Judge is certainly covering all the bases with his charge to jury. Can't see how any of the lawyers or accused could find error in this judge's instructions!

Sounds like the judge wants a"not guily" verdict based on his instructions so far.

He is advising them of the law and what can legally be considered in order for a fair trial. If he was crafting his guidance in favour of one decision over another, that would be grounds for a mistrial.

Or, TD decided that he wouldn't recall BD as he knew some of the testimony would be disputed by BD, therefore no point to it. TD certainly gave the impression he was vigorously defending MS, but if he knew MS's testimony would be disputed..... at least TD can't be blamed for not appearing to defend his client from outward appearances.

That is actually how I interpreted it....instructing the jury to consider why the Defense lawyer corroborated certain parts of the story with witnesses while not doing the same with other witnesses. Did he not ask the questions to certain people because he knew it would work against his defense? That was how I read it. MOO

Goodman also talking about the DNA evidence. He says it's "safe to say no one else on this planet" could have been the source the the DNA talked about at trial.

I take his explicit instructions to mean he wants to ensure there are no grounds for appeal later.

You added a 10 km loop on Book Rd that contradicts Smich's own testimony. From Molly Hayes's tweets:

  • Smich says he pulls out of laneway [farmer field], making a left (westbound) onto Book Rd and follows.
  • Both vehicles then make a right on Trinity Rd. First the truck (driven by Millard), with Smich driving Yukon behind.

Your scenario also assumes the additional video sightings were not Bosma's truck. It also assumes the Super Sucker video is exactly 3 hours out from the cell towers given the time they arrived in Bosma's driveway. In a previous post I explained why I believe all of this is unlikely.

Yes, the post assumed the additional truck sightings were not Tim's. As I said the post was intended to generally match Smich's account, deviating only to include the testimony from Bullman that claimed they continued west on Book. The post also does not assume SS video is only 3 hours out because in my post the SS time it is relative only to itself. I attempted to explain 34 minutes between Yukon sightings on the SS video in a way that might fit selective evidence supporting MS's claim. It is not the only or the best hypothesis, but it's one that would work. Every interpretation of the timeline evidence in this case is selective in some way.
