Yes, Nichole is a sneaky one who is going to find out she is not as slick as she thinks!!!

Both Daugherty and Kaloyanides were visibly dismayed at hearing this. Both attorneys asked the judge if he would call in the juror Nichole was seen chatting with, and ask what the two women were discussing.

The juror was called in and Judge Mazurek asked her about the topic of the conversation she had with the blond woman outside. Nichole's name was not used. The juror said she had complemented Nichole on her shoes, and Nichole was talking about where she got them. That was it, according to the juror.

Just a side note: all of the jurors wear yellow buttons on their shirts that indicate they are jurors, so it's hard to imagine Nichole didn't know she was speaking to a member of the panel deciding her husband's fate. As Kaloyanides said in open court of Nichole,

"This witness is unpredictable, and I'm not sure (the interaction) was benign."

Why was Nichole in court with her attorney today? The defense is not up to bat yet? Testifying against his advice, interesting.
I flash back to what she told Megli. SHE is so smart, she kept her story straight but Chris didn't ...
I don't think Nichole was physically involved with Erin's murder. But I've strongly felt she was involved in the cover-up, maybe even the planning.
Smiling in court, while your husband is charged with murder? I wonder if she is a narcissist?

So NL wanted to testify for the Prosecution and they didn't call her.

She is still under subpoena for the defense as they might call her.

Other than wearing CL dog tags i can't tell whose side she is on.

Doesn't sound like the def can tell either.

As Kaloyanides said in open court of Nichole,

"This witness is unpredictable, and I'm not sure (the interaction) was benign."

On another issue: I think the reason we are not seeing any tweets during trial. I don't think the Judge allows them during trial. They have to wait til break or lunch etc. IMO I could be wrong

They have no defense so for sure someone is going under.

If she helped with planning then she is an accomplice to murder as CL had it all planned out beforehand. It was only after the fact that he messed up with the lying, evidence in the vehicle etc. Which she refers to keeping his story straight.

Maybe the state will get a twofer in the end.

Just have to wait and see I guess.

I wonder if part of that today was NL wanting to be in the courtroom and since the DA subpoenaed her she has to say out of courtroom. The judge telling her the def still wants to call her so she is still under subpoena.

Bet both sides want her out of the courtroom for different reasons.

Maybe when Joe Nelson puts his article up we can glean additional info.

Nuts I tell ya. I'll probably quit shaking my head around midnight.

Still doesn't explain why she was in the courtroom today, because if she is under subpoena she can't attend until afters she testifies. So what the heck?

So my guess about it being her outfit that made her presence notable wasn't too far off. :eek:

I don't think the defense is going to try to put any of the blame on Nichole at all but I could be wrong.

Whatever the case may be, that isn't enough to prove that Erin thought she was going to the place where she was eventually found. And she thought Chris wanted to go hunting. What's he gonna hunt out there, a tumbleweed?

Apparently, he was hunting pregnant mistresses...

I am not sure she helped with the planning. But I think she mifght have been the trigger. I am wondering if, after she found out, she demanded he 'do something about' the baby on the way. She doesn't seem like the type of wife that would allow him to have another baby w/someone else coming into the family.

I agree, I think there is something missing to what happened today. It was before court started.

It sounds to me like the DA subpoenaed her and then is not going to call her so she thinks she should be allowed in the courtroom, like she was released from the subpoena. The judge advises her the def plans to call her so she is still under subpoena and won't be allowed in the courtroom until after she testifies for the def. she got mad went out of courtroom and got loud enough that she could be heard in the courtroom.

Reading what Beth wrote it's the only thing that makes sense to me. But I could be wrong.

I guess my question would be how does/did she know the DA was not going to call her if that's what happened they are not finished yet.

Court was scheduled to begin at 10 a.m., or "ten-ish" as presiding Judge J. David Mazurek likes to say. Before the jury was allowed in, Nichole Lee, the wife of the defendant, made an appearance in the courtroom. She was with her attorney, who said his client wanted to testify "over my advice." Judge Mazurek told Nichole that while she had been subpoenaed to testify by the prosecution, ADA Daugherty declined to call her. However, defense attorney David Kaloyanides did want Nichole to testify for the defense, and so she was still under subpoena. She had a smile on her face the entire time she stood before the court.

Cut to a few minutes later, after Nichole had left the courtroom. The sound of a woman's voice, raised and angry, could be heard coming from outside the courtroom. I turned around to see Nichole Lee in the vestibule that separates the courtroom and the hallway where the jurors wait to be called in. The bailiff approached the judge and told him he caught Nichole Lee talking to one of the jurors.

Why she was smiling I have no idea, surely nothing to be smiling about.

That's my take on it.

After her outburst today I honestly don't know what to think about her. At this point I guess I'm thinking anything is possible.

I believe CL planned the murder either when he was out there the weekend of the 22nd, or when he came back from that trip. I believe the purpose of the trip was to find a place in the middle of no where to do it.

Did NL know that Erin was pregnant could be but I doubt that he told her. They were set to leave for Alaska pretty soon iirc. NL would be away from it all. She had known since Feb/March about the affair and managed to keep it together living right next door. Or did she? I don't know.

Then you have to take the things she said after Erin went missing and it sounds like she at a min knew after the fact and tried to help cover it up. She and him sure wasn't very good at that with leaving all the evidence in the car. Lying about things they knew would come out. Saying incriminating things to others like IM.

I don't know. I just hope that CL is convicted and if she is involved the truth comes out and she goes away too.

Ok, thanks for explaining. I guess the key is as you said, how are they notified they will be called to testify. The DA subpoenaed her, but decided not to call her to testify.

Surely her attorney is clued in though. He probably contacted the DA and knew the above. So she came to court anyway to say she wanted testify for the prosecution regardless? Or was it that she wanted to attend the trial in advance of her appearing for the defense? I'm thick headed tonight I guess, lol. Maybe the bloggers part two will shed light on the lovely Nicholes appearance in court today.

I am not reading it the same as you. She was happy in court. I think she left with a smile on her face, got caught by the bailiff when she was talking to the juror, he said something to her or asked her to stop or what have you and then she got mad? Either way, I hope Part 2 is very specific, detailed and lengthy.

The thing that stands out to me is that there was purported yelling/arguing, but the juror simply told the judge that she complimented Nichole on her shoes...
