This is the part you are thinking of -

Chase: I’m trying. Um the DA’s premise is that I left that evening at 5.48, went into Bonsall and came back, at 9.32 I made a call from they say the 15 freeway going north, but my phone hit two towers near the 60 freeway but definitively show, you know, if, if the towers are correct, I’m going east on Van Buren, not even on the 60.

Cathy: That night?

Chase: Yeah. What would I be doing on Van Buren Boulevard, at 9.32 at night? There’s nothing over there. There’s the 60, Van Buren runs parallel [inaudible].

Cathy: Is that in Riverside?

Chase: It goes to Riverside. At 9.30 at night I wouldn’t be going out there.

Tortoise always gets it right. :)

I know that he mentions Van Buren Blvd near the 15 and 60 fwys and how there is "nothing out there". But I don't recall him ever mentioning Ventura. In fact Ventura is probably 2 - 3 hours in the other direction.

MOO

Yes, it was Van Buren and not Ventura, my mistake.

So "some officers" will testify tomorrow, Mike won't be on until Thur. the 28th and someone named Fiedly (Randolph? it was hard to hear) may be on Wed. - does anyone know who that is?

There was a painter who bailed and supposedly was based in Las Vegas. That was thought to be why McGargar was asked to paint, because the original painter disappeared.

He was either from Vegas or Mexico. I remember reports that he took off for Mexico to visit family. Not sure how accurate any of this is.

They said they didn't have anyone for Wednesday, but they would try to dig someone up.

So, not quite the 'well oiled machine' that the defense promised during their OS.

Randolph Beazley Beasley crime scene specialist. From defense OS's:

We saw that there is a lot of information about the crime scene, so we wanted to get the person that we knew about crime scenes, so we got Randy, or Randolph Beasley involved. He has spent 30 years with the San Bernardino Sheriff's Department as a crime scene specialist, a trainer for many of the people who you will hear testify in this trial.

The judge at the end of the day was saying how he understands about experts and blah blah blah... way too passive for my liking! I can't believe the delays and days off in this trial. But I do think it's a catch 22 with the jurors, the time off may allow them to absorb and think about the info and not have information overload, but it's still a really long time for them. Cannot believe we have not lost 1 juror yet!

LOL @JMarsh Trying to get missy booted for "repeat posting" aye...I'm onto you!! :p:D

Oh no. Never. I have problems finding older posts sometimes and it helps if there is a number referenced. But the last thing I would want is to lose Missy. She does some great research. And is constantly hearing/seeing things I missed.

I don't know if that was in addition to the 5K.

The only problem I have with this is ... how in the world does anyone think these fountains were being made? Things had to be bought to make them, time was spent making them, was Chase or anyone supposed to do those for free? I don't know that the amounts line up with the cost of the fountains and neither did Susan or does she now. I don't fault Susan for this one bit, she was doing what she was doing to just try to salvage what she could. I am also not sure where MSM comes in here... did they also receive payment? and from who? Dan or Susan? If the money coming into the bank account was 36K like was indicated by Maline... 15, almost 16K was not much when looking at the costs of making these fountains. JMO

One question for anyone that knows... what is with the $3300 cheque? Did it get returned as NSF? or? I missed this in earlier testimony I think ...

ETA: I also don't fault Susan for not remembering what was what back then... first off, it was 9 years ago, second, the amount of stress she was under. JMO

The defense promised a forensic accountant, and my thought is we will get a full report with that testimony.

So with all this money Merritt was given per SB's testimony, did CM ever deliver on the goods that the money was for? The fountains?

Susan Blake's testimony yesterday actually made me re-think my position on whether Dan K. could be responsible for these murders. I'm beginning to think he might have been. He certainly could have hired someone, promising monies later. He was the only person Joey actually took steps to get rid of. Steps that can be objectively verified. And he might have been able to lure the family out of their home Friday morning the 5th.

Maybe the trip to Hawaii was done to provide him with an alibi. That this was part of the plan.

I am also now convinced that the family was alive until Friday morning, and that they were very likely lured from the home.

It's interesting in his own language selection Chase allows for the fact that he was indeed on the road going somewhere and not at home per his alibi

Yet CJ is crucial to his official alibi per his own defence and statements

Shouldn't the two of them know he was at home when speaking candidly and privately between themselves?

  • #798
That's not the 8.28 call though, which is what he said he never remembered.

He does go on to talk about his phone being on towers going north on the 15 freeway at the 9.32 call after that part I posted, but that's not where he says he never remembered that call.

It's interesting that the defendant never remembered the call, he has produced no call log for it, and he has no billing records for it and apparently never showed the device log to Dugal, even though it was topic of discussion as to when he last heard from Joey.

CJ can't be sure he received the call that day. Maybe it was another day.

In private conversation, CJ and CM allow for the fact that CM was not at home at all but out on the road - Chase wonders where he was going?

Yet according to his daughter, CJ and Chase fought about it a missed call there are no records of.

In that case how do we explain Merritt's DNA in the Trooper?
And Merritt's statement to LE about if he would murder anyone it would be DK?
Looks like CM really hated DK if he said that IMO. Wonder what was up with that?
