LOS ANGELES — A detective was about to testify Monday at the trial of a Canadian graphic novelist accused of killing his girlfriend in their Hollywood apartment. Before the testimony started, the prosecutor in the case leaned over and spoke softly to the victim’s mother, sitting in the front row.
“There’s going to be some rattling photos,” she said.
But the mother didn’t leave. Olga Kasian stayed sitting in the muggy Los Angeles courtroom while homicide Sgt. William Cotter described photo after photo of the apartment where Kasian’s 30-year-old daughter Iana was found dead, lying on a blood-stained mattress beneath a Mickey Mouse comforter.
Blake Leibel, the son of wealthy Toronto real estate developer Lorne Leibel, had pleaded not guilty to murder, mayhem and torture in Kasian’s death. She was his girlfriend and the mother of his newborn daughter.
It was the second day of the prosecution’s case, focusing on the brutal state Kasian was found in when police finally managed to get into the couple’s Holloway Drive condo, where Leibel had allegedly barricaded himself on May 26, 2016. Mokayef told jurors in her opening statement that she would prove Leibel planned and calculated Kasian’s murder, following a script he took from one of his own graphic novels....
Leibel didn’t look at any of the photo evidence shown at the front of the courtroom. He sat, slumped on his elbows, staring at the desk in front of him. ...

The prosecution continued trying to answer the question Wednesday, with Bevel, the blood spatter expert, testifying that the apartment Leibel and Kasian shared in West Hollywood showed signs of extensive cleaning. The fact that the bloodied mattress didn’t stain the top sheet meant the blood must have had ample time to dry before the new sheet was put on, with Kasian on top of it.
Investigators sprayed a chemical substance that glows when it comes in contact with blood that has been treated with cleaning products (it reacts to both the metals in the cleaners and the iron in blood).
In photos of the apartment shown to jurors, the apartment floors are streaked with a fluorescent blue – in the dining room and in the hallway, in both the guest and master bedrooms and bathrooms. For Bevel, it was a sign Kasian had been transported throughout....
Close to the end of the day Wednesday, prosecutors showed a photo of a tub in the apartment after it was treated with the blood-detecting chemical. It glowed pale blue, with streaks spilling down the front and to the tile floor – another glimpse at how Iana Kasian died, but not why.

"LOS ANGELES — An entertainment lawyer and friend of Canadian graphic novelist Blake Leibel was thrown out of a Los Angeles courthouse and banned from watching Leibel’s murder trial after he allegedly tailed a juror in his car.
Before the trial resumed for its sixth day on Monday morning, Judge Mark Windham called Canadian attorney Jeremy Tenser to the front. The court had received “a credible description” of Tenser following one of the jurors in his vehicle, the judge said. “This juror was so frightened by the behaviour that she described that this court was forced to relieve her.”...
Tenser, an entertainment lawyer in Los Angeles, represented Leibel in several Hollywood deals. The pair know each other from their time at Western University in London, Ont., Tenser says. And since Leibel was accused of the murder in 2016, Tenser has been his most vocal supporter. Until Monday, he had watched the trial unfold from a seat in the Los Angeles courtroom, usually directly behind Leibel.
“I had no idea a juror was in front of me. That’s absurd. This is absurd,” Tenser told the judge. “Your honour, please listen.… You’re nodding at me but you’re not listening to me.”
The juror in question was excused Thursday after a private meeting with Windham. In dismissing her, Windham thanked her for going above and beyond the service expected of a juror. An alternate was selected to take her place.
Last week, Windham had ordered Tenser to stay away from all jurors, witnesses and attorneys in the case – an order that stemmed from Tenser’s conversation with a witness who collaborated on a graphic novel with Leibel...
...Takasugi announced Leibel would not testify – a question that has hung over this trial for days. Judge Windham spoke directly to Leibel, making sure he was confident in his decision to stay silent.

After a series of court rulings from California state judges, it is de facto impossible for California to execute anyone. California governors have not challenged these rulings.
My guess is that the current policy of retaining death sentences while knowing that there will be no actual executions is a political compromise designed to keep conservatives and liberals relatively happy.
There is also a practical advantage. "Lifers" on death row have fewer privileges than non death row lifers. Thus, victims and their families receive more justice.

It was the first time the prosecutors had ventured to answer why Leibel, a 37-year-old graphic novelist from a wealthy Toronto family, would have killed 30-year-old Iana Kasian in 2016.
For the past six days, prosecutors presented jurors with a vivid image of Kasian’s final hours, lying immobile in the bathtub of their West Hollywood apartment as her blood flowed out of tears and gashes in her head.
“I’m sure you’ve asked yourself many times,” deputy district attorney Beth Silverman told jurors in her closing arguments Tuesday, “how could another human being do that to someone he supposedly loved?
“There has to be a level of frustration, thinking to yourself, ‘I just don’t understand how a human could do such a thing.’”
The answer, she said, is control and jealousy. Kasian’s mother had travelled to Los Angeles from her home in Ukraine for the baby’s birth. After, Kasian started spending more and more time with the baby at her mother’s apartment, not the apartment she shared with Leibel.
“What happens after the baby comes home? Within four days, she’s out. She can’t stay in the apartment with him,” Silverman said. “He’s jealous because now the baby’s in the picture and it’s taking away his attention.”...

Pieces of Kasian’s flesh were found on the bed, behind the mattress and on the floor while a bed sheet showed Leibel’s bloodied handprints, THRreported.
In the basement of their apartment building, police also found 11 trash bags, some of which contained sheets covered in blood as well as Kasian’s body parts, including chunks of her hair and scalp, the publication reported.
“He threw away pieces of his fiancée like she was trash,” Silverman told the court. “The mother of his newborn baby.”
“He is a monster.”

Glad he was very swiftly found guilty. I usually have a good stomach about these types of things, but reading what he did to this woman literally made me feel sick and shake my head. Disgusting.

This case made me particularly sick as well. Thinking of that baby and the terror Mom would have felt about whether her baby would survive. Unfathomable. Evil.
