We don’t know how much of the investigation (if any) was focused on DK or anybody else. Seems sketchy DK put in a request for money via PayPal as early as Feb. 6th.

Patrick McStay always had a problem with DK and the PayPal transfers.

Again wrong, the paypal withdrawals on the 6th, 9th and 15th were not authorized by Mike or Susan. Susan and Mike weren't even involved until after the week of the 15th when the SD started the investigation. Those were proven to be DK and he had no authority. He was not on the bank accounts, Joey's paypal account, the qb accounts and he was not an owner or partner on any documents which has been stated by the SD.

Joseph McStay's father, Patrick McStay, told CBS News 8 that he has a hard time believing Merritt had anything to do with the murders.

"What does Chase have to gain with Joey gone? Chase isn't going to get the company," said Patrick McStay. "If you recall, Chase took a lie detector test and he passed."

Merritt claimed in his interview with Daily Mail that he agreed to a polygraph examination at the request of San Diego County Sheriff's Department detectives. He said he had passed the test in the early stages of the 2010 investigation, despite "a couple of inconsistencies."

"Was I a suspect? Well, I don't know if I'm the only one they asked to do a lie detector test, but I am the only one who actually agreed. They were certainly on my case,"

This article is referencing the preliminary hearing in 2015. It we are going to focus on evidence then it should be pointed out that Expert Testimony during the trial has contradicted many of the assertions made during the PH. It's important to listen, and when possible, watch the testimony and exhibits (in evidence during trial). The assertions made during the PH and "probable cause warrants" have been contradicted. That is the evidence that will be presented to the jury and the ONLY proven facts when they determine guilt or innocence. jmho

Since you now want to "stick to the evidence", Mike was asked about that in his cross exam. About 41:00. That along with the information I have outside of the testimony, which I hope they will show, I highly SPECULATE, it was DAN that accessed the emails and the Paypal. I find it really hard to believe that Chase would send Dan money instead of himself if he had access to the Paypal account.

The question about Dan in cross-exam was disallowed, so I was "sticking to the evidence". The jury didn't get different testimony from him.

Dan was co-owner and Chase wasn't, so does anyone know if he had no authority to access the PayPal or email accounts?

Within a week of the family's disappearance in 2010, large sums of money started being transferred out of Joseph McStay's business bank account.

Where was the money going? Who was transferring it and why?

CBS News 8 caught up with the employee who admitted to his involvement in some of those transactions.

Kavanaugh said the transferred money was used to keep the fountain business going during Joseph McStay's unexplained absence.

He said he was working with Joseph's brother, Michael McStay, and Joseph's mother, Susan Blake, at the time the withdrawals were made.

"I actually transferred it (the money) to myself with Mike's knowledge," he said. "None of that money went to me. That money went to vendors, welders and manufacturers."

"Mike and I and his mom tried to salvage and run the business that we had built for a long time," Kavanaugh said.

But without Joseph McStay at the helm, the business would eventually fold.

It sure shows how Joey was the one who really made his company so successful.

It brings tears to my eyes how they all came together, trying to save Joey's company. I would have done the very same thing for my beloved brother or anyone else in my family.

I wish they had been successful, but it's often true, without a certain individual at the helm, the company will just not survive. It shows me what a very special man Joey truly was.

I read a business article one time that stated 6 out of 10 small businesses opened will fold in the first 2 years. So it sure shows Joey knew how to be successful, and the most tragic part of his business... is his business future was brighter than it had ever been when they were all murdered.

Dan seems very upfront, and forthright about what they tried hard to do to keep Joey's business going.

Maybe if it had survived, one day his oldest son would have taken his dad's place, and ran the business himself now that he is a young adult.

That's why it's ridiculous for the PT to claim the family was killed at home, and by CM alone.

In the Groene case in Idaho, one man entered a home, and controlled and killed the mom, stepdad, and a teenage son, then kidnapped the two younger children. He later killed the kidnapped boy, the kidnapped daughter was rescued.

If Merritt controlled the McStay boys, he could control the parents. One lone man can kill a family, several family annihilators, and other murderers, have shown that to be true.

Merritt was a coworker and family friend, I'm sure Joey had no qualms about turning his back to Merritt, leaving Joey vulnerable to an attack.

If he did, it wasn’t up to DK to begin helping himself to JM’s money as early as Feb. 6.

McGyver testified he thought the buyout had been completed prior to the disappearance. Patrick also has discussed the same.

McCargar said that Kavanaugh had considerable computer and informational technology skills and that he was known as “Hacker Dan” or the “hacker kid.”

In a series of questions, virtually all of which were objected to by the prosecution and sustained by Judge Smith, McGee angled for information about Kavanaugh and his reputation. McGee asked if Dan was known as or recognized to be “some kind of irresponsible person” or if everyone “knew Dan as a loose cannon.” Because of the prosecution’s objections and Judge Smith’s sustaining of those objections and because Judge Smith then deemed McCargar’s statements as “speculation,” the jury did not hear McCargar give answers to McGee’s questions relating to McCargar having told Joseph McStay that a vindictive Kavanaugh “is going to come back at you” if Joseph McStay cut Kavanaugh out of the Inspired Earth Products business and that McStay should keep Kavanaugh occupied because he didn’t want him “screwing up the business or causing problems with his waterfall website.”
When McGee stated that McCargar’s information was not speculative “because we have Dan [Kavanaugh] threatening” Joseph McStay, Judge Smith said “I have already rule that is not relevant.” The judge said that Joseph McStay intending to “buy out Kavanaugh or was in the process of buying him out are relevant and you can inquire about that but speculation as to what McGyver or Joseph McStay thought Mr. Kavanaugh’s reaction to that [was or would be] are not relevant.”

Nevertheless, the jury did hear the questions and McGee did get McCargar to indicate that McStay wanted to exclude Kavanaugh from the business and had attempted “buy him out” by giving him an old BMW automobile.
The defense made further headway when Judge Smith stated “If Kavanaugh got proceeds, that is relevant,”an indication that the jury down the line will hear testimony and see evidence that shortly after the McStay family’s disappearance, on February 6, 2010, as well as thereafter, Kavanaugh transferred money out of the Inspired Earth Products account to himself.

McCargar testified that he and Joseph McStay had discussed the buy out of Kavanaugh and that McCargar believed the buyout “had already been done” prior to the family’s disappearance.

No violent crime history.
I've seen cases where older men suddenly turn violent, but their motivation isn't so much a psychological tendency towards violence for it's own sake, but IMO a determined and concious decision to be ruthless, because they realize that's the only way they'll get away with it.

For eg, a recent case of a perfectly law abiding man in his 50s, Paul Caneiro, who, with premeditation, shot and stabbed his brother and family (2 children), for money.

Al Blanco, in his late 50's with no criminal record, with premeditation lured, shot and buried his "friend" and employer Sid Cranston, for money.

CM has a long record, going by this article. He didn't clean up his act and get scared straight, in spite of repeated jail time, over several decades. McStay murder mystery: Who is Chase Merritt?

Even though he was repeatedly caught and sent to jail, he continued to commit crimes to steal money. IMO, he may have had enough of getting caught and decided the solution was to be ruthless. ETA, also possibly by then, unlike earlier in his life, he would perceive he had a lot to lose by getting caught

He did the website. Not an owner. SEO’s are not always owners. If Joey had a possible “gentlemen’s agreement” to pay him until the end of the 2009 year, then Dan was paid off/bought out. Maybe bobcat1 can weigh in on this matter.

I believe your interpretation of their relationship is accurate. I think Joey was "buying out" the website part of the business but nothing more.

Dan was the webmaster, by agreement, for EIP. He drove the sales, via search engine. When Joey started making plans for his own shop and wanted to distance himself from DK, et al. There was evidence of a threatening message to JM. Subsequent to that, DK and JM agreed to a buyout plan for the "internet value DK brought to the business. JM's final payment to DK occurred at the same time as the family disappeared. imo
