LOS ANGELES -- A federal appeals court on Wednesday upheld the convictions of Erik and Lyle Menendez, two brothers convicted of murdering their parents in their Beverly Hills mansion in 1989.The 9th U.S. Circuit Court of Appeals left intact a 1998 state appellate court ruling upholding the convictions and life-without-parole sentences.

The brothers admitted fatally shooting Jose and Kitty Menendez in the home in August 1989 and were convicted of first-degree murder.

They said they feared their parents were about to kill them to prevent disclosure of the father's sexual molestation of Erik. Prosecutors contended there was no evidence of molestation and said the sons were after their parents' multimillion-dollar estate.

Jurors deadlocked at their first trial, in which separate juries heard the evidence against each defendant and the judge gave jurors the option of manslaughter convictions based on the sons' belief that they were in danger. more at link: http://www.ktvu.com/news/4946247/detail.html

A California parole board has decided that convicted killer Eric Menendez will remain in prison. On Friday, the board will hear the case of his brother Lyle Menendez, who was also convicted in the 1989 murder of their parents.

It's rather obvious where the "sexual abuse" story originated, and the reason for it. They should be ashamed of themselves for damaging their deceased parents' reputations, and for exploiting victims of sexual abuse. Their parents did everything they could to provide opportunity for their sons, and their sons appreciated nothing. All they wanted was easy money, and to appear as big-shots.

What he is saying is irresponsible. He accuses prison staff of illegally providing cell phones to prisoners - meaning the criminals are the victims and staff are the criminals.

He then goes on to complain that the only reason that cell phones are banned is because someone in the prison system wants to profit. At no time does the lawyer (who must adhere to professional ethics) acknowledge that providing cell phones to all criminals in prison violates the rights of non-criminals. That is, criminals with cell phones inside prison will continue to conduct illegal activities outside of prison.

Sadly, many people will hear the celebrity lawyer declare that it's unfair to deprive criminal prisoners of cell phones. They will not think about what he is saying to determine whether it is the right idea, and they may join his chorus in support of his complaints about prisoner conditions. Consideration of consequences sometimes seems to get lost behind the initial emotional outburst about "unfair".
