At the very least, he is rationalizing. If his musing in that one tape to Wendy Hutchens is a recollection, then he thought she was breathing, but then thought she was dead, and somehow he bashed her on the head, and doesn't know why and can't explain it to her parents. To his mind it seems that could be an accident.

But I'm pretty sure that a court of law won't find that to be an accident, so it doesn't matter what he thinks it was to justify it in his mind.
You're right, it is all about what is in his mind. What was he doing with a garotte and duct tape that'd turn into an accident? What is an accidental explanation for her fractured skull ~ that he dropped her on the floor? Just questions I guess we'll have to wait for the answers on.

JK has hinted, but I don't recall him saying, "I killed her."

He said it was an accident and, "No," when asked if he was innocent. He admitted having sex with her. He said he was with her when she died. He says he thought she was breathing, etc. But, he hasn't spoken those three words. Even the tapes are evasive. "How do you tell a parent...?"

As far as his claims that it would be 2nd degree murder because he did not intend to kill her, there are many special circumstances (sorry I forget the legal term at the moment) that ...even if he did not intend to kill her...(if he even did it at all) would probably cause the case to be considered first instead of second degree murder...

a couple of the circumstances:

Lying in wait
Sexual assault
kidnapping
Possibly something for a child victim being under a certain age

I just about keeled over when I heard that he said it was second-degree murder instead of first...supposedly if he is such a crime buff he should know about things like this.

(CNN) -- The suspect in the slaying of JonBenet Ramsey made additional statements about the child's death once he reached the United States, a source told CNN.

As he was being driven to the Los Angeles County jail, John Mark Karr began talking calmly to himself while looking out the window, a source involved in Karr's transfer said.

"Everybody says I couldn't know my way around the house, but I got in the house around 5 o'clock ... and I stayed there all night," the source quoted Karr as saying. (Watch how Karr keeps on talking -- 2:23)

Karr, 41, also said that "they" -- meaning the Ramseys -- did not come home until about 10 p.m. He also repeated what he earlier told reporters -- that JonBenet's death was an accident, and that he was with her when she died.

Fox news reported on the BIG STORY that JMK is to be moved to Boulder sometime tomorrow, but no report on the time. I am not sure that I believe that they really know this as there has been quite a bit of secrecy as to when he would be moved, and there has also been quite a bit of miss-reporting in the last week.

But I thought I would post what they said anyway.

Thanks Dragonfly. I wouldn't be a bit surprised if they moved him in the middle of the night. Cut down on the chances for reporters being around.

Yes MM there is now a Media Camp Ground outside the jail in Boulder according to Rita on MSNBC this morning.

I don’t think he meant that he was there in spirit for exactly five hours.

We are just going to have to wait and see how this shakes out. I don’t think we should just let him go without an investigation.

Karr's has said a few things, yes...but he needs to be actually placed in Boulder at the time of the crime, and also be tied to the house before one tries to navigate through Karr's story...it seems likely though Karr will stick with his old story (but who knows if he's tinkered with it).

From hearing what the two defense lawyers who talked to him were saying...at this stage nothing Karr says should be taken at face value, I feel.

Sometime before dawn, JonBenét is killed; her skull is fractured, she is strangled with a cord, duct tape is put over her mouth, and her body is placed downstairs in a small windowless room in the basement. She is wrapped in a blanket, with the ligature still around her neck, head uncovered, and her arms above her head.

A judge was interviewed on Fox. He said the DNA was contaminated in both samples. the fingernails were exposed to air and the undergarments were also questionable. He said the BPD went and bought the exact same undergarments from the same store... the same kind of foreign DNA was present... probably from factory workers who handled the garments.

He said there could be enough points that match or don’t match, but that it may also be inconclusive. And that %99 of murder cases are convicted without DNA.

Exactly...considering how obsessed Karr was...he certainly knows enough about the case details.

He also said he went to the Xmas party at the Ramsey's. So far, I haven't heard anyone say he was there. I don't believe much of anything this guy is saying. He seem to be having a hard time understanding fact from fiction. Next he'll be saying that he had a chat with Patsy (last night).

I believe JR told police something to the effect of "I put JBR to bed and read." The police assumed he meant "read to JBR," but JR later said he just meant he read a book (to himself) for awhile after tucking in JBR.

I don't know if it is true, but it's not an unresonable explanation, IMHO.

That's interesting...and new to me. I've never really thought that the DNA was anything but a red herring.

According to an ABC News report, the parents of Karr's first wife say that they discovered letters signed "S.B.T.C." The story doesn't say whether the notes are still extant:

Still, Ray's parents said they discovered letters Karr wrote to their daughter that were signed "S.B.T.C." — the same initials found on a ransom note left in the Ramseys' home.
