I thought he was saying the gun was putting in a shopping bag then tape wrapped around it. Some statements sound like he wrapped the gun in tape, then put it in a shopping bag.

Tape around the gun would make it near impossible to collect any evidence from it, especially fingerprints. He knew exactly what he was doing... MOO

The gun had been wiped. It is quite obvious that he is preparing the gun to survive in the elements without corroding, meaning he intended to retrieve it at some point.

Even if he wasn't the one who used it to shoot Tim, it would have had his fingerprints/DNA on it as well so yes, I agree he knew exactly what he was doing.

Sachak suggests he had the bag with the gun in his hand. Smich says he doesn't agree with that, he doesn't recall. #Bosma

Susan Clairmont ‏@susanclairmont 21m21 minutes ago
Doesn't remember either where bag with gun was while he cycled to forest.

Colin Butler ‏@ColinButlerCBC 23m23 minutes ago
Smich holding his against Sachak's mocking line questioning. Answering "I do not remember" to each of his suggestions. #TimBosma

molly hayes ‏@mollyhayes 22m22 minutes ago
Sachak says "give us a likely scenario." Smich says he does not reall, only that he was a bit drunk and a bit high that day. #Bosma

Lisa Hepfner ‏@HefCHCHNews 22m22 minutes ago
Smich doesn't agree. He doesn't remember how he carried the gun. "So give us a likely scenario! That's all I'm asking for!" Sachak says

molly hayes ‏@mollyhayes 22m22 minutes ago
He says he couldn't sell it, everyone was telling him to get rid of it. Daly suggested burying it. #Bosma

Alex Pierson ‏@AlexpiersonAMP 22m22 minutes ago
Smich doesn't recall how he transported weapon. What it was in. How he carried it. Where he biked. @AM900CHML

Lisa Hepfner ‏@HefCHCHNews 22m22 minutes ago
Smich goes through his story of trying to sell gun, getting advice to bury it, being scared and shocked and having that impact his decision.

molly hayes ‏@mollyhayes 22m22 minutes ago
He says the shock he was under affected his ability to remember it. #Bosma

Susan Clairmont ‏@susanclairmont 22m22 minutes ago
"I recall only that I was a little bit drunk that day, a little bit high." And that Daly suggested he bury it. Plus shock. #Bosma

Susan Clairmont ‏@susanclairmont 22m22 minutes ago
"I think you can drive a bike drunk. I've done it before," Smich tells court. #Bosma

Peter Akman ‏@PeterAkmanCTV 21m21 minutes ago
"I think you can ride a bike drunk... I have done it before." Smich about going to hide the murder weapon #Bosma @CTVNews

  • #145
I believe he's telling the truth that he buried it and today doesn't know where it is because he passed on the location to someone who then dug it up and from there, who knows where it ended up.

  • #146
I believe Smich knows where it is. Biking, walking, skateboarding...he knew the area well. While I agree he has a reason to hide it/say he doesn't know where it is, it still doesn't convince me 100% that DM wasn't the one who did pull the trigger. IMO MS was a paranoid mess so I could understand his brain thinking the best thing to do was get rid of it - especially with his own sister telling him and his friends.

I think DM's team is doing a decent job of poking a few holes but parts of it are also going nowhere.

  • #147
Sachak isn't doing himself any favours, but it goes without saying MS is a lying 🤬🤬🤬. He and CN should hook up, but I am guessing they'll never be able to find one another. They will set a date, walk out the door and forget where to meet.

I am more convinced today than I was yesterday that MS ambushed TB from behind and shot him while DM drove, as was the plan all along. MOO

Lisa Hepfner ‏@HefCHCHNews 22m22 minutes ago
He doesn't remember falling off his bike. Says he was drunk and stoned. But didn't have any injuries. Doesn't recall ride. #TimBosma

molly hayes ‏@mollyhayes 22m22 minutes ago
Sachak suggests he didn't fall off the bike. Smich says that'd be a fair suggestion (bc he had no cuts) but he doesn't recall. #Bosma

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak says we now know you managed to cycle to a forest without falling off the bike or the bike being damaged. Smich doesn't remember.

Colin Butler ‏@ColinButlerCBC 21m21 minutes ago
Sachak going on tangents about whether Smich fell off his bike, or whether Smich had a spade taped to his head. Smich maintains its hazy.

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak: "so what you're saying to the jury is 'I don't recall whether I fell or didn't, it's unlikely I did..." #Bosma

Shannon Martin ‏@ShannonMartinTV 21m21 minutes ago Toronto, Ontario
Millard lawyer throws out all sorts of ridic scenarios: Did you tape the spade to your body? Did you fall off the bike? Smich doesn't recall

molly hayes ‏@mollyhayes 21m21 minutes ago
Smich says "what I'm saying to the jury and to this court is I don't remember the events of that night." #Bosma

Susan Clairmont ‏@susanclairmont 22m22 minutes ago
"What I'm saying to the jury and the court is I do not recall the events of that night." Smich still polite, but becoming a bit combative.

Lisa Hepfner ‏@HefCHCHNews 22m22 minutes ago
Sachak trying to establish Smich made it to the forest without falling. Smich says he does not remember the night. #TimBosma

molly hayes ‏@mollyhayes 22m22 minutes ago
Sachak going back to this idea of whether or not he fell that night. #Bosma

molly hayes ‏@mollyhayes 21m21 minutes ago
Smich sighs, says he's answered this. #Bosma

Colin Butler ‏@ColinButlerCBC 22m22 minutes ago
@ColinButlerCBC "I don't recall"

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak suggests he was riding a traditional bicycle. It was a BMX stunt bike, Smich says. #Bosma

Peter Akman ‏@PeterAkmanCTV 21m21 minutes ago
"I will keep on asking you the question until you answer the question." Millard's lawyer to Smich under cross. #Bosma @CTVNews

Susan Clairmont ‏@susanclairmont 21m21 minutes ago
Sachak's absurd questions are starting to rile Smich. Smich says it was his BMX bike, "It's one of my hobbies." #bosma

Lisa Hepfner ‏@HefCHCHNews 22m22 minutes ago
The bike didn't have a navigation system, Sachak asks. It was a BMX stunt bike, Smich says. A hobby of his. #TimBosma

molly hayes ‏@mollyhayes 21m21 minutes ago
Sachak suggests he would've had some level of coordination then, especially since he'd been drinking or smoking. #Bosma

Lisa Hepfner ‏@HefCHCHNews 21m21 minutes ago
The physical act of cycling to the forest requires coordination, right? Sachak asks. "It was more of a random thing," Smich says.

  • #151
What day did the media show up? What day did BD try to sell the gun to "Bleach"? :waitasec:

Okay we know it wasn't the night of the 11th or the 14th because he was under surveillance then.

So it had to be the night of the 12th or 13th?

MOO

Yes and what day did MS's sister and Mom go to MM's sister's house to tell MS he better get everything out of the house? Surely that date can be determined. MS said he buried the gun on this date. Also did MS take a cell phone with him when he buried the gun?

All MOO.

molly hayes ‏@mollyhayes 21m21 minutes ago

Lisa Hepfner ‏@HefCHCHNews 21m21 minutes ago
He left his mother's house, on Montrose Abbey Drive in @townofoakville near Dorval & 4th Line/Old Abbey Lane

Susan Clairmont ‏@susanclairmont 21m21 minutes ago
Mom lived at 1081 Montrose Abby Drive in Oakville. Main intersection is Dorval and Old Abby Lane, says Smich. #Bosma

molly hayes ‏@mollyhayes 20m20 minutes ago
Sachak asks how long he'd been living there. Smich says for a "considerable" amount of time. His mom moved in probably 10 yrs ago. #Bosma

  • #153
I believe he's telling the truth that he buried it and today doesn't know where it is because he passed on the location to someone who then dug it up and from there, who knows where it ended up.

I'm wondering if it could tie into the charge for communication with MM.

Interesting short article about marijuana and memory:

http://www.hightimes.com/read/how-does-pot-affect-memory

"The latest research on the effect of cannabis on memory has shows that it affects spatial memory but not associative memory. Smoking marijuana might not affect your memory of what you and your friends talked about while walking around town, but you might not remember exactly what route you took."

...

"After waking up from a night of smoking with your buddies you’ll still have hazy recollections of everyone’s hilarious antics, but the exact location of the pizza place you ate at will always remain a mystery."
