Twenty-two recruits with the Los Angeles County Sheriff's Office were injured while on a run when they were struck by a man driving the wrong way, the sheriff's office said.

Five of the recruits were critically hurt and four suffered moderate injuries, Los Angeles County Fire Capt. Sheila Kelliher said at a news conference.

22 LA County sheriff's recruits hit by vehicle during run

A vehicle struck 22 Los Angeles County sheriff's recruits on a training run around dawn Wednesday and five were critically injured, authorities said.
A total of 23 people were injured, including the driver, said Los Angeles County Fire Department spokesperson Capt. Sheila Kelliher.

In addition to the five who were critically injured, there were four with moderate injuries and 14 with minor injuries. The driver was among those with minor injuries, she said.

CHP Capt. Charlie Sampson said the suspect was going southbound on Mills Avenue when he veered into the opposing lanes. The CHP is not releasing the suspect’s name at this stage of the investigation but said he is a Diamond Bar resident.


Authorities confirmed the 22-year-old driver was going the wrong way when the horrific collision occurred. He underwent a sobriety test at the scene and was taken into custody. The results of the sobriety test are unknown, and he also suffered minor injuries in the crash.

Angelica Musick, a girlfriend of one of the victims told FOX 11’s Christina Pascucci the cadets believe the crash may have been intentional because they do not recall the driver using his brakes.

"He just told us the car went straight into them and several of his classmates were severely injured," Musick said. "The driver was still on the accelerator, so he was trying to break the car window just trying to get the driver to stop because he was still just pressing on the gas."

Just horrific! It's been on our local news all morning. Apparently there was no alcohol in the drivers system but I wonder if he was under the influence of drugs at the time of the crash. Either that or it was intentional.
Villanueva said the driver blew a 0.0 on a Breathalyzer test.

Who is the driver?

The driver is a 22-year-old man from Diamond Bar. Authorities did not release any additional information about him Wednesday.

Investigators are looking into his background and have learned his uncle is in law enforcement. They say his initial behavior could suggest he was under the influence. They also said they found marijuana in his vehicle.

Nicholas Joseph Gutierrez, a 22-year-old Diamond Bar resident, was charged with attempted murder on a peace officer with additional charges pending, the Los Angeles County Sheriff's Department said in a statement.


Homicide investigators are continuing to investigate the incident, and no bail has been granted for Gutierrez, authorities said.

Online jail records show Gutierrez is scheduled to appear in court on Friday. It's not immediately known whether Gutierrez has an attorney who can speak on his behalf.

Sheriff's authorities have not yet presented their case against Gutierrez to the Los Angeles County district attorney's office for prosecution and said they expect to do so on Friday.

I came to say I thought this was a matter of driving under the influence, but I have to point out the similarity with Darrell Brooks Jr. — and the fact that Brooks was sentenced yesterday. I checked Brooks’ speed and he also reached 30mph. For some reason I thought it would be faster if it were intentional. MOO

Investigators "have developed probable cause to believe it was intentional," Sheriff Alex Villanueva said in an interview with NewsNation on Thursday.

"They went through an exhaustive interview process with everyone involved, with the video surveillance, the statements from the recruits, the physical evidence they have and what they got from the suspect himself, and they were able to form the opinion this was a deliberate act," he told the news station.

In fact there were indications the driver may have sped up shortly before the collision, Villanueva said.

"Some recruits are saying they heard the car accelerating, they estimate around 30 to 40 miles per hour," the sheriff said. "You can see how little reaction time that allows someone."

Deplorable. The dates are grossly coincidental. I’m absolutely disgusted by that and am not sure what else to say.

Jail records show that Nicholas Joseph Gutierrez was released at 9:49 p.m. and that his initial arrest Wednesday has been deemed a detention. The records cite California Penal Code 849(b)(1), which authorizes police to release arrestees from custody without first being arraigned if there are insufficient grounds to make a criminal complaint.

  • According to L.A. County online jail records, Nicholas Joseph Gutierrez was released at 9:49 p.m. and no bail was llsted.
  • Sheriff's officials told the L.A. Times that investigators are "continuing to develop the case against Gutierrez but are not legally allowed to hold a suspect in custody for more than 48 hours without presenting the case to prosecutors."

Of course, Darrell Brooks Jr., was in court the same day for driving his SUV into a Christmas parade last year in Wisconsin.

So he was freed on a bond? Is this like a signature bond (basically just you paper you sign saying you will come back to court) or what does that mean exactly? I’ve never been to court in California, luckily, so I’m not familiar with that phrasing.
