Joey's phone moved to the closer tower, Chase's didn't move. You're entitled to your opinion and I'm not trying to change it, but I'm just pointing out a meeting is not based in any direct evidence, it's based on Chase's word with no cctv footage or any sighting, and as the murder accused he has an incentive to make up his own narratives to best suit his defense. When he was interviewed his narrative involved Joey handing over all those cheques dated the 4th, which Chase would go on to create after that date.

My opinion is also based on Chase driving to Fallbrook after Joey called him at 5.47 pm. It makes more sense to me that if Joey was expecting him and was ambushed in his office, also knowing that Chase backed into the driveway which indicates an expected arrival rather than a hidden one, that two meetings in one day, especially after a 2 hour lunch, would not be necessary.

np, I was trying to see if the theory could fit for me LOL Why do you think LE said they verified it, if they really hadn't? I had expected to eventually hear "how" they verified it.

I was wondering if he (Joey) did use his CC? And maybe the prosecution didn't want to be the one's to introduce those records. I think it would have opened it up for the defense to cross exam about the rest of the transactions. Just a thought.

No, he ruled that her testimony could come in. But, the jailhouse recordings SHOW that CM was attempting to get her to "remember" that JM owed him money, not that CM was in debt to JM. The State had previously proven that FACT! I'm not sure if the DT will call her now?

What video are you watching? LOL I thought the judge said that it could come in for "impeachment" purposes, but she she hasn't testified yet, and it would depend on if she testified about it and what she says first?

I think you are correct, however, she would NOT be a good witness for the DT.

you just be quiet LOL I want to see her testify... her and Dan! LOL Why do you think she would not be good? I found it interesting that McGee said that she has said the same thing since Feb 2010, even when they threatened her that they were going to charge her ... I haven't listened to all of the new recordings, but last I heard from the judge, he told the defense all her prior statements, including the video of her being interviewed by SD detectives could be shown.

McGee tells the judge, I can inform the court that the interviews that Ms. Jarvis had with LE, that is what she kept telling them, that is a review of the conversation, and the officers kept telling her that can't be right, you're wrong, he wasn't there, she like no, he was there, I saw his phone, she has said that since Feb 2010, and they started trying to trip her up, saying well what about this? and trying to change her testimony and change her statement, they were trying to realistically manufacture evidence that he wasn't home. And she was very clear in Feb 2010, she's been very clear in all emails with other people and very clear with SB, he was home when that phone rang, I saw it ring and I wondered why he wasn't picking it up. So this is not Mr. Merritt trying to convince Ms. Jarvis what to say, this is a rendition of the statements she has said since day 1. Even though LE tried to get her to change her story, I shouldn't say that, SBSD tried to get her to change that story, she has stuck to it, and she (someone says something).. McGee: even under threat of arrest, they were threatening her if you are going with this, then you're an accomplice and we are going to arrest you too, she still held her ground, that's what happened, and that's what the conversation was, it was not Mr. Merritt trying to tell her what to say, it was a reminder of the recorded conversation and the contents of it.


Judge: alright, that may be. I still think that conversation is relevant. If that conversation is played however, for that inference that Mr. Merritt was trying to get her to say certain things, then the defense would be able to put on the earlier statements to show that Ms. J didn't need to be reminded or convinced of anything, that she had said that from day 1 and continued to say that.

The other thing I'd like to know, have the prosecutors given an explanation of how it was possible for Chase to do all the alleged parts of the crime alone, such as murdering at the house, driving the victims (alive or dead) to the grave site, burying them, driving the Isuzu Trooper to Mexican border (did the burial happen before or after the Mexican trip?), leaving the Trooper there, and somehow managing to get from the Mexican border to home or to the burial site with a vehicle other than the Trooper (or motorbike? bus? taxi? rental truck?)

The point is, if all you have is circumstantial evidence, some of which are unreliable, without any forensic evidence linking the defendant to the murder, you need at least to show that what you allege he did was practically possible. A convincing time sequence conjecture or various possible scenarios such the different ordering of events ABCDE or BADCE will help.

WHY would anyone else, have to be involved? He drove to Fallbrook, in the evening of Feb. 4, 2010. He may very well have/probably had a gun (he has been known to go shooting, up in Victorville, when he was younger), overpowered the parents and murdered everyone. He loaded the bodies into his truck. Drove back home and the next day, looked for a secluded spot to bury them, ending up in Victorville. The next day, drove back to Fallbrook and took the Isuzu to San Ysidro. There's a Greyhound Bus Depot about 2 blocks away from the parking lot, where he left the Isuzu. I have parked in that same lot myself (more than once) and walked across the border (many years ago), no one ever stopped/questioned me or towed my car--just sayin'. There are also all kinds of buses that cater to Latino's that travel from the border to L.A., Northern SD county and the Inland Empire. Then there's the SD Trolley, which he could've taken to the Coaster (Amtrak) located in SD Old Town Transit Depot, to Oceanside, then used North County Transit to Fallbrook, back to his truck. He has been to Mexico, in the past and is familiar with all of the different types of transportation going northward. I am quite certain, that he had been planning these murders for a LOOOONG time.

Jailhouse recordings: CM attempted to persuade CJ that he was owed $$ from JM, which in fact is NOT true, which the State has PROVEN toward their motive as greed. Also, witness tampering.

IF CM is innocent, why would he want CJ to testify he was owed $$ from JM? Explain that !

I don't quite understand the context of your question.

I'm reluctant to say what my suggestion was in case, even the smallest possibility, the defense is reading here.

I "think" the Pros has the goods on her and is waiting for CM and his DT to call her, IMO.

The Jailhouse recordings were NOT favorable to CM in any way. The Judge (Impartial trier of fact) agreed with the Pros about what they discovered on the recordings. Period,

FT, didnt you remind us that Merritt and she shared the bank account? Then she would have been aware of the check cashing. Would love to hear the PT cross examination on that subject.

Yes, the $42K aligns with the Pros that CM was overpaid.
But let me play devil’s advocate here. I think it indicates Joseph owes Merritt money. That’s why he tacks on the 2 fountains at the end - it’s additional money he owes to Merritt for work done. (I really don’t think it means that. I am honestly not clear what it means. I am sure Maline is going to claim it means JM owed Merritt.)

I would like to have a better understanding of what those jobs were... The Provecho and the Levine projects. I think one of them may have been the 'insurance' fountain? But I'm not sure.

Didn't Metro Sheet Metal sue EIP after Feb 2010? Does anyone know how much or have any info about that?

IIRC, Metro sued Mike McStay after he took over EIP.
