Jury is back in. Now judge is summarizing positions of the parties.

Susan Clairmont ‏@susanclairmont · 15m15 minutes ago
Crown position is that Millard and Smich planned the theft of the truck, the deliberate murder and incineration of Tim Bosma.

Susan Clairmont ‏@susanclairmont · 14m14 minutes ago
Crown says actions of accused before and after murder prove overwhelmingly Smich and Millard are guilty of first degree murder.

Susan Clairmont ‏@susanclairmont · 14m14 minutes ago
Crown says it doesn't matter which one pulled the trigger. Are you satisfied they worked together and knowingly participated in the murder?

Susan Clairmont ‏@susanclairmont · 13m13 minutes ago
Crown does not need to prove motive. "We all want to try to understand" why Tim was killed. #Bosma

Susan Clairmont ‏@susanclairmont · 12m12 minutes ago
The two had access to a gun and was part of the escalation of the mission, Goodman says in stating Crown position.

Susan Clairmont ‏@susanclairmont · 12m12 minutes ago
Crown says plan to "steal, kill and burn" was an "all-nighter" as stated in Millard text to Noudga.

Susan Clairmont ‏@susanclairmont · 11m11 minutes ago
Smich and Millard worked together to take Bosma on a test drive, incinerate his body together, travel together, clean up together...

Susan Clairmont ‏@susanclairmont · 9m9 minutes ago
Summary of position of Millard is that Crown has failed to prove his guilt beyond a reasonable doubt. #Bosma

Goodman pointing to Pillay's close, where he says Smich would, "lie to save himself."

Millard counsel says Smich's demeanour stands in stark contrast. He tried to hide his face.

Susan Clairmont ‏@susanclairmont · 7m7 minutes ago
Millard told people he was planning to steal/get a truck. Why would he do that so casually if he planned to murder its owner?

Susan Clairmont ‏@susanclairmont · 6m6 minutes ago
Browser history showing search for 3500 trucks, including #Bosma's ad on AutoTrader, were not erased.

Susan Clairmont ‏@susanclairmont · 6m6 minutes ago
Millard didn't try to cover his AMBITION tattoo when doing test drive with Igor Tumenenko. Also, he didn't clear his schedule for that week.

Susan Clairmont ‏@susanclairmont · 5m5 minutes ago
Everyone around Millard seemed to know of existence of incinerator.

Susan Clairmont ‏@susanclairmont · 5m5 minutes ago
Makes no sense for #Bosma truck to drive around with Bosma dead inside. Not careful planning.

Susan Clairmont ‏@susanclairmont · 4m4 minutes ago
Failure to have incinerator ready at hangar, warn staff ahead of time not to come to work, failure to destroy the DVR...not well planned.

Susan Clairmont ‏@susanclairmont · 4m4 minutes ago
Other missions had been carefully planned.

Goodman is now turning to the position of Smich's lawyers -- that he testified because he wanted the jury to get the "full picture."
by Adam Carter 3:35 PM

He notes that Smich was cross-examined for a week, but didn't deviate from his story.

Smich ramrod straight in his chair, looking at judge. Millard taking notes.

Why is Millard constantly taking notes and Smich rarely does it seems? What do you all take their body language to mean?

I thought about this a while back. It seems DM is always taking notes and I wondered if his notes were on how to conduct himself in court when he represents himself. But I do think he is taking very details notes for the purposes of trying to make an appeal. From his letters to CN, you can see he likes to spin stories and write our his thoughts. JMO.

Just catching up. Sounds like the jury is going to be doing some tree climbing this week ;)

Thanks to meterclicks, mozzagirl and canadiangirl for posting the tweets and blog today. :tyou:

Millard could not have known if there was GPS on #Bosma truck or not. So why would he steal it, without being sure?

Susan Clairmont ‏@susanclairmont · 3m3 minutes ago
Millard says Walther PPK gun is Smich's firearm.

Susan Clairmont ‏@susanclairmont · 2m2 minutes ago
Millard submits that, unknown to him, Smich brought a firearm to the test drive on May 6.

Susan Clairmont ‏@susanclairmont · 2m2 minutes ago
"It was Mark who ****ed up a truck robbery, not me," Millard wrote in a jailhouse letter to Noudga.

Susan Clairmont ‏@susanclairmont · 2m2 minutes ago
Smich position. Smich chose to give evidence at this trial. Cross-examined for 7 days by experienced lawyers and his story didn't change.

Susan Clairmont ‏@susanclairmont · 1m1 minute ago
Smich sick during Tumanenko test drive. At #Bosma test drive, Smich got out of truck, leaving Millard and Bosma alone in it.

Susan Clairmont ‏@susanclairmont · 49s49 seconds ago
Smich followed behind in the Yukon. Millard suddenly swerved over and stopped Bosma truck. Bosma was dead, laying headfirst on dashboard.

Susan Clairmont ‏@susanclairmont · 8s8 seconds ago
Smich described Millard as a "lunatic." Yet Smich followed Millard to the farm and hangar. "He was scared and confused." #bosma

He's running through what Smich says he saw on May 6, when he saw Bosma's body inside the truck.
by Adam Carter 3:38 PM

Also talking about how Smich buried the gun, and about how his rap lyrics are fiction.

Does anyone have any idea if the Judge Goodman will finish the evidence tree and send the jury away today?...I guess I shall turn on tweeter too...hmm....seeing Sillybilly's thread on verdict alert makes one believe that it will happen tonight ..Plus as I posted the Toronto Star thinks so too....?..thanks Robynhood.

I think he gave the jury about a quarter of the picture the way he repainted it. Pretty easy not to deviate from "I don't know, I don't remember, I was scared and confused."

IMO, even if he runs a little over time today, Goodman will send them to deliberate starting tonight. If it gets to 4:30 and he is almost done I can't see him continuing tomorrow instead.

That is the plan robynhood. Unless Judge Goodman is deterred by a lengthy legal argument within the next hour, I think the jury will get this case by the end of the day.

Also going over Smich's evidence that this was supposed to be just a "scoping and stealing mission."
by Adam Carter 3:41 PM

Goodman also pointing out how Smich's lawyers say he had no motive to kill Bosma.

All news outlets and Goodman reported the jury will start deliberations tonight.....they brought their suitcases this morning in preparation for being sequestered. I know you posted earlier that Goodman's instructions would last until tomorrow, but that was honestly the first I had heard that.....even as far back as over a week ago the plan was for Goodman to give him instructions on Friday the 11th and Monday the 13th and then have the jury deliberate. He has always been prompt, I can't see that plan changing. MOO

Here is my opinion after reviewing the decision tree's. They are either going to find them both guilty of 2nd degree murder or they are going to find DM guilty of 1st and MS not guilty. Let's see what happens MOO

thanks Kamille and Mozzagirl ..I like to see Justice for tim Bosma and especially his family...JMHO enough already from these to slugs...Robynhood

Goodman is now onto his last portion of his charge -- concluding instructions. He again thanks the jury for listening.

Smich testified he did not help burn Bosma's body. Millard did it. Smich said "He ****ed up" because he shouldn't have gone on test drive.

Susan Clairmont ‏@susanclairmont · 7m7 minutes ago
Smich can't remember where he buried gun. If he was lying, he could say he threw gun in lake, his counsel says.

Susan Clairmont ‏@susanclairmont · 7m7 minutes ago
Smich says his raps are fiction. He rapped he had lots of women and lots of money and, in fact, he had neither. #Bosma

Susan Clairmont ‏@susanclairmont · 7m7 minutes ago
Smich and Millard had stolen together before and nobody was hurt.

Susan Clairmont ‏@susanclairmont · 6m6 minutes ago
Smich told Meneses on May 6 that he would be back in a few hours. He wouldn't have said that had he known there would be a murder. #Bosma

Susan Clairmont ‏@susanclairmont · 5m5 minutes ago
DVR video from hangar shows Millard wearing his satchel, "Just as Smich described," Smich legal team said.

Susan Clairmont ‏@susanclairmont · 3m3 minutes ago
"Not only did Michalski lie to police, also lied to you, the jury," said Smich's team. Smich told Meneses he wasn't even there for murder.

Susan Clairmont ‏@susanclairmont · 2m2 minutes ago
Smich had no reason to kill #Bosma, says his lawyers. Suggestion he killed him to be rewarded with a Caddy from Dell, doesn't make sense.

Susan Clairmont ‏@susanclairmont · 2m2 minutes ago
Smich didn't even have a driver's license.

Smich team says no evidence Bosma was killed in Bullmann field. If he had, there would be glass, sound of gunshot...

Susan Clairmont ‏@susanclairmont · 3m3 minutes ago
If Millard killed #Bosma unexpectedly, it makes no sense MIllard would continue driving #Bosma truck.

Susan Clairmont ‏@susanclairmont · 2m2 minutes ago
"Those are the respective positions of all parties at this trial," says Justice Goodman. He is not thanking the jurors for their patience.

The jury will get verdict sheets for each accused in the jury room, Goodman says.
by Adam Carter 3:49 PM

"A conviction for accessory after the fact is not available for your consideration ... in those situations you must find Mr. Millard or Mr. Smich not guilty," Goodman says.
by Adam Carter 3:50 PM

Goodman says their verdicts must be unanimous, but they don't have to come to that conclusion the same way.
