Hello SDHELPS and TheBestInTheWest ! I cannot believe that a Prosecutor is even suggesting a "road rage" incident and a death penalty in the same hearing. This is clearly two separate incidents involving the same family members and same household. Only committed at two separate locations and two separate vehicles. I understand that we all would like to know the motive. But for the District Attorney to suggest and lean toward random and or road rage is leaning away from a death penalty, IMO.

Curious Me: from what I understand it was a coicidence he got Ilona and Sal. Maybe when he shot Gianni he went through his phone? His phone was never recovered nor was Sal's.

I forgot what families of the victims wanted concerning Justice. Did they want a Death Penalty trial?

After I've followed so many trials, I feel a DP trial sometimes makes it much harder to get a DP conviction. I'm concerned that the families have to go through the further agony of this trial, and then he ends up with a lesser sentence anyways, or a hung jury, or appeals further down the line.

I want what is best for the loved ones seeking Justice. I just wonder if the families would be better off if he was offered a plea deal for life without parole.

Does anyone else here feel it might be risky to go for the Death Penalty in this case and actually get a DP conviction?

My prayers continue to go out for all the loved ones of Sal, Gianni, and Ilona.

Bestinthewest can you please refresh my (our) minds as I believe early on there was mention of "road rage" with Gianni. My apologies as I can't remember if it was public knowledge or something that came out in discussions with the family/LE?

How can this have been something random and maybe road rage? Can't get this off my mind tonight! I'm trying to imagine how the prosecution will present this.

Here's my imagined version:
Mercado is in a car or on a motorcycle, or maybe at the gym, when Gianni, a complete stranger to him, sets off his murderous rage. He follows Gianni, kills him, taking over Gianni's car and phone. For some reason, he decides he has to kill Ilona and Sal too...but why I can't imagine. Later, there's phone messages from Ilona, but she's still working because he somehow knows that and is seen at the mall waiting. Then, Sal comes to pick her up and they're sitting in the car when Mercado takes their lives too. Does he drive away in Gianni's car at that point?

To this day I find it so hard to imagine only one guy did all this, and despite his mental condition, almost managed to not get caught until he made the mistake much later with the silencer in his car.

Please somebody knock me out so I stop thinking about this case tonight.

Thursday is the next hearing date and I pray this is the day the justice system moves forward with a vengeance! IMO I think this will be the day. The visits to the Justice....... FB page has had a lot of visitors in the past two weeks, especially in the last couple days. I will only have very limited internet time during this time. I don't want to seem ungrateful for what we have in this case. However there does seem to be something and more importantly SOMEONE else missing from the case. I can't believe that a kid who when arrested immediately attempted suicide on tylenol had the gonads to plan and execute this crime of coincidence. Three victims in two different cars, two different locations and times yet same family.

IMO, someone(s) is being protected and this person would show the motive.

a doomed miserable one he definitely earned for himself. I wish he'd talk because there's got to be more to these horrible crimes than just some randomness. He acted alone...that is very hard to believe.

Saw him on a court video on the news tonight, but it's not up for linking yet.

Looks like he finally got a haircut, and he grew a mustache.

The news said the Death Penalty Trial should start by January 2017.

Carlo is still on the calendar for this Tuesday and I can only pray that this trial starts moving forward. I think of the kids a lot and of course the families. I can only imagine how difficult this has been on them the past couple years. Praying that justice is right around the corner.

Well, nothing reported through media for today and he no longer shows as being in San Diego Central Jail (perhaps it's just not updated?). The only thing I can find is ANOTHER trial date in October. It seems he has a fairly new defense attorney. I just pray he's not being sent back to Patton for mental health issues. This needs to flipping move forward :gaah:

Had to add that Carlo's defense attorney, Jane Kinsey, also represented one of the defendants in this high profile crime in San Diego...

I know that case and followed it here. This attorney didn't leave any impression on me. All three were depraved and got life with no possibility of parole.

A San Diego man suspected in the mysterious slayings of two brothers and a young woman – which began with a shooting on Christmas Eve 2013 in the parking lot of a mall – will stand trial next year, a judge ruled Tuesday...

The trial of Carlo Mercado, 31, is set to begin April 3, 2017.

Prior to his trial, Mercado is scheduled to appear in court this October for a status conference, a judge said Tuesday

He still does not show as in jail but based on the above it's probably just an update issue.

A heads up that something interesting might have happened and to listen for it on the news tonight. It was a very fast recap.

Darn it, I didn't hear what they were saying on the News8 at 5 p.m. tonight about Mercado, but it was something about him and his cell mate being found in some kind of distressful situation in their cell? I need to wait to hear it again. There's no article to link to yet. They mentioned an April 2017 trial.

All I can find is Mercado and his jail cell mate both had medical emergencies that required hospitalization. "Deputies discovered accused triple murderer Carlo Gallopa Mercado, 31, and convicted killer Abel Angel Martinez, 52, ailing in their quarters at the San Diego Central Jail about 12:30 p.m. Tuesday, sheriff's spokeswoman Jan Caldwell said."

“You cannot blame them for having an initial 'good riddance' reaction,” Gilleon said. “But they also know that Mercado’s family is likewise suffering. My clients have suffered an indescribable horror that they would never wish on someone else's mother, father, sister or brother, no matter how evil the act that brought on this unimaginable tragedy.”
