*Sentencing for both (@ 8:30am PT) - CA - Gabriel Fernandez (8) (May 22, 2013) – *Pearl Sinthia Fernandez (29/now 34) “mom” accused of 1st degree murder; plead not guilty. DA seeks DP.
2/15/18: Plead guilty in plea deal in exchange for life in prison; waived all rights to appeal.
(@ 8am PT) for *Isauro Aguirre (32/now 38), BF of Pearl accused of 1st degree murder. Plead not guilty. DA seeks DP. Trial started 10/16/17; found guilty of all charges; jurors recommended he get the death penalty.

At the end of the hearing Thursday, Superior Court Judge George G. Lomeli sentenced Fernandez, 34, to life in prison without parole and Aguirre, 37, to be executed for the 2013 torture killing of Fernandez’s 8-year-old son — abuse that the judge characterized as“horrendous, inhumane and nothing short of evil.” It was the worst abuse he’d seen in nearly 20 years on the bench, he said, telling the defendants he hoped they woke up in the middle of the night plagued by their actions.

“I hope you think about the pain you caused this child and that it tortures you,” Lomeli said. “I rarely say that.”


Lomeli recited trial evidence that stuck with him — the defendants bashing Gabriel’s teeth out with a bat and shooting BB pellets at him. Some might call the abuse “animalistic,” the judge said, but not even animals would do such a thing to their kin.

The judge recounted a story he’d seen on the news about a cat running into a burning home to rescue her kittens. Firefighters tried to stop her, but the cat ran in and out of the home several times. Each time she emerged, she held one of her kittens in her mouth by the scruff of their back. During the last rescue, the judge recounted, the fire singed the mother’s fur and burned her eyes.

“The cat was now blind, but she never let go of that kitten,” Lomeli said, pausing. “No, this is beyond animalistic.”

Several agencies investigated abuse allegations leading up to Gabriel's death. On several occasions, investigators concluded there was no evidence of abuse.

Prosecutors have since filed charges of child abuse and falsifying records against county social workers Stephanie Rodriguez and Patricia Clement and supervisors Kevin Bom and Gregory Merrittfour in Gabriel's death.

Their next hearing is June 26th. The last 2 names are incorrect, they should Kevin Bloom & Gregory Merritt.

I don't think even Gabriel would evn want this, he was an innocent baby but I cant help but wish for it. God forgive me.

Looks like a hearing will be held 8/15 for Patricia Clement & Gregory Merritt. Wondering "why" S. Rodrigues & Kevin Bloom aren't on the court dockets?? Are they NOT being charged??

Charges upheld against L.A. social workers in death of 8-year-old Gabriel Fernandez

A Los Angeles County judge on Thursday denied a motion to dismiss child abuse and other charges against four social workers in the killing of 8-year-old Gabriel Fernandez, concluding that the Palmdale boy’s death had been “foreseeable.”

On Thursday, Lomeli said the social workers had not properly documented the abuse nor the mother’s repeated refusal to attend counseling. The judge said he had reviewed the voluminous case files and noted that the defendants had overruled a scoring system set up to detect danger to children.

The defendants demonstrated “an improper regard for human life” and “a lack of vigilance,” Lomeli said.

I didn't find a next court date in that article, Niner. And it's the only recent article. I tried looking up the court records but they charge a fee. :(
