Or, he was so stoned out of his mind he actually wasn't thinking about what he was doing? Assuming of course, he didn't shoot Tim and was honestly freaked out by finding the gun in the tool box assuming DM was trying to set him up.

Does that mean that DM wrote that down for his lawyers to ask because he wants to know where the gun is? To possibly dig it up later if he is acquitted?

I don't know but it seemed like a really strange thing to ask. Why in the world would MS tell DM where it is, even if he did know? What does DM knowing where the gun is, have to do with anything?

Sachak asks if Kavanagh was respectful to him. Smich says he raised his voice, and wasn't totally respectful, but he was "doing his job."

He's just trying to establish to the jury that MS and DM were close like brothers and that MS looked up to DM like a big brother. So of course DM had to help him out with his mess. It's like a mother telling a child, "tell your father what you did today" when they have done something wrong. LOL Or trying to make the jury think that an appeal from DM means that he is disappointed in MS for not telling the truth.

Great drama question, but the fact that according to MS, DM wiped the phone down. And when he received the gun (according to his story), it was wrapped in a cloth. 99% chance it was wiped down. Only thing it would show is MS did bury it, and it was the gun that fired the spent casing.

Why would DM's defense try and compel MS to tell DM where the gun is? That seemed sort of weird.


It shows that there was a reason why DM didn't give it to MS, and why MS reuses to allow it to be discovered. There is obviously something about that gun that makes it clear that MS used the gun, and they both know it, in my opinion.

Regardless of which one of these creeps shot Tim, knowing where the gun is or even having it tested to prove DNA/prints either way, how in the world would that bring peace to the Bosma family when nothing could bring Tim back?

Nothing. Dm's defense team have nothing else to go on and know I am starting to wonder if in fact MS does know where he buried the gun he is saying he cannot remember so DM won't get his hands on it again to hurt anyone else or MS himself. MOO.

You have to wonder if lawyers do their clients any favours when they advise them to remain silent. Sometimes it seems to me the client would have been in a better position had they chosen to speak to police. Could MS have told police where the gun was and then exercise his right to remain stay silent on other parts of the crime? Is it an all or nothing type of thing?
