I beg to differ. She looked absolutely defeated and scared in the court appearance today. I truely believe he told her they wouldn’t get caught or tried because he got away with the last child. I hope I’m not wrong but I def saw real emotion in her at the hearing today
Defeated and scared for Emmanuel or for herself with a prison sentence of life above her head.

Honestly had to look it up myself, and I remain confused. 🤣 I’m in California, but they didn’t teach us California criminal law.

So what I can tell you based on what I found is that the section you’ve quoted there isn’t the crime of first degree murder, but rather the crime of murder in general. It is section 189 that defines whether a crime meeting the definition of murder is first degree or second degree. First degree murder is murder that meets any of the criteria outlined in that section (of which there are several). Second degree murder is defined as all other murders. So, “murder with malice” doesn’t seem to be a lower charge from first degree murder, it’s just an umbrella charge.

What I don’t know is what this would look like in those jail records that have been posted. You can see that both RH and JH have charges for violating 187. The one that specifies first degree murder for Rebecca still just references 187, not 189(a).

I think we need to see the criminal complaint to know for sure what degree of murder they’re each charged with. Does anyone have the PDF? There’s no copyright issue with those so we should be able to copy them here in full.
Thank you! Glad to have expertise on the thread.

Charges can sometimes be confusing, but we learn as we go.

Bottomline: they are behind bars forever, imo.

Rebecca Haro was spotted at the same store days before the kidnapping report, allegedly asking management if there were exterior security cameras because her car had been burglarized in the parking lot, according to KTLA.

he's playacting like he hates her for what she did by ignoring her in court
snipped

100% agree. He is looking out for himself ONLY while she probably thinks they are a team.

Hours later, the Haros made their first court appearance in the case at the Riverside County Hall of Justice. They were placed almost as far apart as possible — Rebecca Haro sitting in the jury box in a blue jail jumpsuit, and Jake Haro sitting in a red jail jumpsuit, indicating he’s in a protected population, near the incarcerated defendants’ entrance.

The sistem protected him. But no one protected Emmanuel.

If she's a victim of domestic violence she's liable to be terrified of him.
I'm guessing he won't be too comfortable in prison when the other inmates know what he did to that poor baby boy. This is of course if he's found guilty of murder.
Chances are they both end up going protective custody because of how high profile this case has become

Apparently, JH told LE that he rolled over Emmanuel in bed, killing him by accident, and then buried him. That's what sparked the search. LE now believes that was a LIE.

Then LE apparently inserted a fake inmate into the jail and JH confessed to him that he killed Emmanuel and put him in a trash can at home.

Meanwhile, RH is sticking to the kidnapping story.

I'm not even sure what to say about this. Are they that slow that they would actually think this wouldn't come out eventually? Or were they that confident or arrogant that they would think imthis whole kidnapping story would work? At least we know why they chose this place to say where it "happened" at

Liars convince themselves of their own lies

He's going to flood the investigation with lie after lie after lie. And she is going to stick to one lie. imo

And I think both approaches will work against them at trial. The jury will see the lies for what they are - efforts to make sure the body is never found.

I suspect the body was so abused before/after death they have a primal instinct to be ashamed. And I also suspect they hope that no body = no murder. imo

They will be convicted, imo.
