While the accused child molester remains out of custody on bail, Velasquez is still behind bars with no bail. The UFC fighter is charged with attempting to kill Harry Goularte in February during a wild 100-mph chase and shooting on Highway 101 in Morgan Hill and San Jose.

In court documents, Harry Goularte is described as a “predatory pedophile” who molested the 4-year-old boy “hundreds of times” inside one of the daycare’s bathrooms. He was arrested after Velasquez reported the suspected sex abuse to police."

A Santa Clara County (Calif.) judge granted the former UFC heavyweight champion bail Tuesday after a pre-trial hearing that stretched nearly 13 hours over the course of two days.

“This incident is extremely serious but appears to be isolated behavior by Mr. Velasquez,” Judge Arthur Bocanegra said. “There is also a viable heat of passion defense.”
 
Can't say I agree with the prosecutor's office if they argued for no bail way back at the arraignment. Probably Velasquez was still scary angry at that point.
 

A lot of people champion his revenge, which is somewhat understandable, but we have to remember that someone else was injured in this revenge run and a lot of others put at risk with this chase. If an accident had occurred costing life or injury would we write that off as just a cost of revenge too? It just completely reckless all the way around.
 

During the hearing, Hessling and Santa Clara County assistant district attorney Aaron French agreed on a March 8 date for the next appearance, which is where a trial date will be determined.
 

The decision to go to trial was made by Judge Javier Alcala after a full day in Santa Clara County (Calif.) court in which Cain Jr., his mother and Cain Sr.’s wife, Michelle Velasquez, and Goularte’s mother, Patricia Bender, testified in court. Goularte is due back in court for a trial setting March 13.
 

After multiple continuations delayed date setting, Velasquez and his defense attorney Renee Hessling appeared in Santa Clara County (Calif.) court Wednesday where Judge Panteha Saban granted their request to move the hearing once again – this time, to Aug. 2. The request was met with no objection from the district attorney’s office.
 

The man who allegedly sexually assaulted the young son of former UFC heavyweight champion Cain Velasquez won’t go to trial until September at the earliest.

Harry Goularte appeared virtually in Santa Clara County (Calif.) court Wednesday. Presiding Judge Daniel T. Nishigaya granted his trial-setting hearing be continued until Aug. 30. Goularte has pleaded not guilty to one felony count of lewd acts with a child after he was accused of inappropriately touching the then-4-year-old boy at a daycare center.

MMA fighter Cain Velasquez, 41, is tentatively set to start trial next year for allegedly trying to murder the man charged with molesting his young son.

Judge Daniel Nishigaya of the Santa Clara Superior Court in Californiagave the defense more time to settle on a precise date, but only as long as he would decide at a hearing set for Dec. 6, according to MMA Fighting.

“I am willing to give this another setting date with the understanding that I will be intending to set a trial date in the middle to later part of January on Dec. 6,” he reportedly told them. [...]
