Judge denies motions before Charles Holifield murder trial – Monterey Herald

SALINAS — Judge Pamela Butler denied a motion Thursday by Charles Holifield’s attorney to remove the possibility of the death penalty from the murder trial, which is set to begin in a little over a month, on the 1998 kidnapping and death of 13-year-old Christina Williams.

Deputy District Attorney Lindsey O’Shea said Butler denied the motion, which the defense filed on grounds the death penalty violated the Eighth Amendment, as well as a separate motion arguing the state’s death penalty statute is unconstitutional. Butler denied another motion arguing that due to Gov. Gavin Newsom’s death penalty moratorium the jury wouldn’t be able to believe a death sentence would be able to be carried out if Holifield were to be found guilty and the death penalty was his sentence.
[.....]
Holifield will return to court Tuesday (9/3) when Butler is expected to make a decision on a motion to suppress a past statement by Holifield. A motion to change the venue of the trial could be brought up as well Tuesday.

Holifield is currently serving a third-strike sentence of 25 years to life in prison for attempted kidnapping and making criminal threats against a woman in September 1998. Holifield also was convicted of sexually assaulting or raping two teenage girls, and he was suspected of raping a third, between 1979 and 1983. All the attacks took place on Fort Ord.

Holifield didn't do it. Look at the Noelani Burleson case, November 23, 1998. The poster pictures in that case match the poster pictrures in the Christina Williams case. Christina and Noelani were the exact same type girls - both had Filipina mothers and Anglo fathers, both looked alike. I have the wanted posters in both cases. E-mail me and I will send them to you. Seen you post on a few places for years, besides the eye witnesses accounts which can be notoriously inaccurate...any other reason why you feel this way? Wonder what prompted Holifields arrest, DNA?
I have no idea if this response reaches you. I live in Monterey, work, grew-up here. Politics are not rational here, politics are ruthless here. 20 years worth of study cannot be explained on this site. Call me if you want to help or know more. Bob Oliver 831 383-2676

The Christina Williams case was high profile. When the remains were tested DNA findings were never made public. There either were DNA and it was not made public or there was no DNA. However, after 18 years, the government wants you to believe they couldn't locate it but now they did. What I think is that the original testing came up with the same DNA that the original suspects in the Christina Williams and Noelani Burleson cases have. One and the same. Holifields DNA was fabricated or planted and that could cost millions and no one is going to pay for the testing. Holifield didn't do it. Look at the pictures of both sets of suspects. They are the same guys.

I lived a few houses away from her when she disappeared. I will never forget getting a knock on my door from the police and asking me about Christina. I had actually seen her that day with a friend walking. I was a new mom and having this happen really shook me. I can't believe it is taking this long to give the Williams family justice.
I would appreciate it if you contact me. I have the wanted poteres in both cases, Christina Williams, and five months later Noelani Burleson. Its the same guys and there has been a cover-up, no doubt. Bob Oliver 831 383-2676 [email protected]
WANTED 1998 Christina William's murder Suspect comparison pictures

Welcome to this thread Bob Oliver.

You are quite correct on the suspect comparison pictures. I just looked and there is no thread for Norelani Burleson....

I would "think" his defense will bring up these pictures in at least one of his hearings.

Charles Holifield murder trial moved to March 2020 – Monterey Herald

SALINAS — Citing issues with missing or mislabeled documents Tuesday, Judge Pamela Butler pushed back the murder trial of Charles Holifield on the 1998 kidnapping and death of 13-year-old Christina Williams from next month to March of next year.

According to Deputy District Attorney Lindsey O’Shea, an issue arose Aug. 20 when Holifield’s defense attorneys let the prosecution know in an email it was missing about 60,000 pages of documents.
[.....]
In addition to those documents, O’Shea said the Monterey County District Attorney’s Office received an email Tuesday morning from the FBI indicating they were going to send additional documents.
[.....]
Given the time it will take for the person tasked with organizing the documents as well as the time the defense will need to review them, the sides agreed to move the start of the trial to March 2, 2020. In part, because the DA’s Office announced it will pursue the death penalty, O’Shea said the prosecution wants to make sure to do its due diligence before the start of the trial.
[.....]
Holifield will return to court Oct. 17 for rulings on additional motions.

Yeah...moved to March 2020 and then July 2020 and then December 2020 and so on...
They're doing their best to NOT punish this beast
"DA's office announced it will pursue the death penalty"....wow unfortunately California has no real death penalty (Newsom de facto abolished the capital punishment in California).

These are the next 3 court dates for this case! I wish there was a pdf document like there was in Sierra's court orders
