GUILTY CA - Gabriel Fernandez, 8, tortured to death, Palmdale, 22 May 2013

 • #421
Considering it's in California for DP.... well, he and she will live a long time before being executed, unfortunately. But I like your idea Dogface about pictures in their cells.... should be mandatory for ALL murders....

LWOP is harsher conditions in this state.

Watching this video brought tears to my eyes, again, for Gabriel. I hope these two receive a harsh punishment for what they have done to this beautiful child.

Sometimes articles get bumped for new ones. You might need to type Gabriel's name in the search bar.
I looked and read the article. :( Guess it was mainly for a little boy who was fully at the mercy of monsters.
If I could speak to this boy-- I'd tell him.. " I KNOW what they did to you."

I think some people (who might defend some abusers) NEED to see the photo of what the child looked like after -- not before, when he was healthy and smiling.

There was a case some years back-- where a young man-- the boyfriend of the babies' mom -- killed the infant or toddler.
As he was being led from the courtroom after being convicted and sentenced--- various relatives and friends of this young man were calling out support to him.
My jaw practically dropped.
Why.

Sometimes a picture can change minds about the punishment needed for the perps.
Although as soon as I read about this case , my .02 was that both of these beasts fully deserve the DP.
Even without the photo being released.

I believe he lived with his grandparents up until his "mother", Pearl --regained custody of him.
8 months later little Gabriel was dead.

Rest gently, sweet Gabriel !
No one will ever harm you again.

I couldn't agree more!

I imagine there are legal hoops they need to jump through, but I can't imagine it will take very long. At least I hope not.

-Hundreds of blood stains and indentation marks were on the walls - so many that she ran out of evidence stickers to mark them.

-Shew did DNA tests on items in the home with blood on them...including a wooden club, a black bat and a data cord.

-Gabriel's DNA was also found inside the cabinet prosecutors say the boy was locked in for hours with no food or water or access to bathroom, bound and gagged.

-Another witness, now-retired criminalist Stephan Schliebe, said he compared the contents of Gabriel's stomach to a cat litter sample. The material was so similar he could not tell them apart, he said.

-Another expert found a fake doctor's note to take the boy out of school that had apparently been typed in the apartment.

The mother is having a competency hearing soon. Defense is saying her IQ is low.

 • #434
This was premeditated. The child was kept out of school during these beatings.

Aguirre is showing no emotion. This will hurt him.

The first grade teacher for Gabriel Fernandez, a Palmdale boy who authorities say was tortured to death by his mother and her boyfriend, read a note from the 8-year-old she found days after he died.
The letter was written in shaky handwriting and she found it hidden in his desk days after she learned of his brutal death.

"I love you mom and Gabriel is a good boy," the note said.

Garcia said Gabriel confided in her early on in the 2013 school year and told her he was beaten at home. She immediately reported that information to the Department of Children and Family Services.

"'Sometimes my mom makes me bleed,' and I said, 'where do you bleed?' and he says, 'well, on my bottom cause she hits me with a belt.' And he says, 'you know that part with the metal on it? That part,'" Garcia is heard saying during a phone call with DCFS that played for the court.

Over the next few months, Garcia said she saw repeated bruises, burns, wounds and other injuries on the young boy. She said in at least one instance that Gabriel came to school wearing girls' clothes.
