Although a number of Ayres' medical colleagues have reported seeing Ayres out and about acting and looking perfectly competent within the last two weeks, his lawyer is trying to get him to an "assisted living home" near where Ayres lives... Wouldn't one think that ANY assisted living home would not want a pedophile living in a place where other people's grandchildren are visiting?

The real key here is: why isn't the DA fighting this?

Bear in mind that an attempt to make a complaint in 2008 to the DA's office that Ayres had raped a boy in the late 1970s was made, but the DA didn't do anything about this complaint in 2008.

In 2008, an Ayres victim told two of his closest friends that Ayres had given him alcohol and a drug, and then raped him. He was 13. This was in the late 1970s. He said that Ayres told him, "If you let me do this to you, I will make sure you don't go to juvenile hall. "

The victim is now dead.

The San Mateo County District Attorney’s office has not announced or made a decision regarding the continued prosecution of this case, even though the same six men who testified the summer of 2009 are all ready to take on round two of justice. Unfortunately the issue of competence must be resolved before the criminal trial can be re-heard.

There are rumors that Ayres has been seen out and about town, driving himself hither and yon, enjoying his life free from his crippling dementia. We have obtained convincing evidence that ayres is indeed lucid, displaying functional memory of distant and recent past events, as well as the cognitive ability to understand future events.

This evidence has been provided to the San Mateo County District Attorney, the prosecutor, and other agencies.

We urge victims and their families to contact the DA, THIS WEEKEND and ask them to review the information prior to proceedings THIS MONDAY August 22, 2011. Disturbingly, when the San Mateo prosecutor Melissa Mckowan was contacted on Thursday, August 18, 2011 and told that evidence had been obtained that showed that Ayres was mentally competent to stand trial, instead of being happy and saying "Great let's see it, let's get this child molester put away," her response was " I still think he's mentally incompetent."

Even weirder:the conflicting messages coming from Mckowan and her boss District Attorney Steve Wagstaffe in the last two weeks on whether there was going to be a retrial for Ayres' mental competency.

On Monday August 8, 2011, Mckowan told a relative of an Ayres victim, "No jury will ever find Ayres to be competent." She stated that Napa ( a mental hospital in California) would not be a suitable place for Ayres because his "dementia" (her word, not ours) would "not get better there". She stated that Ayres' lawyer was looking for some nice rest homes for Ayres instead of a retrial for the mental competency.

A government official was alerted to Mckowan's inexplicable statements, and this concerned government official called District Attorney Steve Wagstaffe on Tuesday August 16, 2011. The official asked Wagstaffe about Mckowan's statements.

Wagstaffe said that Mckowan's statements were wrong - that there were only two options for Ayres on the table:"Either Napa or a retrial." Wagstaffe gave this public official his word on this.

But then JUST TWO DAYS LATER, on August 18, 2011, when a lawyer who had obtained the evidence that Ayres was mentally competent to stand trial called Mckowan, she told him that they "were going to drop charges against Ayres on August 22 because Ayres had dementia." She made no mention of Napa.

So then on Friday, August 19, the same concerned government official calls Wagstaffe back and Wagstaffe says "No, it's going to be NAPA."

The mental hospital option makes no sense, as overwhelming evidence has been obtained that Ayres is competent to stand trial. The DA should be using the evidence as a negotiating chip with Ayres' lawyer and say, "Ok, your client is competent. We're going straight to trial."

There's not a chance in hell that the fully competent Ayres would EVER agree to being locked up in a state hospital.

Can anyone explain here why once again Wagstaffe is giving one version of events to the public, while his prosecutor tells a completely different one?

This DA's office - aside from being full of BS- does not want the Ayres trial to go forward.

Citizens have filed complaints with the California Attorney General's office on the San Mateo DA's mishandling of the Ayres case. They are asking that there be a change of venue immediately.

This is beyond outrageous. Even if McKowan and Wagstaffe arent committed to a moral compass that would require them to pursue justice on behalf of the many tortured victims of Ayres, they are REQUIRED to protect the public from someone as allegedly prolific as this man.

The Ayres blog has just posted the videos of Ayres under surveillance by a private investigator this week as well as transcripts of his conversation with his wife and two men at a Vietnamese restaurant in San Francisco. When you see the video and read the transcript, there will be no doubt in your mind that Ayres is competent to stand trial. But the San Mateo DA's office is still fighting it. Here are some highlights from the private investigators' report who were tailing Ayres heard on Thursday, August 18, 2011:

Ayres states that he has to “go to court on Monday.”

“The trio also discussed politics, the recent straw poles in Iowa and the current state of the Republican Party.”

“Ayres talked about joint pain, weight loss (“I’m down to 200 lbs. now” )…”

“Both men spoke about the effects of Alzheimer’s and the unidentified man said that its only benefit was that “you can mention it in front of the lawyers ‘case it’s serving a purpose” which was greeted by laughter from all seated at the table.”

“There were teenagers standing there with their pants down mooning some cars that were passing by the crowd.”

“One of my patients in the past’s father had traumatized him before he got onto a school bus”

Ok, let's see if everyone can keep this straight:

- At the end of June, 2011. after the mental competency mistrial, prosecutor Mckowan told the mother of the victim that there would be no retrial; that no jury would find Ayres to be competent; that they wouldn't send him to Napa (state hospital.)

- On August 8, 2011, Mckowan reiterated to the relative of an in-statute victim that "No jury would find Ayres to be competent"; that they would not send Ayres to Napa as his "dementia" wouldn't improve; and that his lawyer was looking for some cushy rest homes for him.

- A few days later, a mother of an Ayres victim met with a San Mateo government official and told him what Mckowan had said about no jury finding Ayres to be competent, and that they wouldn't send him to Napa, a place for the mentally ill.

- The public official who was very concerned, then called District Attorney Steve Wagstaffe on August 16, 2011 and asked him about Mckowan's remarks.
Wagstaffe stated that Mckowan was "wrong" that no jury would find him to be competent and about Napa, and he gave the government official his word that there were only two options on the table: Napa or a retrial." The government official asked Wagstaffe to give him his word on this. Wagstaffe did.

However, just TWO DAYS LATER, a lawyer representing an in-statute victim called Mckowan and asked her what was going on with the Ayres case. She stated that "Ayres had dementia and we are dropping the case. " The lawyer stated that an investigator had collected evidence that Ayres was competent.

Mckowan replied " I don't believe Ayres is competent. We're dropping the case on Monday August 22 because Ayres has dementia"

Huh? What prosecutor in their right mind wouldn't jump at the chance to look at evidence that a molester who raped young boys was competent? Not Mckowan. She stopped taking the lawyer's calls.

Then on Friday August 19, the lawyer got hold of Wagstaffe who gave yet another story about Ayres. He told him that he was going to Napa!!

A mother of an Ayres victim called DA Steve Wagstaffe today after seeing the surveillance video on Ayres. Here are excerpts from her description of the conversation:

I called Wagstaffe today and got a return call about 10 muinutes later.
He talks faster than a machine gun, and I will try to relate here everything of importance.

He said that he looked at the videos and read the transcript, and that the overwhelming,
dramatic evidence we needed was a video tape of Ayres driving a car. He would
have gone back and retried him for that. He also mentioned seeing him without a walker
would have helped.

He was very disturbed about McKowan telling people that Ayres would never go to Napa. He
said he never knew that, and if that's the case it's a serious violation.
He also said that delays weakened the
trial, and Melissa was very frustrated after the trial.

We talked about re-trial, and he said because of the 8-4 verdict on the competency trial, he could
not justify a repeat since he has an obligation to the taxpayers against spending more money on
a subsequent trial that can't be won.


Here is the official plan for Monday: The DA's office will argue for committment to Napa
State Hospital, and only Napa. They will not agree to any other hospital. He said the presiding
judge is conservative, and the defense attorney agrees with Napa. He could be sent there for a
minimum of 180 days, or up to whatever the judge feels is fair. However, here is the kicker,
there will be a 4 to 6 week planning report on the decision before a committment. He said he will
talk to the press and tell them his decision.

While Wagstaffe told the mother of a victim today that they would never win a retrial and that the cost would not be justified to the taxpayers then why did he tell a San Mateo Supervisor on August 16, 2011, just four days earlier that there were only two options:"Napa or a retrial."

As it was the prosecutor who bungled the first criminal trial and the competency retrial, we would argue that the DA's office owes it to the tax payers to try again.

But come to think of it, no. It needs to be taken over by the Attorney General's office.

If Wagstaffe thought that driving a car was such an important indicator of competency, then why didn't Wagstaffe tell the San Mateo Deputy Police Chief to act on those tips that came in to him on August 11, 2011, stating that doctors in Ayres' old office building at 215 N. San Mateo Drive had seen him driving a car?

The police never responded to those tips. But friends and relatives of victims on their own, knocked on the doctors' doors themselves.

How arrogant of Wagstaffe to sit there and say"Not good enough evidence." Not a pat on the back for the poor families who scraped their money together for an investigator.

Shame on his office for such a cold unfeeling attitude towards victims

WAKE UP SAN MATEO!!! Locals, do you really believe that the handling of this case is in your best interest? Where will it end? Ayres dodges a bullet, and then what prolific (imo) perp willbe next to get a pass?
