I don't see how the items from the house being found in the graves implicates CM. The check attempt comes from data retrieved from the desktop computer however, not until after it was removed from the house by MM and then latter retrieved from him be LE.
MM wouldnt attempt to print a check for Merritt. Especially a check identical to the ones already printed and cashed by you know who.

These points about the "security monitored parking lot" are excellent. I have LOTS of experience with professionally "monitored" parking lots! No pun intended. Very often, those doing the monitoring are doing LOTS (there it is again!) of other things whilst said monitoring is supposedly going on, but certainly wouldn't want the lot manager/owner to know how lax they've been. They aren't going to advertise that they don't patrol as frequently as they're contracted to. Some do things like rent out spaces behind the manager/owner's back, some take bribes, some are just lax. This is my experience. I'm not saying that's what happened here, but it would surprise me not to know the security company was lax.

However, my calculations don't find the time required to go down, plant the Trooper, and get back all that tight, especially if someone helped him. I guess we could look at bus times, which I think was done in earlier threads, but if he had access to a vehicle, I think it could be done without difficulty.
Lax being the operative word. And dedication to doing one's job. Not sure we can trust any of this. MOO.

And if anyone finds that out... I would like to know how much he was paid in total for the Saudi job, including the cheques he wrote himself lol

I don't know if we have this available, but I do know how much the Saudi job was in total ($61,542.50, which appears to have been paid on Jan. 15/10) I saved the invoice/purchase order awhile back when I found it in the old threads, might have to take a snip of it show it but am not sure the quality will be that great since the quality of the copy I have isn't the best *sigh* Now that I understand what Joey was doing with paying Chase, I would be curious to know how much MSM was paid and how much Chase was paid in full as well.
Wow. This is so interesting because earlier when we were looking at spreadsheet, I calculated the 15% - I was just guessing it referenced 15% of the over all job. I came up with a little over 61k for the SA job. And now I see you post that amount. So Merritt was getting 15% plus that “savings” amount, which we don’t know what that is plus an install fee, if he was installing it. He went from 65% to 15%. Hmmmm.

IMO Joey was very fiscally astute. In the majority of sales oriented businesses, especially when your product is a specialty item, you choose a fiscal year that works with your high and low sales periods. You don't want to owe taxes at a time when you are short on revenue. Joey may have also used a fiscal year that corresponded with his business or partnership date inception. jmho

What is the significance of the fiscal year to this case?

I may have missed some posts while trying to catch up... so I apologize if this part has already been discussed. But maybe the confusion over the bounced check during SB's testimony is this:

Leticia Juarez‏ @ABC7Leticia

Blake said she did not receive any funds from the fountains because they were not completed. She signed checks for the business.

2:30 PM - 8 Jan 2019

Leticia Juarez‏ @ABC7Leticia

She only wrote checks for six to seven weeks on the business but did not view bank statements.

2:31 PM - 8 Jan 2019

Leticia Juarez‏ @ABC7Leticia

Maline approaches Blake with a document to refresh her memory. He asks if she calls issuing a check for $2K. The check bounced.

2:33 PM - 8 Jan 2019

Leticia Juarez‏ @ABC7Leticia

The check was drawn from McStay's Earth Inspired Products business at Chase Bank.

2:34 PM - 8 Jan 2019

Leticia Juarez‏ @ABC7Leticia

Defense asks if anyone was helping Blake run the business like Michael McStay. She said she can't recall.

2:36 PM - 8 Jan 2019

Leticia Juarez‏ @ABC7Leticia

Defense asked if she was helping to keep the business going why wasn't she aware of the balance.

2:37 PM - 8 Jan 2019

Leticia Juarez‏ @ABC7Leticia

Defense asked if Blake knew Kavanaugh withdrew bank account. Prosecution objects on speculation. The judge sustains.

2:39 PM - 8 Jan 2019

Leticia Juarez‏ @ABC7Leticia

Blake said she closed the bank account and funds went to Jonah McStay, her son's firstborn.

2:39 PM - 8 Jan 2019

Leticia Juarez on Twitter

Mica was wondering about a $17K cheque that bounced. I see there was a 2K one mentioned in Susan's testimony.

OT sorta... how was she able to close the bank account? If it was the Chase Bank account, I think it was an EIP business account according to the tweets that day as well. I know here there are laws that require waiting for so many years after someone is reported missing before money can be claimed, whether a bank account, insurance payout etc. Maybe that is just Canada?

The problem with the computer being removed is LE has no idea what was done with it while it was in the possession of others.

Maybe with LE’s involvement she was able to close it. She was writing checks on it, so she must have had some kind of authority. Maybe she just ran it down so far the bank automatically closed it.

Well now that’s not exactly true. They know when it was taken and they know when it was returned. If they know who searched for what at 2 in the morning, I’m sure they can figure out if Mikey messed with anything during the timeframe he had it in his possession.

I think the acct SB is talking about is the one opened after MM registered EIP.com in his own name. IIRC...which I might not.

But what you are missing is that Joey was paying expenses at this point... since October, and that was MSM who were manufacturing the fountains.... and Joey was paying MSM directly for that. I did the math on my earlier calculations and it was within a percent or so of the 15% ... what Chase was getting in October 2009. So possibly Joey changed that to 15% on Feb 1st? or maybe they used that as an estimate? But that doesn't make sense to me either because theoretically, Chase could make money and do even less work... lol If MSM billed Joey for everything they were doing, including what Chase was supposed to be doing, Chase just got the remainder of the 65%, in theory, it could have ended up being $0.

Again, before October... when it shows Chases $$$ and it's 65%, do you think there were no expenses? (I am still unclear if Chase paid all of those or if Joey paid them and subracted from the 65% or a combination of the two) And if you do think there were no expenses, how do you think the fountains were actually made, with what products? How were they shipped?

That "savings" thing.... I can't think of anything logical that it represents lol

It did say she gave the money to his oldest son, so there must have been some left in it.

I'm not sure how much LE would get involved in that, but maybe...

True. But MM wouldnt print Merritt a check identical to the ones he cashed. Right?

Just as an example... about the voicemails which you have transcribed in your post, we learned that VM's were deleted and that the VM's that they did find on Joey's phone were from after it was reported in the media that he was missing, so how were they to find VM's from someone that left them previous to that if they were deleted?

RSBM

I'm a few pages back in being caught up here but I've wanted to ask this - since Joey's phone wasn't found, how do we know VMs were deleted from it? I've always been confused on this issue.

ohhhhh could be! That makes sense Cricket... and would make sense as to why we didn't hear about an EIP business account at Chase Bank, and why the defense has subpoenaed those records.

Thanks so much!

Not to mention Sequieda calling Joey a "crook" during testimony.
Was this because Joseph wouldn't divulge his percentage at the time?

Patrick says in his book that after the disappearance, he and Gina began looking closely at CM because she knew him from the waterfall industry. According to her CM had a horrible reputation. As many will remember Gina W. was a friend of Joey's who worked for one of his suppliers. So I would say he had burned bridges with others in the business.

MOO

Just to make a point: A person with a " horrible reputation" is also the easiest to be made a target/scapegoat. How many murders in history were committed by people without a horrible reputation?

Hi @geevee :) Was wondering where you were!

In Dugal's testimony, he is asked questions about listening to the VM's. The VM's that were on there, that Dugal was given access to from the cell phone company, the 2nd message mentions knowing they are missing, which indicates it was after it was in the media. Chase said he left VM's, but they were not on there. Susan and Mike also said they left VM's, but they were not on there either. Dugal said he believes there were VM's from the 4th-at least the 15th that were deleted and missing.

I do have links to the testimony if you would like it.

No clue LOL I was wondering that myself..

Could it be that they changed the 65% minus MSM or expenses to 15%? It would be inline with what he was getting paid anyway after they were in partnership with MSM? it doesn't explain the "savings" part of that... how confusing! LOL

I am still wondering when Joey's fiscal year end was, and I have not heard or been able to find that.

I think I now understand the MSM issue with wanting to know how much Joey was getting paid for the fountains. They wanted to know how much Chase was getting paid, because if they were doing some of his work, they wanted to be paid for it. Joey tells them it's none of your business, just bill what you do and I will pay you... So if they billed what they did, even part of Chase's job, they did get paid for it and it would have come from Chase's "cut" anyway, and that was probably Joey's thinking, because it really was none of their business how much Joey was making. JMO

Joey does not strike me as someone that would keep a fiscal year. IMO/MOO, Joey just went by calendar year.

What is the significance of the fiscal year to this case?
I was simply responding to the post by @missy1974 and your reply to it. Clearly, we disagree. :p

Still here! :D

Somehow my brain glossed over that testimony, thanks for the refresher, Missy. :)
