I wondered if it had something to do with the realtor email/s. Perhaps the listings he forwarded to Nancy in her efforts to 'get out of the house ASAP.'

That is what I thought as well.

I thought LE testified that his bathroom was pretty clean (as well as the kitchen).

Correct, but it was time for quarterly service anyway. Perhaps she knew that anyway when she called.

She went out of her way to make a special phone call to him. Regular/quarterly service didn't require her to do anything since it was automatic.

But the point still remains: the garage was still a cluttered mess, where NO CAR COULD FIT. That is the importance of the bug guy testimony, much more so than the bugs he saw in the house. It directly contradicts what BRAD SAID to investigators, in his affidavit, and again, in his deposition. BRAD LIED. He did.

The sticks and ducks weren't used in a fight...they might have been damaged in a fight, or, Brad was afraid there might have been evidence on them...evidence he couldn't clean away, so he tossed them.

Yes, JA testified she saw those items on 7/11 in the house. Her testimony is solid and truthful and was not impeached. Brad, during his deposition, had no explanation for the missing sticks in the foyer and tried to make it sound like it was something the girls put in the vase, which was not true.

So we're to believe this witness about the ducks and she could not possibly be mistaken but disregard any witnesses who claimed to see her that morning because they HAD to be mistaken? I am skeptical about a person remembering the ducks, especially since they were boxing everything up in prep of a move. That is not a typical item to leave out if you are getting ready to move. I'm not saying she is lying, just doubtful she saw them on the 11th.

ETA: the ducks are not important in my mind because I'm not positive they were there on the 11th.

I don't dispute the garage. That was something that hurt defense yesterday (although I don't know if anyone here expected the guy to know who was sleeping with whom).

Just as an aside, I don't know how they had it, but I have quarterly service and I still need to call to schedule an appt. I usually get a call reminding me of this but they don't just 'show up'.

He said he cleaned it out the previous week but the exterminator said the right side still had 10-12 toys . I did notice that he said that the left side usually was completely packed.

Day(s) before Nancy came home from her vacation on Sunday July 6, 2008 (per BRAD).

I thought it was the Saturday afternoon they left?
In any event it was before the bug man saw the clutter

Yeah where did those toys go? Are they the ones that are kind of pushed over to the left side in the photos?

Right. Before Nancy got home from vacation. And JTF may be more accurate in it being the same day after Nancy & kids left on vacation.

Well, I think the pool was against a wall and a barbie toy was hanging up. No idea about the other stuff.

Thanks. Just trying to gauge how quick a job it was to clear the space for the car.

I don't think it was as long as maybe we initially thought. The exterminator said the left side usually was pretty packed so he would only had to move the small amount of objects on the right side. I had initially thought both sides were pretty cluttered but the exterminator didn't make it seem that way (to me). I'd say probably 15 min tops.

3 days earlier the pool was on the garage floor with 10-12 outside toys.
When do you think he decided to clear the garage and why?
Hint: He could park his car in the right side for the first time, per any evidence.

That's what I'm thinking too. I was also thinking both sides were originally equally filled.
