with them. #Bosma

Shannon Martin ‏@ShannonMartinTV 6s6 seconds ago Toronto, Ontario
Sachak: This was his drug toolbox, that's what you assumed all along? Hagerman: Yes. #Bosma

molly hayes ‏@mollyhayes 23s23 seconds ago
It was locked even there, Sachak says. Hagerman said he'd keep it locked but it was open when he saw it. #Bosma
