I think you're right. But, I think this will go quickly. I hope so. IMO.

Court and judge will have to agree to resentence.

Its not guaranteed to happen

I saw that documentary, I had to watch it after taking breaks. It was intense!! Really not sure how I feel about this decision today.

I guess all prisoners are now going to want a documentary in hopes that they can have the same outcome...jmo.

Gascon did talk about disagreement within his office and that it's possible members of his office may appear in court opposing the resetencing

Im of the opinion that if the abuse was real, then the new recommended sentence is appropriate.

Im undecided if they should be paroled immediately. I think by the 50 year mark, they should be released

I imagine it won’t take long, with the differing sides arguing for and against. I believe they will be re-sentenced, immediately eligible for parole, and paroled due to their model behavior in prison and extenuating circumstances. I watched the trial. Leslie Abraham was masterful down to her comforting hand on Erik’s back as she spoke, humanizing him. I still would have voted guilty.

Great decision IMO. Hope the process moves swiftly and all parties can come to an agreement. I personally hope they get released immediately, they’ve already spent 34 years in prison

The difference is that the Menendez brothers killed their abusers, not random or innocent people.

Okay, they're hoping to bring it before the judge in 30 to 45 days, is that what was said? That's still pretty quick, all things considered. There is a lot that the court will have to hear that wasn't let in during their second trial, right?

That is the sentence guidelines but this gets adjusted because they were both under the age of 26 meaning they'd be eligible for parole today.

He said he would file the paperwork Friday that recommends that life without the possibility of parole be removed in the brothers' case and that the brothers are re-sentenced for murder. A superior court judge will make the ultimate decision.


Beyond Friday's filing, no timeline or court hearings have been been set.

Gascón said that because the men were younger than 26 when they killed their parents, they would be eligible for parole immediately if a judge follows his resentencing recommendation.

The DA's recommendation for resentencing was not universally backed , he said.

I am so torn over this as a feel like they are getting a lot of press because they are White Good looking guys. You only have to see TikTok videos about them from their girl fan base.

So would this be happening if they were BAME?

They brutally gunned down their parents in the most barbaric of circumstances and they have since admitted the parents were no threat to them that night. But then they have been model prisoners and served over 30 years so I guess they have done their time.
