L.A. County trying to block return of social worker in Palmdale child abuse death

LOS ANGELES – The Los Angeles County Department of Children and Family Services is reportedly going to court in an effort to block the return of a social worker who supervised the case of Gabriel Fernandez, the 8-year-old Palmdale boy who was beaten to death.

Gregory Merritt was fired over the case. But he successfully appealed his dismissal to the five-member Los Angeles County Civil Service Commission, which voted unanimously to reinstate him, imposing a 30-day suspension instead of termination.

County departments usually abide by the commission’s findings, but Philip Browning, the county’s child welfare chief, said Tuesday he is taking the matter to court after determining that Merritt had “egregiously” missed multiple opportunities to save Gabriel, the Los Angeles Times reported.

The Los Angeles County district attorney’s office will seek the death penalty against a mother and her boyfriend, who are accused of torturing her 8-year-old son to death, prosecutors announced Wednesday.

Aguirre was in present, but Fernandez was not in court Wednesday as Deputy District Attorney Jon Hatami made the announcement that the District Attorney’s Office is “going to seek the death penalty as to both defendants in this case.”

Fernandez and Aguirre are due back in a downtown Los Angeles courtroom July 14 for a pretrial hearing.charged with capital murder in the beating death of the woman’s 8-year-old son.

I saw this report on the local news last night. I almost threw my dinner plate at the tv screen. They said that Gabe's teachers had filed SIXTY ABUSE REPORTS with CPS!!!!!!! :furious:

His teacher and principal filed over 60 reports of abuse, many which included pictures of bruises and burns---BUT HE WAS NEVER REMOVED FROM THAT HELL HOLE!

If anyone deserves the DP these two monsters that killed him do. But I wish some of those workers that ignored the 60 abuse reports would be charged with something too.

The whole story makes me sick to my stomach. The DCFS failed this angel big time! It's unbelievable that this sweet child was left with these monster!
I keep up on the story and keep posting even though there is no traffic here, just to give Gabriel a voice. I know many don't want to know the details of the horrible things that were done to him, but it's all out there to read. Such a darling little one. Thanks for the reply katydid.

Next court date is July 14th.

There was a long in-depth report on the local KTLA news. At least they are reporting on it. And they showed lots of pictures of his sweet face.

I know what you mean. I think that's what keeps people from reading and posting about Gabriel. His story just rips ones heart to shreds. At time I wish I had never read the details. I am trying to wait patiently to see justice done, but it's not easy.

There is a pre-trial court date on Nov 5th at 8:00 am at the courthouse in downtown L.A. I'm having trouble finding information about what will be happening, but I hope it means we will be moving forward soon. I'll post more if I get anymore info. Justice is coming Gabriel!!

Today's hearing seems to have been mostly about turning over some evidence which included some school emails and welfare documents. The judge also granted a protection order for Gabriel's siblings. Apparently, when DCSF terminated Pearl's parental rights, they sent her paperwork that included the siblings address. Sheesh!

The next pretrial hearing is Feb. 10th 2016. The trial should begin within 90 days of that hearing. I got this information off of the Gabriel's Justice facebook page and so far it's the only information I can find. It's strange that everyone locally rallied around this sweet little boy who was so sickeningly abused and murdered at first, but now I can't even find a MSM article to keep me updated. :(

I'm not going anywhere little one. :rose:

today I was scrolling through "new posts" and saw Gabriel's page. I never read about him in the past. I clicked on his name mostly because of my own sweet little boy. I almost wish I hadn't. What hell this sweet little innocent boy went through!!!!!!!!!!!!! 60 reported calls by the teacher and nothing done. I feel badly for the family members (grandparents?) that raised him and had to give him back to the egg donor.

Why is trial taking so long? I just don't understand that part of our justice system.

I wish someone would "take care" of these two scumbags in prison.

I agree. There is a point where it goes beyond "money" issues and becomes blatant neglect. When no one else is there, CPS is supposed to be there and they failed Gabriel miserably.
