Closing arguments got under way in a Vista courtroom Friday for a Carlsbad woman accused of murder in the shooting death of her schoolteacher husband.

Attorneys on both sides will finish up Monday, then jurors will be asked to decide if it was murder, manslaughter or justifiable self-defense when Julie Harper shot Jason Harper during a confrontation in the master bedroom of their Carlsbad home on the morning of Aug. 7, 2012, as their three young children watched cartoons downstairs.

Before Julie Harper killed her husband, there was no evidence of emergency room visits, no black eyes covered with makeup. No friends or family reported violence in the couple’s relationship. There were no whispered disclosures of spousal rape.

Harper, a mother of three, told no one of any abuse by her husband until after she shot him Aug. 7, 2012. Facing a murder charge, she testified she had acted in self defense after Jason Harper attacked and threatened to kill her in their Carlsbad home...

Much of the case hinged on her credibility. Some jurors accepted her testimony, some did not... After finding Harper not guilty of premeditated murder, the jury deadlocked 9-3 in favor of acquittal on second-degree murder, and split 7-5 in favor of a guilty verdict to manslaughter, both voluntary and involuntary. The District Attorney’s Office is now mulling whether to retry her on those charges.

Good that a retrial has been ordered. According to the included news video, she'll be facing 2nd degree murder charges around April 15. 2015. She'll remain out of jail on two million dollars bail and won't have custody of the children.

I'm glad this is going to a new trial & hope she doesn't walk free..
It's one of our local murders & I've been following it for awhile.

Hadn't really believed her self-defense story, and think she had probably been dreaming about killing him for awhile.

He didn't seem like a joy to live with and I don't think most people saw his ugly side. He is really nasty to her in the videos.
Still not a reason to shoot someone. Too bad she didn't just leave & wait for the divorce to settle.

A Carlsbad woman accused of killing her school teacher husband in August 2012 is pregnant and due to give birth in the middle of her upcoming retrial -- slated to start at the end of April -- according to recently filed court documents...

A motion filed by Deputy District Attorney Keith Watanabe last week states that Harper’s defense attorney informed the court in February that his client is pregnant. The document says Harper is slated to give birth mid-trial, and is hoping for a postponement.

Watanabe’s motion states that Harper was pregnant during her trial last fall and has said her pregnancy is the result of in-vitro fertilization... The 41-year-old’s due date is May 12. But the pregnancy is high-risk, and her doctor has recommended she have a caesarian section -- commonly called a C-section -- two or three weeks before her due date.

It's like she's squirming when she can't be in control, is not ready to face the music, & keeps grasping for another way out, or to stall.
Really sad that some poor kid is getting born into this mess.

Whoa, I didn't see this trick coming. Every decision she has made has been selfish and cruel starting with killing her husband instead of just getting a divorce. She cheated her other children, and put her other family members through hell. Now she's bringing another child into the world

A woman who admitted to killing her husband three years ago in their Carlsbad home while their kids were in another room took the stand Tuesday in her retrial, recalling just how allegedly toxic her marriage became in the years leading up to the murder.
Julie Harper admits she shot and killed her husband, Jason Harper, on Aug. 27, 2012, but has said she did it because she feared for her safety and was afraid her husband would kill or rape her. The couple’s children were in another part of the home watching television at the time of the shooting.

After an acquittal on first-degree murder charges in her first trial last October, Harper now faces second-degree murder charges in her retrial, which continued Tuesday in north San Diego.
Visibly nervous, Julie testified Tuesday, telling her side of the story to jurors.

Excellent! So happy. I think she really thought she would get off on this. Glad his parents adopted the 3 kids. Wonder who is the father of the newborn baby. Hopefully this baby will not be part of her life.

Check out the picture of her tears for herself. :anguish: She thought she could get away with it by telling all those lies.

Prosecutor Keith Watanabe did a fantastic job. He was brilliant, IMO. Letting jurors experience what it'd take in pressure to pull the trigger of that gun was a unique strategy that made it clear that gun did not go off accidently. The gun had an 11 pound trigger pull.

Poor mrs Harper has the sniffles & a sore throat & can't get prompt medical attention in jail.
Can someone remind her she left her kids parentless?!

Also- don't hold your breath. She doesn't really explain the new baby thing...IMHO it's just a ploy to get a reduced sentence.
