Notice how in the interview they ask him what time he normally goes to bed and he asks Cathy 'what time did we go to bed?'

Cathy testified that they weren't even sharing a bed at that time - he was on the sofa!

Imagine if he said instead: "What time did I go to bed and you go to the sofa?" :rolleyes::D

He makes my head hurt trying to follow all of his ramblings.

Imo,he uses distractions as an evasive maneuver. By the time he is through answering one simple question he wants them to be so confused they have no idea what he really said.

One thing comes across clearly imo. He is a man consumed with himself.

YES. And is so accustomed, to dealing with L.E., that he really thinks he can outsmart them. Which he did, until the deceased bodies showed up. In his old stomping grounds.

Yes but more fool her for going along with it now. She may of been under his thumb when he was a free man but he is now in jail. So the fact she is willingly going along with his lies make her just as vile.

According to her (Jarvis) testimony - Merritt recently told her he still loved her...I think that's the only reason she still stands by him. She's obviously not thinking with her head.

IMHO she is more than just "collateral damage." I think she is complicit in trying to obstruct justice.

I haven't heard of anyone seeing Joey on the 4th.

How that lunch time went down, I believe more than likely, is Joey arrived at CM's apartment but couldn't find him there. I think CM hid from him, maybe in the clubhouse or in his apartment. Joey called him from outside at 12.52 pm and CM told him he was out and to go and find somewhere to eat and he'd meet him there, knowing he wouldn't show up.

CM phoned him at 1.01 pm and Joey told him he was in CFA.

I believe Joey waited, doing some internet business, CM didn't show up and Joey phoned him to let him know he was leaving at 3 pm.

I think CM said he would come to the house later and asked Joey to phone and let him know when he got home.

I also think Joey stopped to do some food shopping on the way home and that's why food was out on the counter still.

Thank you. So you think CM was a no show because he knew Joey had called him about what he had discovered on his account?

In other words he was stalling for time, and then decided how he would take care of the problem?

I think this was planned months before, whenever Joey started getting sick. I think CM was poisoning him to weaken him and I think his plan was to steal the business contracts as soon as he thought Dan was going to be paid off. Dan was the spanner in the works because he did not relinquish control.

I also have a feeling that this was maybe going to go down on the day he printed the first cheque, on the 2nd, but McGyver being there scuppered that plan.

So I think it was completely premeditated.

He was in and out too quickly with the four bodies for it to have not been planned with precision. He had a plan for containing the blood, where he would put them until he could bury them, for not having his phone on, he'd stolen the cheque stock.

I think the cheque at the house was also planned, maybe the printer mucked that up, how he would deal with the dogs, he probably had even purchased the big bag of dog food in advance, the window opened so he could come and go through the back without neighbors observing him, where to put the Trooper until he could take it to the border, the whole lot.

ETA Maybe even that's why he didn't care about slacking off work in the month before because he thought it was all coming back to him, he'd deal with Joey before Joey could deal with him.

I agree, 100%. And he was hanging around the house, getting to know their habits, the neighbor's habits, befriending the dogs, observing and planning...

DK was the fly in the ointment. Susan testified that she witnessed a "scary" fight between the two timed felon and DK with CM demanding more money. Susan said it was very scary to her.

Yep. It's amazing that his reputation is one of not following through, but with this family he was there every minute like a parasite, packing their belongings, digging out the decking, putting up with Summer's verbals, moving all the 50 pot plants, etc. That's an anomaly.

Wow, now that you link it altogether so well, I can clearly see this all happening, just like you've listed.

You have an amazing mind to look at so many different events, and pull them altogether in a very cohesive manner.

I don't believe his story about the office lamp always being on. I think he left it on so that when he came and went at night no one would observe a light going on and off and he would have light in the office.

I don't think the lamp in there would have lit the kitchen or the staircase for the boys getting water at night and I don't think it's likely the boys would go to the refrigerator to get water either. I believe parents generally would make sure their little kids had a drink by the bed if they habitually woke for one,

But now that I've read Tortoise's theory, I now believe it was in the works for quite awhile before carrying it out.

It does explain why he was constantly up their rear end for months in their home, plus it shows how well he was able to carry it all out, and almost got away with it.

He had planned, and was fully prepared when he stepped in their home that tragic eventful day for all of the family.

It rips my heart out knowing Joey, and his family was around this creep almost nonstop, and none of them were aware of what he had planned for them all.

I never bought into that either. It never illuminated anything but the office. And there was no way the 3 and 4 year were going down in the middle of the night for water unattended. They were all sleeping in the MBR! I just couldn't figure out why he said it. It fits with him saying that Joseph had allergies and slept with the windows open. Anyone who has allergies knows it is just the opposite. He speaks way too much, embellishes, and speaks with forked tongue.
I hope the jury in this protracted, disjointed trial has payed attention and taken copious notes.

But now that I've read Tortoise's theory, I now believe it was in the works for quite awhile before carrying it out.

It does explain why he was constantly up their rear end for months in their home, plus it shows how well he was able to carry it all out, and almost got away with it.

He had planned, and was fully prepared when he stepped in their home that tragic eventful day for all of the family.

It rips my heart out knowing Joey, and his family was around this creep almost nonstop, and none of them were aware of what he had planned for them all.

The only thing that makes me wonder about it being premeditated is the use of a sledge hammer. The hammer makes it seems as more of a crime of opportunity. Using a gun and silencer would've been much more efficient. Maybe he couldn't get his hands on a gun?

OMG. This is so creepy to read. One question? Where did he store the Trooper? I know you can't answer that definitively but what is your hunch?
