380 acp is the max caliber energy-wise that works with direct blowback mechanism. It's a 9mm projectile, but reduced powder charge and, therefore, a smaller case. The benefit is in the simple and compact direct blowback design. 9 mm Luger requires positive breach locking.

I swear, I knew it's going to be a walther ppk when they announced the discovery of a 380 casing. Walther ppk is the original James bond gun. The a-hole was playing 007 or something.

Um…Did you read yesterday's testimony about CN wanting to be a secret agent like James Bond?

I would just like to state in MS rap video, where he plays the murderer and has a guy tied up covered in blood, one of the lines of the lyrics is "1 shot to your brain as your sitting inside"( WM, smich was living in the basement when WM was killed) and the last words of the song are 'gone, gone, gone...'.

I keep thinking of MS telling MM that he was just a "drug dealer" when she asked him if he was involved. I get the feeling the pound of pot held great importance to MS and not because MM wanted to smoke it (as she testified). I believe it was supposed to be his payment for his part in the mission. IMHO

I agree! It could be as simple as the shell casing rolling when they loaded the truck in the trailer. Just an example. MOO

Which brings me to a question. Is DM smart enough to load that truck into the trailer on his own?

He may have been smart 'enough' but I do wonder about how the driver ((unless petite/slim)) could exit the truck after loading -- CN or MS?

Anytime a defendant stipulates in a trial, I think the jury appreciates it. They don't all have to sit through handwriting experts which would slow the pace down and making the state or crown prove what is obvious is like giving them a win. Millard likes to win. This is my opinion only, but I wouldn't be surprised if he wrote some of the letters in anticipation that they would be read in court some day. He only told her to destroy the letter when he was trying to get her to convince Michalski to change his testimony. The letters when he puts the blame on Smich, he is probably happy the jury is hearing it.


BBM - And that is pretty much what I was saying in my post in the wee hours of the morn this morn. There is something "sneaky" going on with "cryptic codes" on some letters. Perhaps the coded ones were the ones she was suppose to keep hoping they would make it to his trial? MOO.

This one is August *symbol* -- she says in another letter he'd written out a "cool way of keeping track of time." disagrees it was a code.

So it's from Aug. 2 or 3. There is a portion blacked out. Judge explains parts have been deemed inadmissible and warns not to speculate.

Now seeing another letter. This too has symbol for the date. She says its Aug 10 or 11. Explains you count lines or dots in symbol.

Next letter we see is from Aug 11 (based on two dots). So actually precedes last one.

MS is the drug addict but CN talks about how stoned she and DM were.

Is drugs how DM kept his minions around...drugs? When you're hooked, some people will do just about anything for a fix. I'm beginning to believe DM turned many of his groupies into addicts or users; MS, MM, CN, LB for starters. MOO.

DM saying "Stage 1 complete. Taking a respite." IMO implies a plan in stages. We know this comment was inclusive to TB's death and more than merely cleaning up a mess.

This makes sense. I am certain that the lawyer MB spoke to told her exactly what she could and couldn't do regarding the trailer. CN wiping MB's prints off the trailer wouldn't implicate MB I imagine?

IMO CN wasn't wiping off hers and MB's prints from the trailer, CN was wiping off hers and DM's prints ;) MOO.

On what are you basing the statement "it was MS's gun"?

I don't have links in front of me, but I thought we heard testimony about DM buying a walther .380 from MWJ for $1200, same caliber as the shell casing? (I am open to correction if I've got this wrong.) And in the past I've seen posts that DM bought a concealed .380 holster on eBay. (I don't believe that part came up in the trial.)

Miranda16 asks up thread how we know DM drove the Dodge, I feel like this is something we're pretty solid on but I can't remember why. Is it because he told SS he drove it while sitting on a crate or something? He also had the Dodge key on his keyring. But wasn't there something else?

Edited to add: on the "I f'd up" comment. You know how sometimes when people say "I'm sorry " they really mean "I'm sorry I got caught"?

I think this was MS's moment of regret for being involved with killing TB, and to a large degree it was regret because he knew then he was going to be caught.

Still personally undecided on who pulled the trigger, but the GSR was over the driver's seat, and DM drove away from the Bosmas' house, and he was the one with $1200 to buy an illegal handgun.

Why does he say that it is MS's mess at all?

IMO he has a character flaw that doesn't take responsibility. Everything is everyone else's fault--WM for debt, his mom for stalling giving him money, AM for spilling his guts...He plays the blame game.

Yes, if it was an accident, they wouldn't have been celebrating and acting happy, they would have had some consternation on their faces IMO.

I continue to believe that MS did not pull the trigger (at least without being ordered to), and not because I feel some sympathy toward him or feel in some ways he wouldn't do that. Rather, he was the minion, and in the dynamic of their relationship with DM, DM ALWAYS called the shots (no pun intended). Mark would not be "authorized" to act on his own in that way, unless DM instructed him to. There is a chance MS might have pulled the trigger if somehow TB broke loose of the bonds and was fighting DM while DM was driving....DM may have ordered Mark to shoot at that point.

Further, because DM was the mastermind, and the primary beneficiary of each mission, MS would not have likely risked doing something so serious as killing someone for Dell when he was just getting paid a relatively small stipend to assist.

So, it's my belief, MS did not pull the trigger, or, if he did, it was under direct order from DM in a situation where MS had little choice, or under total mental submission to DM's manipulative mastery.

LE says he was dead by gunshot before being burned, but what if not? Then it's not about trigger pulling at all. He could have been beaten to death, choked, or burned alive. The point is he's dead and MS was involved. I think MS had trouble making it in the real world,and DM and he decided to become gangsters. The pic of him at his sister's wedding is telling IMO.

I am not disagreeing that she might have been loyal to him for quite some time after he was arrested. And I completely agree that I think she would have been treated differently if she had shown cooperation. But I don't agree that she is still loyal to him. I think she is now needing to protect herself. Her testimony has not been casting DM in a good light but it has been protecting herself. Seeing their dynamic in the court room has been much less interesting than I thought it would be. JMO :)

She maybe isn't in the place to call him a scoundrel yet. Doing so negates their relationship which at the time was important to her. I was in a relationship yrs ago with a manipulator. It took a long time for me to move on and to say bad things at the time would be to say I made a judgment error--something I wouldn't admit. So she'll get there IMO.The adult brain doesn't fully mature until 25, so in a yr or 2 she may see things very differently. IMO

There would be no point to wiping DM's prints from the trailer locks. The reason was it is his own property ever since he bought it (or stolen it) and his prints would be all over it anyway.
Pointless. It would be the same as my sons wiping my prints from my walker if I had committed a crime with that and was currently in jail.

What if those prints were mixed with blood/DNA of the deceased? Whole different situation in MOO.

So, with the Crown witnesses winding down (CN possibly being the last), does anyone think we'll find out about the hoses and washroom at Riverside? There was some interesting speculation on yesterday's thread about them having been used to wash out the clean up can from the incinerator. However, even with that as a possibility, I'm still darn curious.

Could it be that legal arguments, following the testimony from JV, had any further testimony about that evidence quashed?

What think you?

I was wondering a) if that's what they were looking for in the hangar--the can. and b) if they didn't bring it up out of sensitivity to the family.

That is not so far fetched ..... I have often thought the original plan involved more than just shooting somebody while driving down the road.

The urgency ws DM's need for money and this was a practice run.

I think his hairbrained idea was to do body disposal jobs to bring in money, and this was a practice run. Maybe both theft and disposal.

If the hose had blood, he must have been washing something bloody. He had asked about the power washer. Cjouldn't find it so took something to Riverside to wash? Then wanted to wash blood away.

Wondering if MS messages irretrievable were planning the seat burn, etc.

Wonder if SS got new phone to get rid of text msg because DM had asked him to help load the truck into the trailer? He was up there with him that day to hide the red truck.IMO

I wonder if shower traps at Riverside and Smich residence have been tested for residual dna -- presumably all the perps would have had to have a shower MOO
