GUILTY Brock Turner, college swimmer, CONVICTED of rape - sentenced to only 6 months in jail

Wouldn't it make more sense to demonstrate next to a court building?

It makes the most sense to demonstrate wherever you're going to have the most people show up. As well, many students considered the rape as a failure by Stanford, so the campus was a reasonable site on that count, too.

We can make sure his crimes don't get overshadowed/forgotten because of the mass shootings in Orlando. Tragic as they are, this is criminal behavior too and can't be overlooked. Keep discussing this case. Keep it in the forefront of the news and public debate.

Yet they were disingenuous about his making the Olympic team according to someone that knew his abilities. His chances of even qualifying were very slim, he wasn't a fast swimmer.
Brock Turner is a legend in his own mind, he probably thought he was gonna be the next Michael Phelps, Hah!

He did. He already thought he was important enough to take whatever he wanted.

It's sickening to know this was probably not his first rape/SA, and I wonder if, or how many, of his ex-girlfriends have been victims of abuse.

Yet they were disingenuous about his making the Olympic team according to someone that knew his abilities. His chances of even qualifying were very slim, he wasn't a fast swimmer.

BBM - Having been a swimmer (medicore), I checked Brock's racing times. He definitely was a fast swimmer, but not quite on the elite Olympic level. There's fast and then there's f-a-s-t.

"Absolutely shocked and appalled" -- that's the reaction of a juror in the Brock Turner sexual-assault case to the sentence handed down by Judge Aaron Persky on June 2. The male juror, speaking publicly for the first time, delivered a cutting letter to Persky on Saturday stating, "This punishment does not fit the crime."

This juror in the case of the former Stanford University student-athlete, who was found guilty on March 30 of three felony sexual-assault charges, provided the letter to the Palo Alto Weekly. He has requested to remain anonymous to protect his privacy. The Weekly met with the juror on Sunday to confirm his identity as a juror on the case by inspecting his court-issued attendance certificate. He is the only one of the 12 jurors to make a public statement about the case.

"After the guilty verdict I expected that this case would serve as a very strong deterrent to on-campus assaults, but with the ridiculously lenient sentence that Brock Turner received, I am afraid that it makes a mockery of the whole trial and the ability of the justice system to protect victims of assault and rape," the juror wrote to Persky. "Clearly there are few to no consequences for a rapist even if they are caught in the act of assaulting a defenseless, unconscious person."

The juror told the Weekly in an interview that he was surprised by Persky's sentence — six months in county jail (which could be reduced to three under normal county practices) and three years' probation — and considered it an affront to the jury.

It's a great letter, unfortunately the comments by trolls underneath spoil the letter. They are implying the juror didn't write original phrasing, that he copied and pasted certain phrases, of which there is no proof. The juror is a brand new US citizen, we don't know what his command of English is, but his writing appears to be very good. Also, there are other trolls who feel that since Brock has to register as a Sex Offender he shouldn't have to do any jail time. GRRRR!!

LinasK, I know what you mean about trolls commenting on the news articles! I'm following the Cosby case, and there is group of eight Cosby supporters (some are "sock puppets") who constantly barrage-troll the comment section of articles. They are always giving each other high fives for their twisted logic, and lots of times they are the only ones posting! It's just part of the internet culture, I guess.
 
Plus, she was out for over three hours. The police report indicates that they tried rouse her from 1:30 am until 4:30 am, before they were able to wake her.

Does anybody know if they would find Ambien (or similar sleep med) or even look for it when they do a tox screen?

I read that Daily Mail article when it first appeared. Most of the time, Daily Mail is not the original author of their articles. In this case, the source for their piece is Intouch Weekly.

My personal experience with InTouch is that it is a publication that is notoriously unreliable and very loosie goosie as far as facts are concerned.

With that said, here is a quote from InTouch:

“The insider explains that the women tried to come forward after learning of his sex crime. There were discussions among some of the women on the team about submitting letters to the judge about their negative experiences with Brock, says the insider, adding that the discussions were suddenly halted and the letters were never filed.

“There were rumblings that the women were pressured by Stanford officials to not do it since they hadn’t witnessed any crime that Brock had committed,” says the insider.

Lisa Lapin, the school’s Associate Vice President for University Communications, insists that, “As private individuals, our students can say what they wish to whom they wish.”

But the insider insists, “The team has been instructed to not discuss Brock Turner publicly or to the media; however, the entire team completely supports the victim and wishes that Brock had gotten a much harsher sentence.”

“PALO ALTO -- The judge who has come under intense fire for handing a light sentence to a former Stanford athlete convicted of sexually assaulting an unconscious intoxicated woman decided late Tuesday to start his vacation three days earlier than expected -- causing the last-minute reassignment Wednesday of a preliminary hearing he was set to handle.

Judge Aaron Persky could not be reached Wednesday for comment about his decision to tack three extra days onto his previously planned weeklong vacation. A spokesman for Santa Clara County Superior Court declined to say why the judge opted Tuesday night to take the rest of the week off.

Persky's early leave comes after District Attorney Jeff Rosen kicked him off a sex case Tuesday involving a male nurse who is accused of assaulting an anesthetized female patient, using a provision of California law that allows any party in a legal action to object to one judge per case without having to state a particular reason.”​

Judge in Stanford rape case often follows sentencing reports

“The AP reviewed court records for 20 criminal cases in which Persky has issued sentences, including all seven trials he presided over, since January 2015.

The probation department issued sentencing recommendations after five jury verdicts of guilty. One defendant was convicted of misdemeanor drunken driving, and the probation department did not make a recommendation. A seventh trial ended in acquittal.

Cheryl Stevens, a lawyer in the Santa Clara county counsel's office, said the probation department is responsible for providing the court "with a neutral recommendation for sentencing of a defendant."

Echoing findings in Turner's probation report, Persky said on June 3 that Turner's youth, character references, lack of a criminal record and, to a lesser extent, the role alcohol played in the assault pointed toward a short jail sentence rather than a longer prison term. Turner also has to register as a sex offender for life.

The sentence, coupled with Turner's father's plea for leniency because his son had already paid "a steep price ... for 20 minutes of action," thrust the case into the national debate over campus sexual assault.

Until getting assigned the Turner case, Persky and his Palo Alto court attracted little outside attention. Compared to the chaotic Hall of Justice 20 miles south in San Jose, the Palo Alto courts quietly handle a steady stream of suburban Silicon Valley crimes that rarely make headlines. But the Turner case changed that. Even before Turner was sentenced, the case drew more attention than any other Persky has handled since arriving in Palo Alto.

Because of the poor state of Santa Clara County's technology, accessing Persky's cases is virtually impossible for the public. The Palo Alto court clerk's office isn't equipped with a computer for public use, and it maintains only Persky's current, daily calendar.


Comment: How is this even possible? The more I read specifically about this case, the more I feel there is something really small townish and insular and “off” about the Court system specifically in Palo Alto. It started for me, with Persky's very 'thin' resume. It's as though everyone has gotten really comfortable in their jobs and no one wants to rock the boat. For instance, Holly O'Neal has publically supported Persky in the Brock Turner case. She is head of the Santa Clara Public Defender's Office since 2012. She has been with the office since1990 (that would be 26 years). She is married to Judge Jaqueline Arroyo, a judge for the Superior Court of Santa Clara County. Prior to becoming a judge, Arroyo was a Prosecutor in the Santa Clara DA's Office. It certainly makes it awkward when one is literally married to the system.

The article looks at some other recent Persky decisions and seems to, imo, focus on "whiteness" (which I don't think is the main problem) and concludes with:


“Then there's the case of Rachel Garcia, a Latina charged with misdemeanor theft who insisted on a trial. During jury selection last week, several potential jurors told Persky they couldn't serve in his courtroom because of the Turner sentence.

Persky dismissed the critics, seated 14 jurors and alternates and started the trial on June 10. It was the first trial he has presided over since Turner's, and it ended abruptly Monday when Persky tossed out the case before giving it to the jury, ruling that the prosecutor had not proved Garcia guilty.

It's the kind of move supporters would characterize as a sign of Persky's strength — rather than letting a weak case go to a jury he intervened.

The district attorney described it as puzzling.

Personally, I am puzzled by all of them.
 
^^Add to that, Persky is a Stanford almuni and an was athlete there. He never should have been assigned the case. Heck, I'm almost sure one of the elimination questions for potential jurors was: Do you have any past or present affiliation with Stanford U?
