CA - Joey, Summer, Gianni, Joseph Jr McStay Murders - Feb 4th 2010 #10

As soon as police became aware that Joey and his family were missing, however long that took, one week or two, they would get Joey's and Summer's cell phone records and see that their phones went off the network early evening on the 4th and never connected again.

When they would look at Joey's bank records they would see he issued cheques on the 5th and the 8th (if they weren't backdated) but there were no other signs he was alive after the 4th. He wasn't answering or making business calls or emails or personal calls, he hadn't been seen by anyone and neither had his wife and she'd had no interactions with anyone either, but Joey was supposedly still writing cheques that got into Chase's hands.

Chase creating cheques from Joey's bank account on the 5th and the 8th BACKDATED to the 4th is prima facie evidence that he knew already by the 5th that the date would be discovered and that Joey wasn't alive and writing cheques himself on the 5th or the 8th.

At that early stage Chase never said he was writing cheques himself, he made out Joey gave them to him on the 4th, and he didn't say they were blanks. This version that he wrote them himself with Joey's permission was developed later to answer to the evidence, that's what guilty parties do with prior statements that don't fit the evidence, it's called tailoring.

Was it actually asked by either side if JM DID have a pin or password protected phone? I don't recall that.

I do not believe they asked. But if someone physically had his phone, it could have had direct access without entering a PIN... problem is, it would have to connect to a tower, and there would be record of that IMO

I can't help but wonder why he backdated the checks on the 5th to the 4th - did he expect the bodies would be found shortly and LE would know they had all been killed on the 4th?

Did he not plan to bury them until the 5th, then go out there that night, dig the graves and then take them all there on the 6th? Where oh where did he keep the bodies between the 4th and the 6th?

Decomp smell would have pervaded the house if he'd just left them there so it must have been elsewhere, but why on the 5th did he think there was evidence that the family was killed on the 4th, necessitating him to backdate the checks?

Good question! I wonder if anyone looked for that? I wonder if he had EVER called Summer? Didn't they have a house phone as well? Did Chase EVER call that number? I don't mean in Feb 10, but ever? Did the family?
We know Dan tried to reach Summer when he couldnt get a hold of J. Left VMs.

I don't recall Dugal mentioning his name, but don't doubt it.

Those that knew Joey may have been able to figure out his PIN easier than Summer's too... I do wonder if anyone ever asked Mike. IMO if it was my brother and his family, I would probably try to hear them as well... not sure I would delete them all though (but accidents happen?).

One of my nagging questions is this:
MacGyver testified that he was helping with the painting of the house because they were under pressure due to the floor being installed on Thursday the 4th. What ever happened with the dang floor? Why wasn’t it ever installed? I find that loose end strange.

Chase and Joey were joined at the hip for years so it’s no stretch he knew Joeys password for his phone if he had one.

I am sure Chase knew a ton of stuff about how Joey worked and so on as they spent so much time together.

MacGyver testified that he was helping with the painting of the house because they were under pressure due to the floor being installed on Thursday the 4th. What ever happened with the dang floor? Why wasn’t it ever installed? I find that loose end strange.

Not a loose end....

The flooring guys said it would have to wait, IIRC it had something to do with the moisture. That's why there was no urgency to get the painting done by the 4th. I can't recall what day Summer found that out off hand though, it was either the 2nd or 3rd. I would look it up, but I have to get ready for work ;-)

Another strange thing to me was that no one ever asked MacGyver about the bleached carpet. I mean this guy was our only witness to life in that house in the run up to the disappearance. He would certainly have known if that carpet was bleach stained, at least I would think he would remember that.

It’s my understanding MM sold the flooring and gave the proceeds to Heather.

I read many posts here from people saying theft alone doesn't prove he murdered them, but the way he did it is proof he knew Joey wasn't alive after the 4th and only the murderer could know that.

RIGHT!!!! I wish they had asked him about that too. We don't even know that it was bleach. I have wondered if it was paint myself... knowing that McG said the boys were "helping", even painted the front bumper of the truck I think lol

Do you know the handy trick with the youtube transcripts? LOL There is 3 little dots to the right of the Save .... click that, click open transcript, then you can try the "find" and search key words, like "floor". ETA: if you find floor.. then click that in the transcript, the video will jump to where it is :)

Thanks, Missy. I have very detailed notes of everyone who has testified. I will start there with DuGal (I already checked MacGyver’s). If I don’t have it I will do the transcript search thing. Thanks so much.

BBM. Such a good question! Where were they?

This was fascinating in the profiler book Whoever Fights Monsters

In cases like these there are up to 3 actual crime scenes.

In reverse order we start with the graves/dumping spot - this is typically called the crime scene. The victims are seldom killed at this location.

Before that will have been a place where the murders happened - a place the killer feels safe and controls

And then first up, the place the victim(s) disappeared from

There may be significant overlap - e.g. as a killer becomes more confident

In the McStay case these is a lot of focus on where they were killed because of the mystery aspect but in cases I read about, this aspect was not so significant in terms of apprehending the killer. Indeed that interim location is often not found.
