Susan Clairmont ‏@susanclairmont 17m17 minutes ago
Smich tells court: "Like I said, I don't know where it is." Tells jury the gun is buried "in Oakville."

molly hayes ‏@mollyhayes 17m17 minutes ago

Millard's lawyer - hammering away again. He wants Smich to give up where the gun is. Smich says he doesn't know #Bosma @CTVNews

Alex Pierson ‏@AlexpiersonAMP 17m17 minutes ago
Smich says the "shock and stress" he doesn't remember where the gun is. @AM900CHML

Shannon Martin ‏@ShannonMartinTV 17m17 minutes ago Toronto, Ontario
Millard's lawyer says he could get hundreds of officers to search for the gun, right now IF Smich could just narrow down where the gun is.

Sachak says 100 officers will go right now if he points it out. "Like I said under the shock and stress I was feeling, I don't know where"

molly hayes ‏@mollyhayes 17m17 minutes ago
Sachak says let's break that down so the jury knows what kind of shock/stress you were feeling. #Bosma

molly hayes ‏@mollyhayes 17m17 minutes ago
Sachak suggests he made the decision to bury the gun because Daly gave him the idea. He agrees. #Bosma

Shannon Martin ‏@ShannonMartinTV 17m17 minutes ago Toronto, Ontario
Smich repeats. I was shocked. Paranoid. #Bosma #HamOnt

Lisa Hepfner ‏@HefCHCHNews 17m17 minutes ago
Where was the gun before he physically picked it up and cycled somewhere? It was in his mother's garage. In a washing machine.

molly hayes ‏@mollyhayes 17m17 minutes ago
Sachak asks where the gun was before this. It was inside a washing machine (not hooked up) in his mother's garage. #Bosma

"You were sober enough to cycle without falling off the bike," Sachak says. "I think you can ride a bike drunk, I've done it before," Smich says.
by Adam Carter 11:22 AM

Smich says he doesn't recall falling off the bike, but says it's "unlikely."
by Adam Carter 11:23 AM

"What I'm saying to the jury and this court is that I do not recall the events of that night," Smich says.

I don't like Sachak or his lame attempts at humour, but he's doing a good job, IMO. Sachak is making it very clear to me that MS is lying. MS can't back his stories up with any detail whatsoever.
As if he can't guess at the size of the spade he used, how he carried the spade on his bike, whether he buried the gun in a ravine or a bush, etc. etc. Pfffft.

It's kind of no win questioning. If he doesn't remember anything that doesn't feel credible, but it's consistent. If he claims to remember it would be "oh you remember this detail but not where you buried a gun!".

@PeterAkmanCTV Millard seemingly enjoying the cross examination of Smich. Small smile on his face. Watching his co-accused. #Bosma @CTVNews

Not sure why DM is enjoying it. He's toast too.

Because he enjoys seeing people suffer? Just a guess. He's a vile human being.

Smich telling jury gun was hidden in washing machine in garage at his mom's house.

Susan Clairmont ‏@susanclairmont 17m17 minutes ago
Google map? "That would not help at all," says Smich.

Peter Akman ‏@PeterAkmanCTV 17m17 minutes ago
Gun was being kept in a washing machine that wasn't hooked up in Smich's mother's garage. #Bosma @CTVNews

Lisa Hepfner ‏@HefCHCHNews 18m18 minutes ago
"The washing machine in the garage was not hooked up to anything," Smich explains. His mother lived there. Diagnosed breast cancer 2011ish

Alex Pierson ‏@AlexpiersonAMP 17m17 minutes ago
Very strong cross. Millards lawyer mocking. Poking pressing him to give up the gun. @AM900CHML

Susan Clairmont ‏@susanclairmont 17m17 minutes ago
"It was a stupid idea that it was brought there in the first place, but that's what I did until I took it out and buried it."

 • #107
molly hayes ‏@mollyhayes 18m18 minutes ago
Sachak says his mother who had breast cancer. Smich says she was cancer free by that point. Says it was a stupid idea to put it there.

Shannon Martin ‏@ShannonMartinTV 18m18 minutes ago Toronto, Ontario
'It was a stupid idea' Smich says, to put the gun at first in his mother's washing machine, in the garage #Bosma #HamOnt

Lisa Hepfner ‏@HefCHCHNews 17m17 minutes ago
"It was a stupid idea," to put the gun in the washing machine, Smich says. "I have somewhat of recollection of taping it...

Susan Clairmont ‏@susanclairmont 17m17 minutes ago
Recalls taking it, putting it in a bag with tape. "There's empty shopping bags around the house."

molly hayes ‏@mollyhayes 17m17 minutes ago
Smich says once he got the gun out, it was put in an empty shopping bag and taped. #Bosma

Peter Akman ‏@PeterAkmanCTV 17m17 minutes ago
"I have somewhat of a recollection, of putting it in a bag, taping it up and removing it." #Smich about getting rid of gun #Bosma @CTVNews

 • #108
Maybe there is method to this madness of cross. Maybe Sachak is trying to get him agitated to show how his temper can escalate? Just a thought.

 • #109
IMHO, if MS had told LE where the gun was, he would be the only one on trial right now and DM would have gotten away with 3 murders.

Why would you think that? No doubt DM had already wiped it before wrapping it in cloth and putting it in the toolbox so no one would expect his fingerprints to be on it. He also washed the satchel that MS claims he put it in. Why would he have done that? MS may have played around with and touched the gun, including he trigger, when he got it, but apparently Arthur was there to vouch for him about his surprise when he first saw it. I suppose if it was necessary, putting Arthur on the stand was an option?

I think he's lying about the gun because he was under surveillance that week. How did the LE officers in charge of his surveillance miss him leaving Speers and heading over to his mother's place? And how did his mother or sister miss the fact that he was out in the garage wrapping up a gun in a shopping bag?

His sister told him to get "everything" out of the house. Did she also assist him in getting everything out of the house? Is he covering for someone he loves very much here?

There is no other reason why he shouldn't have helped LE locate that gun if he could have. No one would expect the shooter's prints or victim's DNA to still be on it after all it went through IMO.

Were you planning to stick it on a wall? Take it to college and say this is what a gun looks like when it's taped? #Bosma

Peter Akman ‏@PeterAkmanCTV 18m18 minutes ago
Question after question after question... but no real answers from #Smich #Bosma @CTVNews

IF in fact, MS did not shoot Tim but it was DM that did, it would obviously be in MS's best interest of course to produce the gun. IF this is actually what happened, and IF he really did bury it in a haze of panic and confusion and smoking and drinking... it would seem to me he really doesn't remember where he buried it.

I agree but at the same time everyone responds to crisis and trauma differently in their brain. So while I think MS knows where the gun is, I could definitely see him acting paranoid and thinking fast without realizing all of the consequences...even if he didn't shoot Tim. And even if it could exonerate him. MS just doesn't seem too bright.

 • #115
He has a reason to hide that gun. Sorry, but if he rode into the woods, he knows what path he took and can give a general idea. Like oh I turned off this road and road my bike for about 5 mins before I buried it. Or I entered the woods through the park. Heck, I could tell you where I entered a wooded escarpment for a hike 3 years ago. Plus he's from Oakville, and he obviously entered the woods close to home. This is all imo.
