Outside the courtroom, Kaloyanides answered questions by news media gathered for his client’s arraignment. Kaloyanides said Lee’s arrest on Aug. 17 in Anchorage, Alaska, came as a surprise to him and his client.

This guy is either a moron, or a rookie (or both).

Maybe Chris should reconsider his choice of attorney, I don't want this being appealed on the basis of ineffective assistance of counsel.

BBM. CL had to know this was coming or was afraid that he would be arrested for EC's murder. This is not the type of attorney that you would usually hire for a charge of having a potato gun.

Why hire a federal attorney, for a state charge?

BBM No, he probably has not seen it. The open access court data indicates the September 16th hearing will be a TRC(trial readiness conference), the first of which is usually the point where discovery is passed back and forth. (California is a reciprocal discovery state, thank you "Law & Order", so the defense must hand over it's discovery to the prosecution as well as the prosecution having to do so) So all of the state's evidence so far will then be in the defense lawyer's hands at that point. Probably no sooner.

Your post peaked my interest so I went on a Google search & found this info about what the defense has to hand over.

Here are partial examples of the kinds of information defendants routinely must disclose:
•California.
Defendants must disclose to prosecutors:
•the names and addresses of all people other than themselves whom they plan to call as witnesses
•any relevant statements by any of these witnesses
•any experts’ reports, and
•any “real” evidence (tangible objects) that the defense intends to offer into evidence. (California Penal Code § 1054.3.)

I'm glad NL wasn't there, but JC and JC's father were!

Can you imagine the tension in that room if all three would have been there? And the icing on the cake would have been IM showing up with NL.

The attorney said it will take a long time for Lee to be brought to trial, especially because of the special circumstances charge; will need time to evaluate the evidence and prepare, Kaloyanides said.

A preliminary hearing is set for Sept. 16, where prosecutor Sean Daugherty will present some of his evidence and the judge will decide whether there is cause to go forward with the trial.

Kaloyanides said Lee first hired him when the former U.S. corporal was arrested with a potato gun. Asked if he thought that arrest was investigators’ way of holding the murder suspect, Kaloyanides replied, “Let me put it this way: I’ve never heard of anyone being arrested for having a potato gun before.”

BBM: It might have been a surprise for the attorney but I would bet my last dollar CL has been looking over his shoulder since June 28th. What a freaking LIAR! OMG he gets dumber and dumber by the day or does he think we get dumber and dumber and we'll actually believe his lies. Gawd he makes me sick! :maddening:

Two things I wanted to hear thoughts on ...

Why hasn't the DA's office followed through on his promise to the media to give them a media statement on Erin's pregnancy? It was supposed to be later that day, or the following day (I'll look it up).

I'm going to assume that Chris, nor anyone in his family has the money to pay for his defense. How would that scenario play out? Would he eventually be appointed a public defender, or can Kaloyanides represent him at a PD rate?

I think they'd wait just to give the family time to get their bearings. Maybe they have privately given it to the family........but I'd be totally devastated if what I thought was my child or grandchild was actually the child of the person who murdered my loved one.
That would be incredibly tough.

I don't know. Do they have to file the extra charge by a certain time? I am beginning to think she was not pregnant. She might have thought she was. Perhaps she got a false positive on a test or something. I just feel if she were, they would have said so by now. I could be wrong, though. MOO

Speaking of rants, how long can it possibly take to get an autopsy done?? I've been checking this thing for days now. http://cms.sbcounty.gov/sheriff/MediaCenter/CoronerPressReleases.aspx it's insane. Been over a week now, they should at least have something. I don't get this attitude, it's like their own little club or something where only they get to know what's going on. They still haven't put back those scanner files, even though the cat is out of the bag on the whole Chris Lee is their suspect thing. Don't get me wrong thye did a great job of finding her and bringing her home, but they were assisted by the public and I think they would have more respect for that. We don't need to know everything, most wouldn't want to, but why keep us in the dark, with nothing?? sorry for MY rant. :)

Just an FYI...

Yes, the autopsy is done but there is a very real possibility of the county not releasing the results of the exam pending toxicology and/or DNA analysis. Both of those items can take weeks to get the results back. Its is not the responsibility of the Sheriff's department to share every aspect of the case with the public. They have every right to withhold that information from the public (put under seal) if it will be detrimental to the district attorneys case. The only people that they are required to share with is the defense attorney and the court.
